English translation:deferred judgment
Explanation:
The term criterio de oportunidad is analogous to prosecutorial discretion. However, depending on context, there are alternative terms in Enlgish that can be used to translate the one in Spanish, e.g.:

1. negotiated plea, plea bargain, plea agreement
2. deferred prosecution, deferred judgment
3. diversion, alternative dispute resolution

For this context, I woud opt for using a term from the second sense, i.e., ending the case without a conviction, but with some condition.

The Public Prosecutor’s Office ... requested the Judge to apply a deferred judgment, that is, to defer the criminal case, as long as the assailant complied with his part of the agreement.

neutral  AllegroTrans: I agree with your reasoning but not with "deferred judgment" which is a contradiction in terms; "to defer judgment" would make more sense
