I think I understand the reason for your doubt, i.e. that the point in question is not part of the “antecedentes” section of the document (I wonder if there is an “antecedents” section and if so does it mention the “relationship” in question?), but rather he/she is just making an important point for the court to consider, choosing a lawyer-speak term to do so, in which case it might not be absolutely necessary to use such term (factual), saying something like:
In order to understand and consider/weigh the conflict that gave rise to this action/lawsuit, it is imperative to shed light on the background of the relationship between the parties, in particular:
It doesn’t seem necessary to place “y valorar” in brackets.
