I had seen several definitions for this word and wondered which would be best. This is from a Leasing Agreement.

"Sie verpflichtet sich, fuer die mit den Wechselkursschwankungen verbundenen Risiken bis zur tatsaechlichen und vollstaendigen Erfuellung ihrer vertraglichen Pflichten einzustehen."

Explanation:
Another suggestion, if it is for a contract, I feel a latin term might be appropriate. Using the equivalent English term by saying "factual", meaning that when the fulfilment of the contractual duties become fact.
