Tôi rất vui mừng tham dự Diễn đàn xúc tiến đầu tư phát triển nông nghiệp, nông thôn vùng trung du và miền núi Bắc Bộ năm 2011, do Bộ Nông nghiệp và Phát triển nông thôn phối hợp với UBND các tỉnh trong vùng tổ chức tại tỉnh Lào Cai đẹp giầu và năng động. Diễn đàn được tổ chức trong bối cảnh đất nước ta đang đổi mới mạnh mẽ mô hình tăng trưởng và cơ cấu kinh tế, chủ động hội nhập quốc tế ngày càng sâu rộng. Kết quả thu hút đầu tư phát triển nông nghiệp, nông thôn, nguồn tiềm năng dồi dào và cũng đang là thách thức to lớn của vùng trung du và miền núi Bắc Bộ, sẽ góp phần quan trọng trong tiến trình đi lên của đất nước. Với sự tham gia nhiệt tình và đông đảo của đại biểu và các nhà đầu tư, tôi tin tưởng rằng, Diễn đàn sẽ hoàn thành thắng lợi các mục tiêu đã đề ra. Thay mặt Ban Chỉ đạo Tây Bắc, tôi chân thành cảm ơn Ban Tổ chức Diễn đàn và xin gửi tới các vị đại biểu, các nhà đầu tư trong và ngoài nước lời chào mừng tốt đẹp nhất.

Vùng trung du và miền núi Bắc Bộ có vị trí chiến lược đặc biệt quan trọng về kinh tế - xã hội, quốc phòng, an ninh và đối ngoại của cả nước. Đây cũng là địa bàn giầu tiềm năng về đất đai, đồi rừng, với nhiều tiểu vùng sinh thái, tạo lợi thế cho phát triển nhiều loại nông, lâm, thủy đặc sản. Được sự hỗ trợ đầu tư của Nhà nước và cố gắng nỗ lực của đồng bào các dân tộc trong vùng, mấy năm vừa qua, nông nghiệp, nông thôn vùng trung du và miền núi Bắc Bộ đã có bước phát triển mạnh mẽ.
Sản lượng lương thực không ngừng tăng lên nhờ sử dụng giống mới và áp dụng tiến bộ kỹ thuật, đẩy mạnh thâm canh; nhiều nơi có gạo đặc sản cung cấp cho vùng đô thị. Đã hình thành nhiều vùng chuyên canh tập trung sản xuất nguyên liệu cho công nghiệp chế biến như vùng chè, cà phê, cao su; vùng cây ăn quả như cam Hà Giang, Hòa Bình, bưởi Đoan Hùng, xoài Yên Châu, hồng Bắc Kạn... Chăn nuôi đã trở thành nguồn thu nhập chính của nhiều hộ gia đình, nhiều huyện đã đạt bình quân trên 3 con trâu, bò mỗi hộ; nhiều doanh nghiệp, trang trại chăn nuôi đặc sản như lợn rừng, ba ba, cá tầm, cá hồi... mang lại lợi nhuận khá cao.
Nghề rừng đang có bước đổi mới mạnh mẽ. Quy hoạch 3 loại rừng được điều chỉnh theo hướng phát huy tổng hợp chức năng phòng hộ, bảo tồn nguồn gien và nâng cao hiệu quả kinh tế; rừng sản xuất phát triển nhanh, rừng phòng hộ được khoanh nuôi, bảo vệ tốt hơn, độ che phủ và chất lượng rừng tăng lên. Đã có thêm nhiều nhà máy đầu tư phát triển rừng nguyên liệu cho chế biến gỗ, giấy, đáp ứng nhu cầu thị trường trong nước và xuất khẩu.
Sản xuất công nghiệp, tiểu thủ công nghiệp, kinh doanh dịch vụ đang tăng nhanh ở nhiều bản làng. Nhiều ngành nghề truyền thống như dệt thổ cẩm, mây tre đan... được phục hồi và nhân rộng, các ngành nghề mới như thủ công mỹ nghệ, thêu ren, may mặc được du nhập, nhân cấy ở nhiều nơi. Sản xuất, kinh doanh hàng thủ công kết hợp với bảo tồn và phát huy bản sắc văn hóa các dân tộc thiểu số như mô hình bản Lác (Mai Châu, Hòa Bình) được nhân rộng, đã thu hút nhiều du khách trong và ngoài nước tham quan, thưởng thức.
Các mô hình liên kết giữa doanh nhiệp, nhà khoa học với hộ nông dân để tổ chức sản xuất hàng hóa phát triền ngày càng phong phú. Cấp ủy, chính quyền các địa phương trong vùng đang ra sức quan tâm cải cách thủ tục hành chính, tạo môi trường thuận lợi nhất cho thu hút đầu tư. Là địa phương xa xôi nơi địa đầu Tổ quốc, nhưng Lào Cai đã liên tục phấn đấu; năm 2010 vươn lên đứng thứ 2 trong bảng xếp hạng chỉ số năng lực cạnh tranh cấp tỉnh.
Đảng và Nhà nước đang tiếp tục triển khai nhiều giải pháp, cơ chế, chính sách hỗ trợ phát triển vùng trung du và miền núi Bắc Bộ. Kết cấu hạ tầng, nhất là hệ thống giao thông được mở rộng và nâng cấp, rút ngắn khoảng cách giữa miền núi với các đô thị trung tâm. Các chương trình xóa đói, giảm nghèo được tập trung cao độ, ngày càng phát huy hiệu quả; tỷ lệ hộ nghèo giảm nhanh, đời sống vật chất, tinh thần của nhân dân được cải thiện một bước. Bộ mặt nông thôn, miền núi đã và đang có nhiều khởi sắc.
Tuy nhiên, do điểm xuất phát thấp; điều kiện phát triển kinh tế hàng hóa có những khó khăn; công tác quản lý hành chính, quảng bá và tạo điều kiện thu hút đầu tư ở một số địa phương còn hạn chế, nên nhiều tiềm năng, lợi thế của vùng vẫn chưa được tập trung khai thác mạnh mẽ. Nhiệm vụ thu hút đầu tư phát triển nông nghiệp, nông thôn đang trở nên hết sức cần kíp.

