It is my understanding that the prosecutor ("PM") authorises search and seizure during investigations ("decreto di convalida"); the examining magistrate ("GIP") hears motions requesting that the seized articles be returned. See Art. 263 of the CPP:

Art. 263 (Procedimento per la restituzione delle cose sequestrate):

4. Nel corso delle indagini preliminari, sulla restituzione delle cose sequestrate il pubblico ministero provvede con decreto motivato.
5. Contro il decreto del pubblico ministero che dispone la restituzione o respinge la relativa richiesta, gli interessati possono proporre opposizione sulla quale il giudice provvede a norma dell`art. 127.
