Jurisdiction clause
In the case where the parties intend to have their litigation solved by a court, the second alternative provision provides for the parties to choose the competent court and stipulate it in their agreement.
In the case where the parties do not make such a choice, the competent court shall be determined by reference to the Convention on jursidiction and the enforcement of judgments in civil and commercial matters (6).

How interesting! The first sentence quoted is "authentic language" (see Kudo question).

Personally I would translate it "jurisdiction and venue"

it seems to me that "governing law" would be more "leggi applicabili, disposizioni di legge applicabili"
Il foro is the 'court' and literally it means the court that has jurisdiction; this is why I would tend to translate it "jurisdiction and venue"
