the context suggests that the tax was charged in breach of the agreement, contrary

I don't read this as saying that the agreement prohibited the assessment of tax, merely that the amount assessed was in excess of what the agreement permitted.

After rading Asker's comment, it could be that this is tax on the amount in excess of what they were authorized to pay the employee by contract. Would that perhaps fit?

Asker: Many thanks, Paul. The idea is that the company paid income tax out of their own funds which should have been deducted from the earnings of an employee. That could actually be the reason it happened - the amount that was in excess of what was agreed was paid and the company covered the tax costs themselves.
