peer agreement (net): +2نظام استقلال الذمة المالية لكل من الزوجين Explanation: التشريع الفرنسي Régime de Séparation des biens وهو نظام يقر مبدأ استقلال الذمة المالية لكل واحد من الزوجين خلال وبعد الحياة الزوجية، وبمقتضى نظام فصل الأموال هذا، يؤكد الزوجان في عقده على ما يلي: طريقة إدارة أموالهما، وحدود حرية التصرف بشأنها بالنسبة لكل منهما، مع بقاء كل واحد منهما متحملا للديون الشخصية التي يلتزم بها أو تتحملها حقوقه، كمسؤول وحده عن تصرفاته الشخصية، قبل وبعد إبرام عقد الزواج. وبإبرام الزوجين لعقد الزواج في إطار نظام فصل الأموال، فإنهما يخرجان أنفسهما من النظام القانوني العام ويدخلان في إطار النظام الإتفاقي الخاص هذا الذي أخضعا أنفسهما له. |
