Descrierea si incadrarea juidica a faptei: La data de 08.09.2007, inculpatii X and L au indus si mentinut in eroare reprezentantii legali ai SC Lcs SRL, cu prilejul scoaterii din Albita de Jos a cantitatii de 256 tone benzina, apartinand SC Lcs SRL, prin folosirea de mijloace frauduloase si prin folosirea de calitati mincinoase, creand aparenta efectuarii unui tranzit pe teritoriul Romaniei, marfa neparasind insa teritoriul acestei tari, cauzand un prejudiciu total de 67 000 dolari usd si 815 325 lei, faptele intrunind elementele constitutive ale infractiunilor prev. de art. 158 alin. 6 si 8 C. pen.

Description and legal classification of offences: On 08.09.2007, the defendants X and L induced and maintained miscarriage of the legal representatives of SC Lcs SRL, on occasion of drawing from Albita de Jos, a quantity of 256 tones of gas, belonging to SC Lcs SRL, using fraudulent ways and false qualities, setting up false intention to carry out a transit on the territory of Romania, without the goods to leave the territory of this country, causing a total grievance of US $ 67,000.00 and lei 815,325.00, the offences making up the constitutive elements of crimes for article 158 paragraphs 6, 8 – Penal Code.
