No caso, a cláusula limitou a obrigação patronal de pagamento de horas de deslocamento e permitiu o pagamento somente quando o percurso, em cada trecho, fosse superior a uma hora, todavia, essa cláusula acabou por excluir, por via oblíqua, o pagamento das horas in itinere , porque o tempo de deslocamento verificado em cada trecho é por volta de 50 minutos, totalizando 100 minutos diários. Dessa forma, a despeito de a Constituição Federal de 1988, em seu artigo 7º , inciso XXVI , prestigiar e valorizar a negociação coletiva, não se pode subtrair totalmente, como foi feito, o direito do empregado assegurado em norma cogente
