Explanation:
1. Wem gehört eine Erfindung?
Die Erfindung gehört" grundsätzlich dem Erfinder. Juristisch ausgedrückt hat der Erfinder das Recht an der Erfindung. Dieses Recht an der Erfindung besteht aus dem Recht auf ein Patent (§ 6 Patentgesetz) und dem Erfinderpersönlichkeitsrecht. Beide entstehen mit dem Schöpfungsakt.

Das Erfinderpersönlichkeitsrecht ist ein höchstpersönliches Recht,d.h. es kann nicht einem Dritten übertragen werden. Es dient ausschließlich der Anerkennung der Erfinderehre, was dadurch manifestiert wird, dass der Erfinder auf der Patentschrift genannt wird, wenn er nicht darauf verzichtet.

Das Recht auf ein Patent, dessen Inhaber zunächst der Erfinder ist,
kann Dritten übertragen werden. D.h. das Recht, ein Patent für die Erfindung zu beantragen, kann beispielsweise abgetreten oder ver-
äußert werden. Derjenige schließlich, der die Erfindung zum Patent anmeldet und ein Patent erteilt bekommt, also nicht zwangsläufig der Erfinder, wird zum Patentinhaber und kann das Patent für seine Zwecke nutzen und gegenüber Dritten durchsetzen.