Diễn đàn Xúc tiến đầu tư phát triển nông nghiệp, nông thôn vùng trung du và miền núi Bắc Bộ năm 2011 là sự kiện có ý nghĩa thiết thực. Sự tham gia đông đảo của các nhà đầu tư, đội ngũ doanh nhân, các tổ chức kinh tế, xã hội trong và ngoài nước; với sự có mặt của đại diện các Bộ, ngành Trung ương, UBND các tỉnh trong vùng, sẽ là cơ hội tốt để giới thiệu, trao đổi, nắm bắt các tiềm năng, lợi thế ở mỗi địa phương và toàn vùng, tiếp cận các dự án trọng điểm đang ưu tiên thu hút đầu tư, những cơ chế, chính sách ưu đãi đối với nông nghệp, nông thôn và các địa bàn trọng điểm. Tôi đề nghị các đồng chí và quý vị đại biểu tập trung trao đổi, thảo luận, tìm giải pháp khai thác mạnh mẽ các tiềm năng phát triển nông nghiệp và kinh tế nông thôn trong vùng, tập trung vào các lĩnh vực trọng yếu sau đây:
Một là: Đầu tư khai thác thế mạnh phát triển vùng chuyên canh tập trung, trồng rừng sản xuất; phát triển nông nghiệp công nghệ cao, chăn nuôi đại gia súc, nuôi trồng thuỷ đặc sản, gắn với công nghiệp chế biến và tiêu thụ sản phẩm ở các tiểu vùng, trên cơ sở các loại hình liên kết phong phú, đa dạnh giữa doanh nghiệp với hộ nông dân để phát huy hiệu quả sử dụng đất đai, nguồn lao động. Thời gian qua đã hình thành nhiều mô hình liên kết đạt hiệu quả cao như trồng chè giống mới ở Sơn La, Yên Bái, với nhiều thương hiệu nổi tiếng; trồng cây nguyên liệu gỗ, giấy ở Phú Thọ, Tuyên Quang; trồng cao su ở Lai Châu, Sơn La, Điện Biên; chăn nuôi bò sữa ở Mộc Châu, Nghĩa Đàn; nuôi cá tầm, cá hồi vùng nước lạnh ở Lào Cai, Lai Châu, Yên Bái... Đó chính là thực tiễn sinh động để tiếp tục phát huy lợi thế nông, lâm, ngư nghiệp hàng hoá trên địa bàn.
Hai là: Đầu tư phát triển sản xuất tiểu, thủ công nghiệp, gắn với du lịch, dịch vụ, nhất là khai thác thế mạnh về môi trường sinh thái, bản sắc văn hoá các dân tộc, các sự kiện lịch sử trên địa bàn trung du, miền núi Bắc Bộ giầu truyền thống cách mạng và lòng hiếu khách. Phát huy thế mạnh kinh tế cửa khẩu, đẩy nhanh quy mô và hiệu quả xuất, nhập khẩu và kinh tế đối ngoại.
Ba là: Chú trọng thu hút đầu tư cho nâng cao dân trí, đào tạo nhân lực, bồi dưỡng nhân tài. Nhà nước sẽ tiếp tục tập trung cao độ để hỗ trợ đắc lực cho nhiệm vụ trọng yếu này. Đồng thời phải ra sức phát huy tiềm lực xã hội hóa, kêu gọi và tạo môi trường thuận lợi nhất cho các doanh nghiệp, các tổ chức kinh tế, xã hội tham gia vào quá trình phát triển nguồn nhân lực, nhất là ở địa bàn nông thôn, vùng cao, vùng đồng bào dân tộc thiểu số. Nâng cao hiệu quả công tác khuyến nông, khuyến lâm, khuyến ngư. Phát triển mạnh mẽ dịch vụ dậy nghề. Chăm sóc sức khỏe, phòng bệnh và chữa bệnh, chăm lo đời sống tinh thần cho người dân, nhanh chóng nâng cao chất lượng nguồn nhân lực theo yêu cầu chuyển đổi cơ cấu kinh tế nông nghiệp, nông thôn, đẩy mạnh phát triển kinh tế hàng hoá.
Bốn là: Thu hút đầu tư phát triển và nâng cao hiệu quả sử dụng kết cấu hạ tầng nông thôn. Chính phủ đã tập trung nguồn lực khá lớn cho phát triển các trục giao thông huyết mạch, các công trình thủy lợi đầu mối. Tuy nhiên, đường về thôn bản, hệ thống kênh mương nội đồng, lưới điện hạ thế... vẫn còn thiếu nhiều. Việc sử dụng, vận hành, quản lý sau đầu tư cũng chưa thực sự hiệu quả. Tôi đề nghị các địa phương tiếp tục thu hút mạnh mẽ nguồn lực để mở rộng và nâng cấp hệ thống kết cấu hạ tầng nông thôn, bằng nhiều hình thức, kể cả hợp tác công - tư; đề nghị các nhà đầu tư phát huy sáng kiến để cùng Chính phủ và UBND các tỉnh tham gia lĩnh vực quan trọng này.

Diễn đàn xúc tiến đầu tư phát triển nông nghiệp, nông thôn vùng trung du, miền núi Bắc Bộ là cơ hội tốt để các nhà đầu tư, các tổ chức kinh tế, xã hội và các nhà quản lý gặp gỡ, trao đổi ý kiến và kinh nghiệm, tìm ra mô hình thích hợp để thiết lập quan hệ hợp tác, liên kết hiệu quả và bền chặt, thúc đẩy phát triển kinh tế - xã hội trên địa bàn.
Ban Chỉ đạo Tây Bắc và chính quyền các địa phương trong vùng sẵn sàng lắng nghe ý kiến của quý vị đại biểu đối với công tác quản lý, điều hành để không ngừng cải cách hành chính, vận dụng sáng tạo cơ chế, chính sách phù hợp với điều kiện thực tiễn trên mỗi địa bàn, tạo môi trường và điều kiện thuận lợi nhất cho thu hút và sử dụng có hiệu quả các nguồn lực đầu tư.
