Spanish term

atributiva del dominio

Gracias Paola!
neutral Billh : The context, such as we have, strongly suggests that ownership may not in fact have been conveyed.

what purports to pass the title

it's del and not de dominio.

Also, the wording of purport to pass is intended to incorporate the amibiguity of the attribution as an ascribing of ownership and what conveys the title.

I thought that registration of a properly stamped escritura is what formally passes the title and that, in Spain at least, the common failure to register the deed may be down to a wish to avoid triggering a number of land and capital gains taxes. The result I know of is an expediente de dominio to turn the contractual interest of the contrato de venta into a registration of the escritura to which it is 'elevated'.

Maybe Bill H. can expand on this point no one else seems to be picking up on.
