abandonment clause [in marriage] Explanation: Earlier I answered that it was a prenuptial agreement, but since taklik is a normal part of a muslim marriage contract it you wouldn't need a prenup to define abandonment. If you are talking about maintenance after divorce thats 'alimony' -------------------------------------------------- Note added at 4 hrs 15 mins (2003-12-07 18:46:57 GMT) -------------------------------------------------- * corection taklik is a standard clause in the civil marriage license for muslims in Indonesia sanctioned by the department of religious affairs. Taklik translates as \'ammendment\' and I think that historically it has been a pledge made by a husband at the time of marriage. However since it is a standard feature in current marriage contracts its better to use the word \'clause\' when describing it. -------------------------------------------------- Note added at 4 hrs 25 mins (2003-12-07 18:57:04 GMT) -------------------------------------------------- In Malaysia \'cerai taklik\' means to sue for divorce for reason of abandonment. -------------------------------------------------- Note added at 6 hrs 44 mins (2003-12-07 21:16:02 GMT) -------------------------------------------------- I assume you are refering to a marriage contract. If you are directly translating the document for immigration purposes you should probably use one of the following; \'oath\', \'oath of support\', or \'pledge\'. The religious significance or history of the word is not important as the legal function of the clause is clear when you list the subsequent articles. If you are descrbing the Sighat Taklik you should probably call it the \'abandonment clause\' recognizing that article three describes abuse not abandonment, If you are describing its purpose it is a provision in a marriage contract by which a woman can sue for divorce for reason of abandonmentor abuse. My understanding of how its commonly used is as a mechanism for a no contest divorce when the two parties are estranged. HTH \"... I. note: The Sighat Taklik is an ammendment on the last page of the Buku Nikah after the kutipan akta nikah and is not actually endorsed by the D.A. clerk of marriage records. |
