Rules of conflict of laws in relation to non-contractual obligations
Since the Brussels I Regulation relates to both contractual and non-contractual obligations, the conflict rules should also be harmonised for both areas.

On 3 May 2002, the Commission launched a wide-ranging consultation with interested parties on a preliminary draft proposal for a Council regulation on the law applicable to non-contractual obligations. In this framework, around 80 contributions were sent to the European Commission. A summary of these contributions is available in a synthesis document. A hearing on this matter took place in Brussels on 7 January 2003.

On 22 July 2003, the Commission presented its proposal for a Regulation of the European Parliament and the Council on the law applicable to non-contractual obligations, often known as "Rome II". The initiative focuses on the question of civil liability for damage caused to others, particularly in case of accidents such as traffic accidents or accidents caused by a defective product, or in case of invasion of privacy.
