anormalité de l'action Explanation: Dans le lien que j’avais joint pour « antijuricidad », nous lisons ceci : « En termes différents, et pour suivre les auteurs allemands sur leur propre terrain (et notamment Beling), l’antijuridicité, c’est l’*anormalité de l’action* ; ce qui importe donc pour le pénaliste qui examine un comportement humain donné, c’est le caractère *normal* ou *anormal* de ce comportement. » http://ledroitcriminel.free.fr/la_science_criminelle/les_sci... Après avoir consulté une avocate et une juriste, elles sont arrivées à la conclusion que j’avais d’abord laissée de côté, à savoir qu’« anormalité » semble bien être le terme employé comme équivalent de « disvalor ». Normalité/anormalité. Anormalité de l'action (comportement moralement condamnable et socialement nuisible) et anormalité du résultat (risques, inconvénients, aléas). Normalité/anormalité au regard d'une loi ou au regard du principe de précaution. |
