attenuated ad mesuram clause
Explanation:
The subject matter is the sale of land. When a sale is subject to an ad mesuram clause the land is sold by measurement, e.g. x hectares. This form of sale frequently applied when part of a larger and defined parcel of land (registered and defined in terms of boundaries) is sold off. In an ad mesuram contract the area of land stated is of the essence of the contract, so if the real area is less than stated the buyer is entitled to: additional land, a price reduction, or to rscind the contract. Such a contract is atenuated when a margin of error is stipulated in the contract. The English word admeasurement does exist but it is used almost exclusively in building contracts where the price is determined by a bill of quantities.
