Es preceptiva la intervención del Ministerio Fiscal en virtud de lo dispuesto en los artículos 124-1º de la Constitución, 1 y 3-6º y 7º del Estatuto Orgánico del Ministerio Fiscal, siendo el 757-2º de la Ley de Enjuiciamiento Civil el precepto que nos legitima como deber para el caso de que las personas enumeradas en el nº 1º « no existieren o no lo hubieren solicitado ».
