L’article 44 de la loi n° 78-17 du 6 janvier 1978 précitée est ainsi modifié :
1° Au premier alinéa du I, les mots :
« et qui sont à usage professionnel » sont supprimés ; 2° Le II est ainsi modifié :
A la première phrase du premier alinéa, les mots :
« de locaux professionnels privés » sont remplacés par les mots :
« de ces lieux, locaux, enceintes, installations ou établissements » ;
La dernière phrase du dernier alinéa est complétée par les mots :
« dont la finalité est l’exercice effectif des missions prévues au III » ;
3° Les trois premiers alinéas du III sont remplacés par deux alinéas ainsi rédigés :
« III. – Pour l’exercice des missions relevant de la Commission nationale de l’informatique et des libertés en application du règlement (UE) 2016/679 du Parlement européen et du Conseil du 27 avril 2016 précité et de la présente loi, les membres et agents mentionnés au premier alinéa du I du présent article peuvent demander communication de tous documents nécessaires à l’accomplissement de leur mission, quel qu’en soit le support, et en prendre copie.
Ils peuvent recueillir, notamment sur place ou sur convocation, tout renseignement et toute justification utiles et nécessaires à l’accomplissement de leur mission.
Ils peuvent accéder, dans des conditions préservant la confidentialité à l’égard des tiers, aux programmes informatiques et aux données ainsi qu’en demander la transcription par tout traitement approprié dans des documents directement utilisables pour les besoins du contrôle.
Le secret ne peut leur être opposé sauf concernant les informations couvertes par le secret professionnel applicable aux relations entre un avocat et son client, par le secret des sources des traitements journalistiques ou, sous réserve du deuxième alinéa du présent III, par le secret médical.
« Le secret médical est opposable s’agissant des informations qui figurent dans un traitement nécessaire aux fins de la médecine préventive, de la recherche médicale, des diagnostics médicaux, de l’administration de soins ou de traitements, ou de la gestion de service de santé.

Article 5
Article 44 of the aforementioned Law No. 78-17 of January 6, 1978 is amended as follows:
1. In the first paragraph of section I, the words:

3. The first three paragraphs of section III are replaced by two paragraphs worded as follows:
- In order to carry out the duties falling within the remit of the Commission nationale de l'informatique et des libertés [French Data Protection Authority] pursuant to the aforementioned Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 and this Law, the members and agents mentioned in the first paragraph of section I of this Article may request the communication of any documents necessary for the performance of their duties, regardless of the medium, and receive copies of them.
They may obtain, in particular on the spot or upon request, any information and justification useful and necessary for the fulfillment of their duties.
They may have access, under conditions that preserve confidentiality with respect to third parties, to computer programs and data and may request that they be transcribed by any appropriate process into documents that can be used directly for the purposes of the monitoring.
Secrecy may not be invoked against them, except with regard to information covered by professional secrecy applicable to the attorney-client relationship, by the secrecy of journalists’ sources, or, subject to the second paragraph of this section III, by medical secrecy.
“Medical secrecy is enforceable with regard to information which is part of a processing operation necessary for the purposes of preventive medicine, medical research, medical diagnosis, the administration of care or treatment, or the management of health services.
The transmission of individual medical data included in this category of processing may therefore only take place under the authority and in the presence of a doctor.”;

La coupe des planches. Ces planches serviront pour le toit le pour la confection des bancs d’écoles.

L'hôpital de référence de Kerawa. Le CEUM gère cinq hôpitaux en Équateur. Ici, c'est la pédiatrie.

La classe de cinquième de primaire pour la plupart, plus quelques étudiants de la sixième à l'extrême gauche de la photo.

Petite fille nous faisant une lecture, mais sans texte. Il s'agissait plutôt d'une récitation par coeur.

Nouvelle école construite par Vision Mondiale à Gemena. Vision mondiale est actif seulement à Gemena en Equateur, appuyant des projets d'une valeur d'environ $2M par année. Ce n'est pas énorme pour une ville d'environ 400 000 personnes, mais ça permet de financer de nombreux projets comme celui-ci. Cette école fonctionne comme école publique le matin, et comme école privée l'après midi. Bibiche Dole, épouse du Pasteur Dole, est directrice de la partie privée. Il y a une direction séparée pour l'école publique. Les frais de scolarité sont 1,000 FC (environ $1) par mois pour l'école publique, 3,000 FC pour l'école privée. L'école privé est plus chère car elle doit payer les salaires, mais même pour l'école publique, il existe deux classes de personnel : les uns payés par l'était, et le reste 2/3 du total, payé à même les frais de scolarité.

Salles de classe - école des Mennonites. Il y avait six classes en tout. Les enfants doivent s'asseoir par terre. Jean voulait que je vois ceci pour que je comprenne mieux la piètre condition de l'enseignement actuel dans le village. Cécile dit que 50% des enfants ne vont pas à l'école, et que le taux de réussite pour le primaire (examens de sixième année) n'est que 25%. Il y a une école Catholique, qui est assez bonne, et une école protestante, mais cela ne suffit pas.

Le petit déjeunier - une bouillie à un tiers soja, le reste de maïs. Cinq des orphelins.

New school built by World Vision in Gemena. World vision is active only in Gemena in Équateur, supporting projects worth about $2 million per year. This is not a lot for a city of about 400,000 people, but it helps fund many projects like this one. This school operates as a public school in the morning, and as a private school the afternoon. Bibiche Dole, wife of Pastor Dole, is Director of the private school. There is a separate administration for the public school. The tuition fees are 1,000 CF (approx. $1) per month for public school, 3,000 CF for the private school. The private school is more expensive because it must pay wages, but even for public school, there are two classes of staff: some are paid by the State, and the remaining 2/3 of the total are paid by the tuition fees.

Classrooms - the Mennonite school. There were six classes in all. Children must sit on the ground. John wanted me to see this so that I could better understand the poor condition of current education in the village. Cécile said that 50% of children do not attend school, and that the success rate for primary education (sixth year exams) is only 25%. There is a Catholic school, which is quite good, and a Protestant school, but this is not enough.

Breakfast – one-third soybean, the rest corn. Five of the orphans.

The little treasure (son of the head of the village) with the first catfish of the day. The locals call them eels. You can see here that the sediment of the pond contains a layer of mud of about 15 cm. This mud will be removed and could be used to enrich the fields.
