Interdictia poate fi ceruta, conform art. 143 C. fam de catre toti cei prevazuti in art. 115 din acelasi cod si numai in cazurile limitativ prevazute in art. 142 si anume pentru alienatie mintala ori debilitate mintala, care provoaca lipsa de discernamant, iar nu si pentru alte situatii sau deficiente fizice care nu provoaca lipsa de discernamant.
