Hi there, I am translating a Divorce Decree from Venezuela and is target for Canada. The partial text is:
...separación de hecho por más de 5 años y no habiendo oposición por parte del Fiscal..., concluye esta Sentenciadora que la presente solicitud de divorcio debe "prosperar en derecho". Así se decide.
my closest guess is: ...this Court concludes that the hereby divorce application "must be upheld". IT IS SO ORDERED.
but I am not so sure since the expression is related to "prosperar" but not to prosperar "en derecho". If someone could help me please? thanks

From the duplicate question you posted on Jan. 8 it appears that you are actually asking whether "divorce application must be upheld" is correct. It isn't: an application cannot be "upheld"; only court rulings can be upheld upon appeal or review. In legal contexts "uphold" means "let stand," "to defend or maintain a principle or law, or to state that a decision that has already been made, especially a legal one, is correct" (Cambridge Dictionary).

Here are a couple of examples of how "uphold" is used in legal contexts:

To uphold that right, the Supreme Court overturned the federal law barring slavery from federal territory.

Years after he decided to uphold a strict voter ID law, a federal appellate judge says he got it all wrong.
