Este cargo escondido constituye un incumplimiento de contrato lo cual required bajo la ley de (XXX country) que se le devuelva la de diferencia de XXXXXX por dia, mas el XX% de interes legal, si el Honorable Tribunal no determina *******que los demandados incurrieron en temeridad*******

I am understanding this to say that the Court has to repay XXX amount of money per day to the Claimant, plus XX % of interest, if the Honorable Court determines that the Defendant was reckless.......
My question is why does the NO appear before "determina que"-Because if the court determines that the Defendant was not reckless, then they would win the claim, and they wouldn't have to repay the Claimant any of this money in the first place?!?!?!?!?

I would venture that even though the court were to determine that the defendants were not reckless (they could have made a simple error), they may still owe the plaintiff money.

If determined to be reckless, they could be subject to further penalties.
