Simplificando, en el Derecho Penal existen delitos:

a). que se persiguen de oficio; es decir que la autoridad no necesita de denuncia específica del ofendido para actuar (crimes against the estate), o no existe ofendido específico sino que la oefendida es la sociedad en general; y

b). Que se persiguen ante querella necesaria de parte; es decir, que se requiere que el ofendido presente la denuncia, solicitando la acción de la autoridad (crimes against the individual)
