German term or phrase: sonderrechtsfähig
The context is rules concerning the building of structures on a piece of land - the structures are subsequently deemed to be "Scheinbestandteile" of the property and therefore "sonderrechtsfähig." I found in KudoZ that "Scheinbestandteil" = "temporary part of the land." Something deemed to be a "wesentlicher Bestandteil" is not "sonderrechtsfähig."

I believe the legal reference for the concept would be Sections 93-95 of the BGB.
