I have problems in deciphering what exactly does the phrase "equiparable a la anterior" mean in the context of this sentence.

"Obviamente, la declaración de invalidez del Reglamento ha supuesto que los derechos exigidos en su virtud no eran legalmente debidos. Pero ésta no es una ilegalidad cualquiera, equiparable a la anterior, sino que deriva precisamente de la invalidez del propio Reglamento".

Let me add, that there is no mention of any "previous" or "earlier" illegality in the text. My guess was that the phrase could therefore mean that the illegality is not comparable "just to any regular illegality", but that it is a "special".
