Diese Frage, die in BGE 129 II 183 E. 4.2. S. 189 ff. noch offengelassen wurde, ist hier zu beantworten, nachdem das Bundesgericht im Urteil 2A.334/2006 vom 10. Wenn sie nicht berechtigt war, von der Bankenkommission eine von den hier massgeblichen Empfehlungen abweichende Verfügung zu verlangen, kann sie
dieses Ziel auch mit der vorliegenden Verwaltungsgerichtsbeschwerde nicht
erreichen, weshalb darauf nicht einzutreten wäre.

J'imagine que par la suite, la recevabilité est étudiée plus avant.
