Facultades Generales Para Administrar Bienes, en los términos del tercer párrafo del artículo 2554 dos mil quinientos cincuenta y cuatro, segundo párrafo del Código Civil Federal, aplicable en materia federal en toda la República Mexicana de manera supletoria según lo dispuesto por el artículo 2º segundo del Código de Comercio, acrecentando y conservando los negocios de la sociedad; hacer y recibir pagos, otorgar recibos, hacer adquisición de bienes, incluyendo el adquirir participación en el capital de otras sociedades; dar y recibir en arrendamiento con derecho o no al subarriendo y en comodato; celebrar contratos de cuenta corriente con instituciones de crédito; constituir fianzas en favor de la sociedad y liberarlas, extinguida la obligación principal; así como aceptar la constitución de prendas o hipotecas en favor de la sociedad y en su momento, otorgar el finiquito respectivo; adquirir derechos de fideicomisario; celebrar contratos de factoraje y arrendamiento financiero con organizaciones auxiliares del crédito; y en general, celebrar todo tipo de contratos o convenios de la forma, términos y modalidades que crea convenientes, siempre y cuando se trate de un acto administrativo, sin que con ello se comprometa el patrimonio de la sociedad mandante o implique la afectación, gravamen o enajenación de los bienes, derechos o acciones de la poderdante; y por consecuencia, otorgar y firmar los documentos públicos y privados que para ello sean necesarios.

Habra comodato o prestamo de uso, cuando una de las partes entregue a la otra gratuitamente alguna cosa no fungible con facultad de usarla.



Crtitica: no dice que se debe restituir la cosa al finalizar el cto.


PRÉSTAMO (LOAN)
Dinero que el Estado o una corporación toma de los particulares con una garantía, empréstito. Dinero o valor que toma un particular para devolverlo. Según el artículo 1.740 del Código Civil, "Por el contrato de préstamo, una de las partes entrega a la otra, o alguna cosa no fungible para que use de ella por cierto tiempo y se la devuelva, en cuyo caso se llama comodato, o dinero u otra cosa fungible, con condición de devolver otro de la misma especie y calidad, en cuyo caso conserva simplemente el nombre de préstamo. El comodato es esencialmente gratuito. El simple préstamo puede ser gratuito o con pacto de pagar interés."





EL COMODATO

Tambien es denominado prestamo de uso , es un contrato real , bilateral, imperfecto y gratuito, por cuya virtud el comodante entrega al comodatario una cosa no consumible mueble o inmueble para que la use y la restituya despues el comodante

Bailment


Explanation:
I agree with both of the explanations provided by the other colleagues.
Having said this, in my humble opinion "Bailment" is the term that goes best with these definitions in a business environment.

bail·ment:
The act of delivering goods or personal property to another in trust.

I have also had to translate this term from English to Spanish on several occasions, as it is very common in the U.S.-Mexico border region to have this occur betwwen the Mexican Twin Plant (maquiladora) and its mother company abroad.
