CIRCOSTANZE ECCEZIONALI:
tale circostanza si verifica nell’ipotesi in cui per una delle parti si sia depositata istanza di fallimento, di concordato o di altra procedura concorsuale e moratoria, nonché qualsiasi circostanza in grado di incidere negativamente sulla capacità di una parte di adempiere agli obblighi derivanti dal presente accordo.
Resta inoltre tra le parti convenuto che, in caso di recesso e/o risoluzione anticipata del presente accordo, azionati da entrambe le parti, il Distributore non avrà nulla a pretendere in termini economici dal Produttore, ritenendosi il primo ampiamente soddisfatto ed esclusione del caso in cui il produttore non abbia ottemperato ad una obbligazione derivante dal presente contratto eccetto nel caso in cui il produttore sia manchevole delle obbligazioni scritte nel presente contratto.
Le parti pertanto si riterranno liberate da ogni obbligazione nascente nel presente contratto ad eccezione dell’obbligo di riservatezza imposto al Distributore, il quale permane per i 3 anni successivi alla data di cessazione dell’accordo.
