La escritura pública es atributiva del dominio y la descripción que en ella se hace de la finca, constituyen fuerte prueba en contrario frente a terceros. Also, the wording of purport to pass is intended to incorporate the amibiguity of the attribution as an ascribing of ownership and what conveys the title.
I thought that registration of a properly stamped escritura is what formally passes the title and that, in Spain at least, the common failure to register the deed may be down to a wish to avoid triggering a number of land and capital gains taxes. The result I know of is an expediente de dominio to turn the contractual interest of the contrato de venta into a registration of the escritura to which it is 'elevated'.
Maybe Bill H. can expand on this point no one else seems to be picking up on.