Nguồn tiềm năng còn hết sức dồi dào; nhiều lợi thế vẫn đang chờ khai thác. Tôi mong rằng, Diễn đàn xúc tiến đầu tư phát triển nông nghiệp, nông thôn vùng trung du, miền núi Bắc Bộ tổ chức tại tỉnh Lào Cai đẹp giầu và năng động sẽ hoàn thành tốt đẹp mục tiêu đã đề ra, đem đến cho mỗi quý vị đại biểu nhiều tình cảm và mối quan hệ bền chặt, sẽ được kết tinh bằng những quyết định cụ thể cho các dự án hợp tác đầu tư phát triển.

Ladies and gentlemen,
It’s my privilege to attend the forum for investment promotion of agriculture and rural development in the Northern mountainous and midland region in 2011 held by Ministry of Agriculture and Rural Development in collaboration with People’s Committee of its provinces in a pretty, rich and dynamic Lao Cai. The forum is held while our country has strong changes in economic growth and structure with a deeper and active international integration. The results of investment attraction for agriculture and rural development in the region with abundant potentials and major challenges will play an important role in the development of the country. With the enthusiastic participation of investors and delegates, I believe that the forum will successfully get the expected objectives. On behalf of the Northwest Steering Committee, I would like to thank the Organizers of the forum and send all delegates and investors best greetings.
The Northern mountainous and midland region has a great important strategic position in economy, society, national defense, security and foreign affairs of the country. This is also rich in land, forest and hills with several ecological sub-regions which create advantages for developing a variety of agricultural, forestry and aquatic products. With the support and investment of the government and efforts of the local ethnic people, agriculture and rural areas in the Northern mountainous and midland region has achieved a strong growth in recent years.
Food production is continuously increased by applying new varieties and technology, and promoting the intensive cultivation. Therefore, many localities have specialities to provide the urban areas. More centralized cultivation areas have been formed to supply such raw materials to processing industries as tea, coffee, rubber, and fruit crop zones including Ha giang and Hoa Binh oranges, Doan Hung pomelo, Yen Chau mango and Bac Kan persimmon, etc. Furthermore, animal husbandry has become the main source of income for many households, and many districts have reached an average rate of 3 cattle per household. Many enterprises and farms are breeding such specialties as wild boars, turtles, sturgeon and salmon, etc with the high profits.
Forestry is changing rapidly. The planning of three types of forest is adjusted to promote protection function, conservation of genetic resource, and increase of economic efficiency. Forests for production are rapidly developing while protection forests are better zoned and protected with increasing coverage and quality. More enterprises have invested in developing forests to supply raw material for wood and paper processing to meet demand on domestic and export market.
Industrial production, small size industry and service business are quickly developing in many villages. Many traditional crafts such as weaving, bamboo and rattan, etc are being restored and expanded. New industries such as handicrafts, embroidery and garments are adopted and replicated in many places. Production and business of crafts in association with preservation and promotion of the cultural identity of ethnic minorities such as the Lac village (Mai Chau, Hoa Binh) would be replicated and has attracted many domestic and foreign visitors.
Affiliation model among enterprise, scientist and farmers in goods organization and production is being abundantly developed. The local Committees and authorities in the region are trying to reform administrative procedures for the most favorable climate to attract investment. Though being at a remote place, Lao Cai province has continuously strived and ranked No.2 in the Provincial Competitiveness Indicator in 2010.
The Party and State of Vietnam are continuing to introduce measures, mechanisms and policies to support the development of the Northern mountainous and midland region. Infrastructure, especially transportation is expanded and upgraded to shorten the distance between the mountainous areas with the urban centers. Hunger elimination and poverty reduction is strongly focused on and getting effectiveness. The poverty rate quickly decreases while the spiritual and material life of people has been improved. The image of rural and mountainous areas is day by day better.
Due to the low starting point, challenges of commodity and business development, and limitations in administrative management, in advertisement and conditions to attract investment in localities, thus many potentials and advantages have not been fully exploited. The mission of investment attraction to develop agriculture and rural areas is becoming very urgent.
Ladies and gentlemen!
The forum for investment promotion to develop agriculture and rural areas in the Northern mountainous and midland region in 2011 is a practical and significant event. The participation of numerous domestic and foreign investors, businesspeople, socio-economic organizations and the presence of representatives of ministries, central agencies, provincial People’s Committees in the region presents a good opportunity to introduce, exchange and understand the potentials and advantages of each provice and the whole region, and to access to the key projects with priorities, mechanisms and incentives to attract investment in agriculture, rural areas and other key areas. I suggest all of you should focus on exchanging, discussing and finding solutions to strongly exploit the development potentials of local agriculture and rural economy with the following key fields:
First: Invest in exploiting the advantages of and developing the centralized cultivation areas and forests for production; develop the high technology agriculture, breed cattle and special aquaculture in association with processing industry and product consumption in the sub-regions on the basis of abundant link types between enterprises and farmers to promote the effective use of land and labor resources. Recently, many effective association models have been formed such as cultivating new tea variety in Son La and Yen Bai with famous branches, planting to supply raw materials to wood and paper processing in Phu Tho and Tuyen Quang, planting rubber tree in Lai Chau, Son La and Dien Bien, farming dairy in Moc Chau and Nghia Dan, and raising sturgeon and salmon in the cold water in Lao Cai, Lai Chau and Yen Bai, etc. That is a vivid reality to continuously promote the advantages of agriculture, forestry and fisheries in the area.
Second: Invest and develop handicrafts and small size industry associated with tourism and service, particularly exploit the strengths of the ecological environment, the cultural identity of peoples, the historical events in the Northern mountainous and midland area with the tradition of revolution and hospitality. Take the advantage of border economy, accelerate the size and efficiency of import, export and foreign trade.
