Spanish term or phrase: violación espuria calificada
I'm translating the text of the results of a preliminary investigation of an individual in relation to the above mentioned charge. The subject is charged with raping a minor, and the minor's mother is charged separately with aiding.

I know this is 'statutory rape', but does the 'espuria' add anything here, or would this simply be equivalent to 'statutory rape' (in Canada or US)?

The original document is from Mexico. Sometimes the charge is referred in full as above, and sometimes just 'violacion calificada'.

Definition of violacion calificada includes many aspects, several of which including a familial or guardianship relationship
Certainly, violación calificada can be estupro or statutory rape and it is in your case (but it is not the right translation in every case)
Definition of espuria includes false or simulated or as offered in the discussion, without resistance (like what occurs in the case of incest). Please read the difference between violación calificada and incest in this link
Based on all this and the references offered, I think this translation can work in your case, although I do not know if the primary defendant has a familial link to the victim but my guess is that if the mother aided in the assault, the individual could be a relative or someone that exercised some type of guardianship in that household, even if just symbolically.

In reference to the term aggravated that has been offered in the discussion, the difference between rape and aggravated rape varies with jurisdiction but generally aggravated includes more elements involved in the act (other felony at the same time, extent of physical damage, methods, and even age difference between the victim and the rapist). It may fit in this case but without more context we can't tell. In that case, the translation would be incestous aggravated statutory rape.

En la primera audiencia – de vinculación, donde se determina si el detenido es sometido a proceso de acuerdo con los elementos que el Ministerio Público presenta al juzgado– se ordenó dejarlo en prisión preventiva acusado del delito de violación espuria (cometida cuando por sus características o la condición en que se encuentra, la víctima no está en condiciones de oponer resistencia).

Otras parecen indicar que es cuando la violación no es precisamente con penetración del órgano sexual, sino con un objeto o incluso los dedos.

On the meaning of “espuria”, my own investigations confirm what Alberto and Pablo have both said.

Here are the relevant sections of the Guanajuato state criminal code, not that we know this is from Guanajuato, but it provides some concrete evidence which is probably applicable to Mexico generally:

Capítulo I
Artículo 180.
A quien por medio de la violencia imponga cópula a otra persona, se le impondrá de ocho a quince años de prisión y de ochenta a ciento cincuenta días multa.
Artículo 181. A quien tenga cópula con menor de doce años de edad o con persona que por cualquier causa no esté en posibilidad de conducirse voluntariamente en sus relaciones sexuales o de resistir la conducta delictuosa, se le impondrá de diez a diecisiete años de prisión y de cien a ciento setenta días multa.
Artículo 182. Se aplicará la misma punibilidad del artículo 180, a quien introduzca por vía vaginal o anal cualquier objeto o cualquier parte del cuerpo humano que no sea el miembro viril, por medio de la violencia.”

Now, here is a list of crimes in Guanajuato linked to the relevant section of the CP:

So then the offences covered by sections 181 and 182 are both “violación espuria”. It sounds as though this particular case was a section 181 offence.

Here’s the Guanajuato Criminal Code on “calificada” (source as above):

Artículo 184. La violación se considerará calificada cuando:
I. En su ejecución intervengan dos o más personas.
II. En su ejecución se allane la morada en la que se encuentre el pasivo.
III. Se cometa entre hermanos.
IV. Se cometa entre ascendiente y descendiente; padrastro o madrastra e
hijastro; adoptante y adoptado o tutor y pupilo.
V. Se cometa por el superior jerárquico contra su inferior.
VI. Se cometa por quien tenga a la persona ofendida bajo su guarda, custodia,
educación o internado.
En estos casos la punibilidad se incrementará de un cincuenta por ciento del
mínimo a un cincuenta por ciento del máximo de la señalada en los artículos 180, 181
y 182 según corresponda.”

I don’t think there can be any doubt that “aggravated” is the correct translation for this.

But is this statutory rape? This term generally applies to non-forcible sexual relations with a person below the age of consent or otherwise unable to give legal consent. Since sex without consent is rape, such sexual relations are rape since consent cannot be legally given. But it is called “statutory” in some countries (not in the UK, where the term is not used) by contrast with forcible rape, in cases where the minor willingly participated, or at least there is no evidence of coercion.

Regardless of the fact that even if this poor little girl had been willing, it would still have been unlawful, this is clearly a forcible rape. There is also the point raised by Rosa, that “statutory rape” normally applies in the case of sex with a minor who has reached puberty, not to a child as young as this. This is aggravated rape of a child.
