das Genußrechtskapital wird als Eigenkapital i.S.d. § 10 I KWG ab 1.1.1993 bis zur Höhe von 100% des Kernkapitals aus Grundkapital, Rücklagen und beschlossenen Gewinnzuweisungen anerkannt. Diese Begrenzung ist nicht nur aus aufsichtsrechtlichen Gründen erforderlich; auch ordnungspolitisch soll verhindert werden, das Risikokapital ohne entsprechende gesellschaftsrechtliche Herrschaftsrechte in allzu weitem Umfange geschaffen wird.