Third: Focus on attracting investment for raising the intellectual, training personnel and fostering talent. The State of Vietnam will continue to concentrate effectively to support this critical mission. At the same time, we should tap potentials of socialization, call for and create a favorable environment for enterprise, socio-economic organizations to involve in human resource development, especially in rural and remote areas and areas of ethnic minority. Improve the efficiency of agricultural, forestry and fishery extension activities. Focus on health care, disease prevention and treatment, spiritual care for people; rapidly improve the quality of human resources under requirement of restructuring the agricultural and rural economy, and promoting the commodity development.
Forth: Attract investment to develop and improve the efficiency of rural infrastructure. The Government of Vietnam has had significant investment on developing the lifeline road system and focal irrigation projects. However, there is a lack of the village street, the canal system and low voltage power grid. Furthermore, the use, operation and management of infrastructure after being invested are ineffective. I suggest the local governments continue to strongly attract resources to expand and upgrade rural infrastructure system in different ways, including the public-private partnership; and recommend the investors to promote their initiatives together with the Government and People’s Committees of provinces to participate in this important field.
Ladies and gentlemen!
This forum for investment promotion to develop agriculture and rural areas in the Northern mountainous and midland region is a good opportunity for investors, socio-economic organizations and managers to meet and exchange opinions and experiences to find out the appropriate model to establish an effective and strong cooperation to improve the socio-economic development in the area.
The Northwest Steering Committee and local authorities are willing to listen to your ideas in management and administration to continuously reform the administration and to flexibly apply mechanisms and policies in accordance with practical conditions of each locality, to create the most favorable conditions for attraction and effective use of investment resources.
The potentials are very abundant and many advantages are available to be exploited. I hope that the forum for investment promotion of agricultural and rural development in the Northern mountainous and midland province held in a beautiful, rich and active province of Lao Cai will reach the expected objectives and give each representative a lot of love and stable relationships which will be crystallized by the specific decision for projects of cooperation, investment and development.

I. GENERAL INFORMATION
1. Vietnam and Climate Change
Vietnam locates in Southeast Asia, with an area of 330,991 km2 and the complex terrain of mountains, plateaus, plains and rivers, in which the two largest rivers are the Mekong and Red River. Vietnam has tropical monsoon climate, with average temperatures from 24-27 ° C and average rainfall of 1500-2.500mm, mainly in the rainy season from May to October.
Vietnam’s population density is highest in Southeast Asia, up to 1,000 people/square kilometer in the Northern Delta (national average is 232 people per square kilometer) while the population density in mountainous areas is much lower. Appropriately 80% of the population lives in rural areas, and 75% of population lives on agriculture and forestry.
Since 1986, the Government implemented the economic development policy named “Doi Moi”, including a series of amendments to the policies and institutions under the open drive, and built a socialist- oriented market economy. This policy is considered to have promoted strong economic growth of the country with annual GDP growth from 1990 to early 2000 from 6% to 9%. After more than a decade of strong growth, in 2009, Vietnam officially became a middle income country in comparison with the world.
However, locating in the tropical monsoon region of Southeast Asia, Vietnam is one of the countries likely to bear the largest negative impacts from climate change. Vietnam has undergone changes of the basic climatic factors as well as other extreme weather phenomena such as storms, heavy rains and drought. The temperature increases from 0.5 to 0.7 oC within 50 years. Coastal regions suffer from tropical storms originating from the South China Sea with an average of 7 storms per year. The frequency of tropical cyclones has also increased to 2.15 times and sea level has risen to about 20 cm within 50 years. Especially, according to the World Bank, Vietnam is one of the five countries most affected by climate changes.
The analysis of climate change scenarios indicate that the average temperature in Vietnam in 2100 over the period 1980-1999 tend to increase between 1.1 to 1.9oC and 2.1 to 3.6oC, annual rainfall increases from 1.6 to 14.6%, and sea level rises about 11.5 to 68 cm. Among these effects, the rise of sea level at a rate of 0.5 to 0.6 cm per year is the most disturbing effects, especially in the South of Vietnam.
Climate change has strong impact on the agriculture and water resources. Floods and droughts occur more frequently due to the increase of rainfall intensity and reduce of rainy days. Red River Delta and the Mekong Delta could be salinizated due to sea level rise. Climate change will also cause the increased risk of loss of biodiversity, particularly native plants and species with high economic value. Sea level rise may reduce the area of mangroves, causing adverse impacts to the melaleuca forests and forests planted on alkaline soil in the South, and changes in the distribution of ancient and secondary forests. Red River Delta, Quang Ninh province, the North Central Coastal Plain, South-central and Mekong Delta regions are most vulnerable.
2. REDD and the importance of the legal framework for REDD
Forest loss and degradation are responsible for about one-sixth of global greenhouse gas emissions, more than the entire transport sector. Therefore, the proposed solutions are to conserve forests, in which one of the most effective methods is based on economic valuation of forests and rational land use. More simply, decisions about whether to keep or clear forest are highly responsive to its price
That is which is why reducing emissions from deforestation and forest degradation (REDD) was first put on the agenda of the UN Framework Convention on Climate Change (UNFCCC) Conference of the Parties (COP) 11 in 2005 and included as an expanded concept, “REDD ”, incorporating enhancement of existing forest carbon stocks, in the Bali Action Plan at COP13 in 2007. Recognition of the importance of forest conservation in mitigating climate change was one of the few points of agreement at COP15 in Copenhagen.
Currently, REDD is considered as an important potential method to reduce carbon emissions and simultaneously to protect the rights of indigenous people. The objective of REDD is to protect the ancient forest, to restore degraded forests, to supply alternatives to the industrial logging to give benefits of long-term and sustainable development and ensure the restoration ability of ecosystems. Also, REDD supports the development for local communities who have role in reducing pressure on remaining ancient forests by building a stable foundation for effective management.
However, to successfully implement the programs or REDD models, first of all it’s necessary to have an effective and appropriate “design” and framework. The design and framework should be legislated at the national level to ensure the validity of enforcement and effectiveness of REDD and REDD as well.
To prepare for a country to participate in REDD, World Bank designed a Ready Preparation Plan (RPP) to implement REDD in the country. Accordingly, it’s necessary to understand changes in land use, policies and directions of the forests to determine the scope and the underlying factors causing deforestation, forest degradation in the country. Thence, the country will draft the corresponding strategy to deal with those agents.
