The Jesolo Town or Borough Council might have something to do with the matter if 1. there is public land involved or 2. a coastal area is being abutted or encroached on.

Gli immobili restituiti in conseguenza della riduzione sono liberi da ogni peso o ipoteca [2808 c.c.] di cui il legatario o il donatario può averli gravati (1), salvo il disposto del n. 8 dell\'articolo 2652 (2). I pesi e le ipoteche restano efficaci se la riduzione è domandata dopo venti anni dalla trascrizione della donazione (3), salvo in questo caso l\'obbligo del donatario di compensare in denaro i legittimari in ragione del conseguente minor valore dei beni , purché la domanda sia stata proposta entro dieci anni dall\'apertura della successione (4). La stessa disposizione si applica per i mobili iscritti in pubblici registri (5).

I frutti [820, 1284 c.c.] sono dovuti a decorrere dal giorno della domanda giudiziale [1148 c.c.] (6).

Restoration of excess property > created or \'constituted\' by the reduction in (namely abatement of) the whole property gifted or willed.

The donee (e.g. the Comune) gives back or \'assents\' (passes on) tracts of the land to the rightful heirs - usually the next-of-kin - as the legitimate beneficiaries. It is not strictlya (probate) conveyance.

  -> A friendly word: as step 1, pls. confirm that you have read carefully and understood the purport of Art. 561 of the Italian Civil Code dealing with 'alienazioni costitutive'. There's no point pinning this 'impenetrable legal jargon' on me if you don't.
