Bus/Financial - Law (general)
German term or phrase: Geschäftsaufseher
This looks pretty straight forward, but really is not.
The text is dealing with bankruptcy proceedings in Austria. According to Eichborn, *Geschäftsaufsicht* in the context of Konkursverfahren is
* temporary receivership*.
The sentence in question :
Vor Eröffnung des Konkurses war ich Geschäftsaufseher der Bank.
In the previous paragraph, the same person states: Ich bin Masseverwalter (receiver) der XXX Bank, über deren Vermögen...ein Konkursverfahren anhängig ist.
[The brackets and the translation*receiver* are part of the text]. My question is: what is the differenec between *Masseverwalter* and *Geschäftsaufseher*, and more importantly, if * Masseverwalter* is *receiver*, what is *Geschäftsaufseher*, a position he obviously held prior to the bankruptcy proceedings????
Grateful for any clarification!

(temporary) receivership
Explanation:
Geschäftsaufsicht > (temporary) receivership /Task: To keep things running, in such a way that further losses are avoided, until the liquidation can be implemented (or the business becomes solid).
Masseverwalter > liquidator /Task: To convert assets into cash and, as far as possible, pay off debts.

Thanks to everyone who took the time to research. I will go with temporary receiver- seems the most logical in my context.

guess: managing director

Explanation:
Johanna, although the term "Geschaeftsaufseher" is not used in German law, my guess is that this is the Austrian term for "managing director".

At least, this term does not mean "receiver" or "Masseverwalter" because it is referred to as a position the guy had before bankruptcy proceedings were initiated.

(I did a google-search but was not successful to find this term; plus there is no entry in Dietl/Lorenz).

Hope this helps anyway!

Good luck!

legal controller and/or auditor

Explanation:
Auditor is the word that jumped to my mind, but I can't support this.

And I found the following in a very old Langenscheidt (1956):

Geschaeftsaufsicht - legal control

Hope this helps a little.

Supervisor

Explanation:
I am sure that Geschäftsaufseher in a Bank is a supervisor but I don't know how to explain. Anyway I found this in the link below which states receiver and supervisor as two separate appointments in a Bank.

Appointment of receiver, supervisor, conservator or liquidator, exclusive authority, FIN §36.002