At the moment, strategies and mechanisms for the implementation of REDD have not yet been finalized, evenly some parts have totally not been legalized in Vietnam. Therefore, to ensure the success of REDD in goals of cutting emissions while promoting sustainable development, it’s should be a priority to set up a legal framework, institutions and strategies for the implementation of REDD .
Especially, REDD and REDD is still very new concepts in Vietnam. Legal framework and practical experience in this issue is very few and incomplete. Vietnam is in the process of orientation and identification of barriers in effectively implementing REDD , in which the challenges of improving laws and policies are huge barriers to promote development and to achieve target of hunger elimination and poverty reduction by switching to a low carbon economy. The ability to successfully implement REDD depends primarily on the ability of ensuring the implementation of legal instruments, legal capacity and national institutions.
Thus, program of UN-REDD, IDLO and FAO Legal Office has launched the project “Building a legal framework for REDD ”. The project includes two stages. In the first stage, researches will be conducted in three countries (including Mexico, Vietnam and Zambia) to identify and analyze the legal barriers to the implementation of REDD with the consultation of national experts and relevant parties. A summary report highlighting the crosscutting issues and recommendations to build a legal system for REDD will also be prepared. The second stage will discuss and finalize the results of stage 1, including the summary report through an expert meeting held in early November 2011. After the research result is agreed and expert meeting ends, the recommendations will be established and presented in a side event at UNFCCC in 2011 held in Durban.
3. Forest development in Vietnam
Area and types of forest, and the tendency
Land area classified into “forest land” is 19.2 million hectares, but of which only 13.1 million hectares is forested (according to the 2008 figures), the remainder consists of bare and barren slopes. 10.3 million hectares of forest land is of natural forest, and 2.8 million hectares is of planted forest. The use of forest land is classified into three types of items, which are special-use forests (most areas are protected) with 2.2 million hectares, forests with 5.7 million hectares, and production forests with 8.3 million hectares. Forests are unevenly distributed throughout Vietnam, from 5% of land in the northern delta and the Mekong River, to 35% in North Central region and the Coastal Central areas, and 56% in Highland regions. The forest types are varied, including coniferous forests, deciduous forests, mixed coniferous forests, wet and dry dipterocarp forests in the highland and lowland dipterocarp forests, mangroves, bamboo, and mixed wood and bamboo trees in the lower regions, plains and wetlands. The quality of forest is also significant different.
The changing process of forest land in Vietnam is very impressive. During the period from 1943 to 1983, about 50% of forests have been strongly destroyed during the four decades. The area of forest coverage is decreased to a minimum of about 27% in 1990. However, from 1990 to 2000, Vietnam has increased by 236,200 hectares of forest each year, equivalent to a 2.5%year increase. From 2000 to 2005, the rate of increase is 2.1 % a year. This leads to the growth rate of forest coverage to 38.3%, or about 2,568,000 hectares in 2008.
The figures show that Vietnam has come to the right of the variable graph of forest (see Figure 1.3) with increasing forest areas. However, national data do not show large differences in the situation of different areas in the country. At Highland region, deforestation (and degradation) continues to be major factors in changing land use. In other areas, for example, in the North Central region, deforestation is continuing with a much lower rate could be considered to have achieved a stable forest cover.

The major factors causing deforestation and forest degradation
Results of scientific researches and Program of Survey, Monitor and Evaluation on national forest resources from 1991 to today have shown some major causes leading to changes in area and quality of forests in Vietnam as follow:
- Due to conversion from forest land to agricultural land. This is one of the main factors causing deforestation.
- Due to the backward farming habits, shifting cultivation of wandering hill tribes, and heavily dependence on forest resources for survival. Besides, the relocation of people from the lowlands to the highlands and from the Northern mountainous areas to the Highland region has contributed to the rate of population growth pressure on the existing forest area.
- Because there are no rational forest control and exploitation measures while illegal logging occurs in many localities. Furthermore, the legal system is incomplete; the law enforcement capacity is limited, and the lack of coordination between law enforcement agencies. Besides, the process of allocating land and forest and issuing the certificate of land use right is slow, the forest use rights are unclear.
- Because of the need for economic and social development such as construction of irrigation systems, hydroelectric powers, road systems, arrangement of resettlement and construction of industrial parks and mining areas, etc.
- Because of the demand to supply raw materials for processing industries and export of timber and forest products.
Vietnam Government is well aware of the causes of deforestation and forest degradation and has a lot of effort to solve this problem, and has achieved results internationally appreciated.
However, the State’s investment is not infinite. Therefore, it’s necessary to promote the socialization of the protection and development of forest through the establishment of a new and sustainable financial mechanisms based on policies of payment of forest environmental services. Besides, the sustainable forest management and protection also contribute to bringing the benefits to region and globe (for example, limiting climate change, biodiversity conservation, etc.). Therefore, the international community must also have the responsibility to support the Government of Vietnam.
Nonetheless, currently the value of the forest has not been fully calculated, people have not felt secure to live on the forest as well as actively participated in stable forest use and management. As a corollary, the pressure on forest resources is increasing, the phenomenon of deforestation and forest degradation are occurring in many areas. If the value of forests was fully assessed and quantified (including the value of timber, NTFPs and environmental values, ect.), that would be an important basis to compare between the interests of forest protection and development with profits from the conversion of forests to other uses. It’s also the basis for building a strong enough incentive policy to prevent deforestation and forest degradation. However, the evaluation of forests (especially to quantify the value of forests to absorb carbon and reduce greenhouse gas emissions) and calculation of the opportunity cost of activities of using various resources in Vietnam and the market search as well are facing difficulties.
II. OPPORTUNITIES FOR REDD IN VIETNAM
According to statistics of the Ministry of Agriculture and Rural Development, as of December 2007, natural forest area of Vietnam is 10.28 million hectares (equivalent to 31% of the total natural area). Although in recent years, forest cover has increased from 28% in 1993 to 38.7% in 2008, forest degradation and deforestation continues, especially in the Southeast and Highland regions. Forests in Vietnam have a high biological diversity, and are the convergence of the flow of plants and animals from the East to the West and from the North to the South. As a result, given the three criteria of the Forest Carbon Partnership Facility including area of the existing natural forests, biodiversity and changes in forest resources, Vietnam is qualified to be chosen as pilot countries to implement REDD.
