Source text - Italian Momento saliente nella regolazione dei processi economici è l’intervento penale, tanto a livello nazionale che internazionale e comunitario. Stabilire contenuto e limiti delle scelte punitive, da sempre oggetto delle discipline criminalistiche, è vieppiù avvertito come problema cruciale in campo economico, trattandosi di contemperare la libertà di iniziativa e l’efficace svolgersi della produzione di beni e servizi con il rispetto di valori fondamentali in potenziale conflitto, ai quali dovrebbe riferirsi la garanzia penale. Anche la crescente sensibilità al bisogno di sanzioni verso le imprese come tali e non più solo nei confronti degli organi-persone fisiche, testimoniata nel nostro ordinamento dall’introduzione di una responsabilità da reato degli enti, va vista nella logica dell’aumento del rischio penale nel settore economico, che dovrebbe comunque contenersi nei limiti della legittima proporzione.
Translation - English Penal intervention is an outstanding moment in the regulation of economic processes at national, international and community levels. Determining the content and the limits of the punitive options, always the object of criminal law and related disciplines, is increasingly perceived as a crucial problem in the economic field, insofar as it deals with the balance between the freedom of initiative and effective production of goods and services with respect to the fundamental values in a potential conflict, to which a penal guarantee should refer.
The increasing necessity for sanctions against companies as such and not only against individuals, witnessed in our system by the introduction of a corporate responsibility , should also be seen in the logic of a penal risk in the economic sector, that should be enclosed in the limits of a legitimate proportion.

Re: EU Regulation 996/2010 on contact details in case of air accident
We refer to your memo circulated on … concerning the new EU Regulation 996/2010, which includes an obligation on airlines to offer travellers to provide the contact details of a person to contact in case of airline accident.
We draw your attention on the following features of this Regulation:
- The Regulation puts the obligation on airlines and does not mention travel agents;
- The Regulation does not require mandatory collection of contact details, but only requires offering travellers the opportunity to give the name and contact details of a person to be contacted in the event of an accident. Passengers may refuse to give this information;
- The Regulation does not set the technical means by which the information may be collected.
- The Regulation does not require to report on passengers’ refusal to provide the contact details.
We thus disagree with the assertions in your memo that to comply with the Regulation, a reservation must include an SSR PCTC element associated to each passenger containing the name and telephone number of the person to be contacted in case of an emergency or the information that the passenger refused to provide the data. We cannot agree with the requirements in this memo.
In order to comply with the Regulation, we recommend using the method of data collection presently used in the US, where a similar requirement already exists, i.e. a form completed by passengers before departure and dropped into a box at the airport, which will only be opened in case of accident. The forms are destroyed upon safe arrival of the flight.
The solution we recommend has the advantage of avoiding collection and storage of electronic data, and thereby avoiding most data protection issues. It also ensures that data is only collected from those passengers that actually wish to name a contact person and who actually board a plane.
It allows in addition to ask for the information after the ticket sale. Drawing passengers’ attention on the risk of air accident is a disincentive to fly. We do not see your advantage in doing it at the time of booking.
Finally, travel agents cannot accept to take on your obligations without consideration.
Therefore, rather than requesting agents to collect yet another piece of information in the PNR, we advocate for a simpler solution causing less disruptions for all stakeholders.

Inviamo la presente in riferimento alla nota diffusa agli Agenti di viaggio riguardante il nuovo Regolamento comunitario 996/2010, il quale prevede l'obbligo per le compagnie aeree di offrire ai viaggiatori la possibilità di fornire i dettagli personali di una persona da contattare in caso di incidente aereo.
Si richiama l'attenzione sulle seguenti caratteristiche del presente Regolamento:
- il Regolamento pone l'obbligo esclusivamente per le compagnie aeree e non menziona gli agenti di viaggio;
- il Regolamento non impone la raccolta obbligatoria dei dati di contatto, ma richiede soltanto che sia offerta ai viaggiatori la possibilità di fornire il nome ed i recapiti della persona da contattare in caso di incidente. I passeggeri possono anche rifiutarsi di fornire tali informazioni;
- il Regolamento non stabilisce le modalità tecniche attraverso cui le informazioni possono essere raccolte;
- il Regolamento non prevede nulla nel caso in cui i passeggeri si rifiutino di fornire i dati di contatto.
Pertanto, con la presente intendiamo manifestare il nostro disaccordo con quanto affermato da Iberian nella nota diffusa agli Agenti di viaggio, ovvero che in aderenza a quanto previsto dal citato Regolamento, la prenotazione deve includere un elemento SSR PCTC associato a ciascun passeggero contenente il nome e il numero di telefono della persona da contattare in caso di emergenza o l’informazione sul fatto che il passeggero ha rifiutato di fornire i dati.
Per garantire la corretta applicazione del citato Regolamento, si invita ad utilizzare il metodo di raccolta dei dati attualmente impiegato negli Stati Uniti, dove esiste un obbligo simile, vale a dire un modulo da compilare dai passeggeri prima della partenza e da inserire in una cassetta in aeroporto la quale sarà aperta solo in caso di incidente; tali moduli saranno distrutti dopo l'atterraggio sicuro del volo.
La soluzione che si consiglia ha il vantaggio di evitare la raccolta e la conservazione dei dati elettronici e di eludere in tal modo la maggior parte dei problemi inerenti la protezione dei dati personali. Inoltre, così si garantisce che siano raccolti i dati di quei passeggeri che desiderano indicare una persona da contattare e che effettivamente si imbarcano su un aereo.
Ancora, attraverso questo sistema si permette di chiedere informazioni personali dopo la vendita dei biglietti. Porre l'attenzione dei passeggeri sui rischi di incidente aerei rappresenta certamente un disincentivo a volare.
Infine, gli agenti di viaggio non possono accettare di assumersi degli obblighi senza una preventiva concertazione e condivisione.
Piuttosto che chiedere agli agenti di raccogliere ancora altre informazioni nel PNR, sollecitiamo che venga trovata una soluzione più semplice la quale causi meno disagi a tutti gli interessati.

Source text - Italian Gli Azionisti sono informati del fatto che, a decorrere dalla data della decisione del Consiglio, quest’ultimo ha stabilito di autorizzare il Consulente per gli Investimenti del Comparto a disinvestire immediatamente gli attivi del Comparto ed a convertire il portafoglio in denaro. Va osservato che questa linea di condotta risulta essere nel migliore interesse degli Azionisti ed è volta a preservare il valore del portafoglio a partire dalla data della loro decisione.
Gli Azionisti possono continuare a chiedere il rimborso o convertire le Azioni del Comparto prima della Data di Liquidazione al Valore Patrimoniale Netto per Azione (senza oneri) nel Giorno di Negoziazione applicabile. Per evitare dubbi al riguardo, si precisa che il Consiglio rinuncerà a tutte le Commissioni di Vendita Differite Eventuali e ad ogni altro onere che, in normali circostanze, sarebbe necessario sostenere per il riscatto o la conversione delle Azioni del Comparto.
