Explanation: wilful misconduct = intentionally doing something that is wrong
mens rea (Latin = a guilty mind) = the state of mind accompanying an illegal act which makes the act a crime / criminal state of mind
These are the two I would suggest to use from Alcaraz, explanations from the Oxford dictionary of law
Alcaraz -Spanish law habitually distinguishes between culpa, which is guilt involving negligence, and dolo, which is malevolent intent or mens rea.
