I am translating a court document of an Italian preliminary hearing (udienza preliminare).

"la Difesa chiede sentenza di non luogo a procedere nei confronti dei propri assistiti ravvissa comunque il difetto di vocatio in ius nei confronti di xxx attesa l'indicazione di xx contenuta in rubrica."

I have translated the above as: "The Defense requests
sentence to not proceed for his clients and also recognizes the defect of the summons for xxx expecting the indication of xx contained in the index."

I am not sure about the last part: "expecting the indication of xx contained in the index." This concerns an argument made by the defense that two names were confused in the charges. By 'rubrica' here, I think they mean the part where the charges are listed right above this section.
