"KLAUZULA WYKONALNOŚCI - akt sądowy stwierdzający, że tytuł egzekucyjny uprawnia do przeprowadzenia egzekucji. Tytuł egzekucyjny opatrzony klauzulą wykonalności stanowi tytuł wykonawczy będący podstawą egzekucji."

A teraz jeszcze ten sam tekst w wersji polskiej:
"3. Postępowanie przedegzekucyjne:
- po wydaniu przez Sąd nakazu zapłaty wraz z klauzulą wykonalności (tytuł wykonawczy),"

i angielskiej
"3. Pre-execution pursuit:
- After the court's decision in announced requesting the payment (incuding the Execution clause)"

ze strony podanej w drugim linku.

Wiem że takie tłumaczenie polskiej strony to słaba poszlaka, ale obawiam się, że po prostu prawodawstwo anglosaskie nie znaja klauzuli wykonalności w takim znaczeniu, jakie ma ona u nas. Natomiast pojęcie 'execution clause' jest powszechnie używane np. przy sporządzaniu testamentów czy umów, gdzie podpisy uprawnionych osób nadają dokumentowi status wykonalności.

A jeśli nie jesteś zbyt mocno przywiązana do samego słowa klauzula, to może bardziej będzie pasować \'writ of execution\'?
