la société défenderesse se constituait Explanation: sous entendu dans la procédure. Se constituer signifie que l'on fait un acte formel (en général par l'intermédiaires de son avocat et uniquement par son intermédiaire devant les juridictions où il est obligatoire de se faire représenter par un avocat comme le TGI en France) pour signifier au Tribunal que l'on prend part à la procédure. Le terme constitution de partie civile ne s'emploie qu'en matière pénale lorsque la victime réclame des dommages-intérêts. Dans ce cas la juridiction pénale statue au pénal pour condamner p. ex. à une peine de prison et au civil pour allouer des dommages-intérêts en réparation du préjudice subi. |
