Spanish term or phrase: Convenio de Ocupación Previo a Expropiación, por Causa de Utilidad Pública...
The title is so long the phrase box won't let me include it all! The full title is "Convenio de Ocupación Previo a Expropiación, por Causa de Utilidad Pública de Tierras de Uso Común"

This doozy comes from a mining operation agreement being executed in Mexico. The translation is for a Canadian company:

Actualmente es titular de un Convenio de Ocupación Previo a Expropiación, por Causa de Utilidad Pública de Tierras de Uso Común, celebrado con el Ejido XXX, ubicado en el municipio de XXX, Zacatecas, (en adelante el “Ejido”) con una superficie de ....

I understand what it is, that governments can expropriate private land for public use (eminent domain), and that this mining company has an agreement with the Ejido to occupy these lands prior to their expropriation. Hoping for some confirmation on my suggested translation to make sure I'm not taking too many liberties and changing the meaning.

Suggested: Agreement on Occupancy Prior to the Expropriation of Common Land for Public Use

It's a huge document that only uses this full title once (and I'm not even sure, because of the use of the comma, whether "por Causa de Utilidad Publica de Tierras Comunes" is actually part of the agreement title, or a qualifier of the reason for expropriation) and thereafter it makes several references only to the "Convenio de Ocupación Previa a Expropiación", for which I had thought "Pre-Expropriation Occupancy Agreement" but then it doesn't fit with the full title above.

CanE /AmE: Pre-Condemnation Occupancy Agreement with a view to Eminent Domain of Common Land

Explanation:
... to start the ball rolling.

Other ways of dodging repetition of pre-Eminent Domain: Agreement predicated or based on; in anticipation of....

In the UK, this would be rephrased something like: Pre-Compulsory Purchase Occupation Agreement - in contemplation of turning Common Land to Public Use.

Example sentence(s):
  • USA: Pre-condemnation planning is a very important part of the eminent domain process in Maryland.
  • Obviously, the condemning authority (the “condemnor”) undertakes a planning process, and that process can extend for decades and become very complex.

Treaty of Occupation prior to expropriation, for causes of public benefit or entitlement

Explanation:
"La institución que para el efecto copnsagran las leyes es la de la expropriación por causa de utilidad pública. La expropriación viene a ser, como su nombre lo indica, un medio por el cual el Estado impone a un particular la cesión de su propiedad por existir una causa de utilidad pública y mediante la compensación que al particular se le otorga por la privación de esa propiedad."
"The institution, for this purpose, dedicates laws regarding the expropriation (deprivation of property) with the intention of granting for public benefit or entitlement. The expropriation (deprivation of property) becomes, as its name indicates, the means by which the State imposes a particular assignment (or transfer) of one's property because of a public cause (case for public benefit or entitlement) and by means of the compensation which the particular one concerned is granted for the deprivation of that property."

"Actualmente es titular de un convenio de ocupación previo a expropriación, por causa de utilidad púbica de tierras de uso común celebrado por el ejido ubicado en el municipio (en adelante el ejido) con una superficie."
"At present it's owned by an agreement on occupation prior to expropriation for a cause of public and common use of land territory with a surface area, held by the common land ahead and located in the town council."
(That might fit with the description of the transfer of the land ownership or the changes involved for the mining company. It's a bit confusing. 'Pre-expropriation occupation treaty or agreement' might be the same as 'occupation treaty or agreement prior to expropriation')

disagree  AllegroTrans: Treaties are (generally) agreements between countries and it is certainly not a term used in connection with tenancies etc.
