Extract from Argentinian bankruptcy law:

"Son ineficaces ... los actos realizados por el deudor en el periodo de sospecha que consistan en:
...
3) Constitucion de hipoteca o prenda o cualquier otra preferencia, respecto de obligacion no vencida..."

Does this merely mean "preference" or "choice" (which strikes me as slightly odd here) or does it have a specific financial (or similar) meaning in Argentinian Spanish?

Black's Law Dictionary def: An assignment of property for the benefit of creditors, made by an insolvent debtor, in which it is directed that a preference (right to be paid first in full) shall be given to a creditor or creditors therein named. Such assignments are controlled by statute in most states, normally requiring recording, filing schedules of assets and liabilities, etc. Most all state statutes prohibit preferential assignments as being fraudulent conveyances."

preference

"Prferencia" in Spanish and "preference" in English have the same specific meaning in bankruptcy law. Using the terms suggested by others would be confusing to any U.S. lawyer, and most U.S. businessmen with exposure to bankruptcy matters. A preference need not be a lien, encumbrance or assignment (prepayment, for example, can be a preference, and surely is not collateral. Any lending officer who purported to take a bankruptcy preference as collateral would be, or should be, fired.
