even if their legal assistance shall not be mandatory Explanation: No! The sentence does not mean that fees have to paid even if they are not incurred. If they are not incurred, they do not have to be paid. Let us put it in easier words: "La parte que incumpliera el presente contrato correrá con todos los gastos que por dicho motivo se ocasionen, incluso los judiciales, honorarios de abogado, y derechos de procurador aunque la asistencia a éstos no fueran necesarios". That means: if AAA does not perform the contract, BBB has two possibilities: 1. Ask for legal assistance. If this assistance is unnecesary (not mandatoy) but BBB just wants it, costs will of course be incurred and, therefore, paid by AAA. (In some cases legal assistance is not needed). 2. Do not ask for assistance. |
