La ineficacia sobrevenida de la obligación de arbitrar deriva de los términos de los artículos 1, 3, 4 (I), 89, 121, 122 y 123 de la LCM, pues los créditos que reclama el demandante son créditos concursales, por haber sido propuestos para el *reconocimiento* del juez federal en el concurso mercantil seguido en contra de XXX, y a la fecha se encuentran ya reconocidos por dicho juez, lo que implica el sometimiento a la jurisdicción del juez de distrito mexicano, excluyendo de esta manera la competencia del Tribunal Arbitral.

The inefficiency that is a consequence of the obligation to arbitrate derives from the terms in articles 1, 3, 4 (I), 89, 121, 122 and 123 of the Mexican Commerce Law (LCM), since the credits that the claimant claims are corporate reorganisation credits, because they were submitted for *acknowledgement* by a federal judge in the corporate reorganisation carried out against XXX, and at this date are already recognized by said judge, (3) which implies submission to the jurisdiction of the district judge of the Mexican court, thus excluding the competence of the Arbitral Tribunal.
