En caso de terminación unilateral del presente Contrato EPC, por incumplimiento de las obligaciones a cargo del Contratista EPC, se causará una pena pecuniaria a cargo del Contratista EPC que se aplicará en los mismos montos regulados en la Sección 6.2 de la Parte Especial.

El monto de esta Cláusula Penal podrá ser deducido directamente de cualquier saldo adeudado al Contratista EPC y no Impedirá al Contratante ejercer las demás acciones legales a que haya lugar en contra del Contratista EPC para lograr el reconocimiento y pago de la indemnización de la totalidad de los perjuicios sufridos, a cuyo monto se deducirá la Cláusula Penal aquí establecida.