Vietnam joined the UN Framework Convention on Climate Change (UNFCCC) in November 1994 and approved the Kyoto Protocol in September 2002, we have full legal basis and international criteria to implement REDD.
In Vietnam, the Party and State is very interested in forest protection and development associated with social-economic development and poverty alleviation in rural and mountainous areas. Law on Forest Protection and Development (2004), Law on Environmental Protection (2005) and Biodiversity Act (2008) have defined the task of protecting and developing forests. Sustainable forest management is one of five key programs of the National Forestry Development Strategy in the period of 2006-2010 and the vision to 2020 approved by Prime Minister.
Sustainable forest protection and development is also an important content in the Plan Framework to respond to climate change issued by the Ministry of Agriculture and Rural Development under Decision No.2730/QĐ-BNN-KHCN on Sept 5, 2008 and the National Target Program to respond to climate change under Decision No. 158/2008/QĐ-TTg on Dec 2nd, 2008.
In Decision 158/2008/QĐ-TTg, the Prime Minister clearly stated the need to mobilize resources to implement the National Target Program to respond to climate change, in which the financial support from the international community is very important. Carbon absorption is considered as an environmental service provided by forests, thus the implementation of REDD will contribute to improve payment policy for environmental service of forests under Decision No.380/QĐ-TTg of Prime Minister.
The advantage of Vietnam is the governmental management system on forest sector from the central to local levels which is the favorable conditions to implement REDD. Auspiciously, REDD is an effective financial mechanism to implement policies the policies and guidelines. For REDD to succeed, poor nations with forests must implement policies that reduce and eventually eliminate forest clearing and degradation, and/or policies that enhance existing forest carbon stocks. Those that do will be rewarded financially from governments and businesses in the developed world that need to offset their own emissions. The concept is simple; the reality is likely to be much harder and many organizations are studying the technical, policy, and financial barriers to its successful implementation. For example, IUCN has focused on the legal preconditions for fair and effective REDD while the Regional Center for Forests and People (RECOFTC) in Bangkok has looked at the scope for community participation in REDD .
Established in 2008 and primarily funded by the Norwegian government, the UN-REDD Program (http://www.un-redd.org/) helps developing countries, including Vietnam, to get ready to participate in a future REDD mechanism. Of the “REDD readiness” issues that need to be addressed, the government of Vietnam identified the design of a transparent and equitable benefit distribution system (BDS) as a priority
For Vietnam, forest protection is very important to the sustainable development of the country. According to official statistics, Vietnam has a lost about half the cover forest in the period from 1943 to 1990. Since then, Vietnam has maintained a trend to grow all types of forests around 2% per year. Nonetheless, even if rates of cover forest have increased, the quality of forests is continuously degraded. Meanwhile, the forests with areas markedly decreased and reversely degraded are richest in carbon. At the same time, it’s estimated that there are about 25 million people (representing 28% of the country’s population) living in the mountainous, deep and remote areas. Most of them are ethnic minorities that have difficult and poor lives and live on forests for survival. Thus, forestry has an important role in improving livelihoods and reducing poverty for people in mountainous and rural areas .
Recognizing the importance of forests to cope with climate change and sustainable development, Vietnam has shown interest and enthusiasm for the implementation of REDD . Vietnam is one of nine countries chosen to implement the pilot projects of the United Nations Program on Reducing Emissions from Deforestation and Forest Degradation in Developing Countries, and is the first country in the world making the national REDD program. Vietnam Government considers REDD implementation as one of the main tasks of National Target Program to respond to climate change.
Nowadays, the Ministry of Natural Resources and Environment (NRE) is the state agency in change of activities to respond to climate change in Vietnam, but the Forestry Department under the Ministry of Agriculture and Rural Development (MARD) is the leading agency of REDD development strategy through the National Steering Committee to respond to Climate Change. Government recognizes REDD as a transnational and interdisciplinary issue, it should be “widely and actively participated by relevant parties”.
Vietnam is well placed to develop a REDD compliant BDS as a result of many years of experience with similar systems such as Program 661 (also known as the Five Million Hectare Reforestation Program), which pays households to protect forests, and internationally supported payments for forest environmental services (PFES) pilot projects. The focus on BDS also capitalizes on Vietnam’s functioning administration, social stability, and relatively high degree of tenure security. These are assets that Vietnam can use to gain a competitive edge in a future international REDD regime. Vietnam also has large areas of degraded forest that if allowed to regenerate naturally could rapidly sequester carbon and conserve soil and water. (In fact, 1.2 million out of Vietnam’s 16 million hectares of forest are classified as “no forest” or “not yet forested”.)
Researches on benefit distribution system under mechanism of REDD in Vietnam conducted by International Union for Conservation of Nature in coordination with the Ministry of Agriculture and Rural Development in 2010 have released conclusions : REDD could generate about $80-100 million/year in Vietnam. However, this potential can only be realized if government takes steps to ensure that REDD is implemented effectively. This involves: developing a comprehensive REDD strategy to generate and sustain emissions reductions at the local level; developing the necessary capacity to measure and report on emissions reductions; and putting in place a BDS that meets the requirements of international investors and the needs of forest managers.
It could be said that opportunities for development and implementation of REDD in Vietnam is huge both in conditions of economy, society and environment and the orientation of the government. Besides, the benefit of REDD implementation Vietnam gets is considered largely. However, as mentioned above, the success of REDD implementation mainly depends on whether the establishment of legal framework and enforcement institutions is effective or not.
III. REALITY OF POLICIES AND RULES RELATED TO REDD IN VIETNAM
At the international level, Vietnam has signed and joined in UN Framework Convention on Climate Change (UNFCCC), Kyoto Protocol and the UN Convention on Biological Diversity (CBD). Vietnam has applied the “Non-legally binding instrument on all types of forests” launched by the United Nations Forum on Forests (UNFF). Also, at the regional level, in 2009, Vietnam has adopted a multi-sector framework issued by ASEAN on climate change, Agriculture and Forestry towards food security, including factors of REDD .
