Περαιτέρω, εφόσον τα αναφερόμενα στο άρθρο 1 Ν. 2331/1995 αδικήματα, με τα του άρθρου 2
τελούν σε πραγματική συρροή, δεν μπορεί να υποστηριχθεί ότι οι αναφερόμενες στο άρθρο 2
αξιόποινες ενέργειες αποτελούν μη τιμωρητέες ύστερες πράξεις όταν μάλιστα αυτές τιμωρούνται σε
βαθμό κακουργήματος, ενώ πολλές βασικές αξιόποινες πράξεις τιμωρούνται σε βαθμό πλημμελήματος.
