Because of your source context, I am concerned about the obvious (vernacular) interpretation of this expression. I think it is a legal technical expression in Spain or a quote from the wording of some law. If we give it a literal translation, the meaning will be lost. Rather than your take on it, I am inclined toward: 'If the work is not performed appropriately, as defined by law... " These are specific legal parameters being set, are they not?
This nearly has to be a legal technical term for the country in question, delineating what happens in default of a written agreement between the parties. Something like "according to law". We need the context of source and target countries to help much here. Then we could research the term better and suggest appropriate translations.