At the national level, Vietnam has effectively promulgated and implemented some laws and policies on climate change, including forest protection and development to create the basis and support for REDD implementation. This report focus on analyzing legal documents and policies related to REDD in Vietnam at national level.
Within the legal system of Vietnam, REDD is mainly governed directly by the policies and laws on land, forest protection and development, environmental protection, and biodiversity conservation, etc, and especially by policy and law on forest protection and development. In addition, in process of REDD implementation, it is also subject to adjustment of such other policies and laws as: finance, sanctions on administrative violations, complaints and denunciations, etc. There always exists a mutual relationship in the same legal system in fields of policy and law.
1. THE UN-REDD PROGRAM
As mentioned above, Vietnam has joined the United Nations Framework Convention on Climate Change (UNFCC) in November 1994 and approved the Kyoto Protocol in September 2002. This is the most basic legal foundation for Vietnam to set up the legal framework and the REDD implementation.
Also, Vietnam is one of nine countries chosen to implement the pilot projects of the United Nations Program on Reducing Emissions from Deforestation and Forest Degradation in Developing Countries, and is the first country in the world making the national REDD program. Vietnam Government also recognizes the REDD implementation as one of the core tasks of the National Target Program to respond to climate change.

At the moment, the Ministry of Natural Resources and Environment (NRE) is the state agency in change of activities to respond to climate change in Vietnam, but the Forestry Department under the Ministry of Agriculture and Rural Development (MARD) is the leading agency of REDD development strategy through the National Steering Committee to respond to Climate Change.
The objective of the UN-REDD Program for Vietnam is to assist Vietnam Government in developing an effective REDD regime in Vietnam and to contribute to reduction of regional displacement of emissions. This will contribute to the broader Goal of ensuring that by the end of 2012 Vietnam is REDD-ready and able to contribute to reducing emissions from deforestation and forest degradation nationally and regionally.
The UN-REDD Program for Vietnam seeks to address deforestation and forest degradation through capacity building at national and local levels. Firstly, it will build the capacity at national level to permit the Government of Vietnam, and especially the REDD focal point in the Department of Forestry of the Ministry of Agriculture and Rural Development (MARD), to coordinate and manage the process of establishing tools to implement a REDD program. Secondly, it will build capacity at local levels (provincial, district and commune) through pilots in two districts in Lam Dong province that demonstrate effective approaches to planning and implementing measures to reduce emissions from deforestation and forest degradation. Also, the program seeks the cooperation among Mekong countries in reducing emissions in the region.
The process of REDD implementation is divided into two stages, including the first stage from 2008 to 2012 with the content of increasing capacity at levels and relevant parties in implementing REDD in time of carrying out the pilots, and the second stage after 2012 to conduct REDD (if REDD officially became a financial institution in International Agreements on Climate Change)
Under Decision No.01/2008/NĐ-CP by Government on functions, rights, duties and organization of the Ministry of Agriculture and Rural Development to respond to climate change, the Ministry of Agriculture and Rural Development is a state management agency on agriculture and rural development, in which the forestry is the leading agency to coordinate with the Ministry of Environment and Natural Resources (the national focal agency in UNFCCC implementation) and Ministries, departments and localities to survey the REDD implementation for Vietnam. The Ministry of Agriculture and Rural Development has assigned Bureau of Forestry as a leading agency to coordinate with other units inside and outside the Ministry, international organizations building and implementing REDD.
Implementing Decision No.2 of the 13th Conference of Parties to the UNFCCC (COP13), in February 2008, Vietnam proposed to the Secretariat of the Convention the document stated views on methodology and implementation schedule of REDD implementation, including the suggestion of activities needed to be funded by the international community.
In addition, The Subcommittee for Limitation on Climate Change and REDD with governmental and non-government people has established REDD Project Idea Note (R-PIN) in Forest Carbon Partnership Facility in Vietnam in charge of developing the policies and programs for REDD, and setting up a consultation process.
The establishment of the National Steering Committee to respond to Climate Change with participants of the Ministry of Agriculture and Rural Development, the Ministry of Environment and Natural Resources and other Ministries presided by Prime Minister has shown an agreement in coordination among ministries and departments. In fact, however, the duty allocation in responding to climate change could cause challenges in the coordination.
The UN-REDD was officially deployed in Vietnam – the only chosen Southeast Asia country in Sep 2009 at the cost of nearly $4.4 million sponsored by the Norwegian Government. Lam Ha and Lac Duong districts of Lam Dong province was selected for pilot implementation by the consultation of the local people. UN-REDD also carried out activities to improve the professional skills of monitoring and assessing the carbon stocks of forests and raise the awareness of REDD to the people.
The specific contents have been completed after 18 months, including the distribution regime establishment for relevant ministries, departments and organizations; the building of REDD network; the establishment of technical groups; the building of the national strategy plan; the implementation of Community Consultation (FPIC) in some provinces; the improvement of capacity and awareness by holding seminars and trainings; and the implementation of technical researches such as the data building on forests etc.
After the first success of the United Nations Program on Reducing Emissions from Deforestation and Forest Degradation in Vietnam, the national network of REDD continues to propose UN-REDD Phase II with the total expense of $ 100 million. The overall objective of UN-REDD Phase II in Vietnam is the stable forest resource management to reduce emissions from deforestation and forest degradation.
The main operation of UN-REDD Phase II is to establish the National REDD Program, the carbon calculation and distribution regimes with the fair participation and distribution from REDD … piloted down in six provinces with huge forest coverage, including Bac Kan, Binh Thuan, Ca Mau, Ha Tinh, Lam Dong and Lao Cai. Besides REDD, Vietnam tends to implement the innovation of REDD with the content relating to the natural conservation and biological diversification.
