Estoy traduciendo una opinión legal sobre un caso de un choque con víctimas fatales. Los demandantes no cumplieron con los lapsos de ley para colocar los carteles de citación, pero el tribunal también se atrasó en sus funciones:

"Pudiera ser que en vista de la inactividad del propio Tribunal, no prospere la sanción de perención a los demandantes, porque el propio Tribunal estaba en mora del cumplimiento de sus propias obligaciones. No obstante, la defensa de perención **va a ser opuesta en nuestra contestación** haciendo la salvedad de que en este caso, puede ser que el Juez la resuelva de inmediato o la resuelva en la sentencia definitiva junto con todas las demás defensas opuestas."

Tengo problemas con el concepto de "oposición de defensa". Las demandadas son las que están usando la defensa de perención del caso.