To direct, set up and implement the programs of REDD and REDD in Vietnam, on January 7, 2011, Minister of the Ministry of Agriculture and Rural Development issued Decision 37/2011/QĐ-BNN-TCCB to establish the steering committee on the implementation of REDD innovation headed by Mr. Cao Duc Phat, Minister of the Ministry of Agriculture and Rural Development
The implementation of UN-REDD Phase I and UN-REDD Phase II in Vietnam is to ensure that Vietnam will be ready to implement REDD at the end of 2012. The implementation of REDD is a content of national forest development strategy. Some other contents of this strategy such as the enhancement of law enforcement, the management and trade of forest products, payments for Ecosystem services (PES), etc will interact and support the implementation of REDD.
Because REDD is a relative new issue and in the discussion in international negotiations, the programs, policies, legislation and plans for social economic development of Vietnam has not mentioned fully and specifically REDD . In Oct 2010, the Ministry of Agriculture and Rural Development has begun to incorporate the contents of REDD on the National Plan on Forest Protection and Development during the period of 2011-2020. The plan is expected to be submitted to Prime Minister in the 3 quarter of 2011.
2. Policies and rules on land, forest protection and development
In Vietnam, there are two laws and regulations on forests and forest land. Law on Land in 2003 regulates relations related to forestry land. Law on Forest Protection and Development in 2004 adjusts the relations related to forests as resources and assets on forest land, which is summarized as follow:
2.1. The concept of forests
- Law on Forest Protection and Development in 2004 is the written document with the highest legal effect of regulations on management, protection, development, and use of forests as well as the rights and obligations of forest owners. The Law provides, “The forest is an ecosystem consisting of the complex of forest vegetable, forest animals, forest microbe, forest land and other ecosystem factors, in which timber, bamboo or characterized flora is the main component of the forest cover from 0.1 upwards. Forests include natural forests and planted forests on production forest, protection forest and special-use forest land” (clause 1, Article 3).
In practicing, the Ministry of Agriculture and Rural Development has specific guidance on the criteria of forest identification under Circular No. 34/2009/TT-BNNPTNT on June 10, 2009. Accordingly, some objects are determined as forests if three criteria are achieved as following:
Is an ecosystem, in which the main component includes perennial, woody, palm trees with the top soaring height of 5.0 meters or more (except for newly planted forests and some species of coastal mangrove), bamboo, etc and able to provide timber, NTFPs, and other direct or indirect value such as biodiversity conservation, environmental protection and landscape.
Young forests of woody trees and new generation forests after being logged having an average height of 1.5 meters for the slow-growing tree species, over 3.0 meters for the quick-growing tree species and a density of 1.000 plants / hectare or more is considered as forest.
- The cover of foliage –the main component of forests must reach 0.1 or more.
- The minimum consecutive area is 0.5 hectare or more, if it’s a strip of trees, it must have a minimum width of 20 meters and with more than 3 lines of tree.
However, there has not had the definition of forest degradation in law and other guidelines as well.
2.2. Forest Classification
- National Forest is divided into three types of forest uses, including special-use forest, protection forest and production forest. Thence, the Government regulates the management and use suitable to the purpose of each forest type.
- Classification of forests is according to the formation (natural forest, plantation forest); the terrain conditions (mountainous land forests, wetland forests, mangroves…); the tree (woody forest, mixed forest); and according to the reserve (poor, medium, rich, very rich, and no reserve)
- In 2001, the Ministry of Agriculture and Rural Development approved the Forestry Development Strategy for 2001-2010, in which the planning of forest land is 16 million hectares, including 2 million hectares of special-use forest, 6 million hectares of protection forest and 8 million hectares of production forest.
- In December 5, 2005, the Prime Minister issued Direction No. 38/2005/CT-TTg to direct localities to review, plan and reorganize three types of forests to suit practical requirements, to ensure the requirements of conservation, protection and sustainable economy development. The areas of three type of forests nationwide after reviewing is 16.247.492 hectares (nearly 50% of the natural land of the whole country), including 2.199.342 hectares of the planned area of special-use forest, 5.552328 hectares of protection forest and 8.495.823 hectares of production forest. The area is relatively consistent with the national forest distribution expectation in 2020 mentioned in the Vietnam Strategy for Forestry Development in period of 2006-2020.
- According to the Ministry of Agriculture and Rural Development, to December 31, 2009, the national forest area is 13.258.843 hectares (coverage rate of 39.1%), including 1.199.915 hectares of special-use forest, 4.832.962 hectares of protection forest, and 6.288.246 hectares of production forest.
This is an important legal basis to investigate, survey, and assess the forest conditions, to measure the stored and absorbed carbon reserves to select the suitable place for REDD implementation.
2.3. Policies on land and forest allocation
- Law on Land in 2003 (Article 5) states that land belongs to the entire people with the State as the representative owner. The State has the most powerful determination on land through the specific juridical capacity. The State shall grant land use rights to land users via the form of allocation of land, lease of land, and recognition of land use rights for persons currently using the land stably.
- Law on Forest Protection and Development in 2004 (Article 6) states that the State unanimously manages and determine the natural forests and forests funded by the State capital, forests the State has the forest ownership rights transferred from forest owners. The State has the determination rights on forests. The State shall grant forest use rights to forest users via the form of allocation of forest, lease of forest, and recognition of forest use rights, use rights for production forests that are planted.
Thus, as prescribed by current law, land and forest allocation is one of the basic methods the State grants land and forest use rights to those in society and form a system of forest owners. Law on Forest Protection and Development states that forest owners are organizations, households and individuals the State allocates and releases forests, allocates land to plant, releases land to plant, recognizes the forest use rights, recognizes the use right of production forest as plantation forests; accepts the transfer of forests from other owners. There are 7 types of forest owners such as Management Department of protection forest, management department of special-use forest, economic organizations, households, individuals… furthermore, the forest use right is also allocated to commune community and recognized as forest.
- After the promulgation of Law on Forest Protection and Development, state agencies have adopted many legal documents guiding the implementation of law. The Ministry of Agriculture and Rural Development has issued Circular No.38/2007/TT-BNN on April 25, 2007 guiding the order and procedures for allocation or lease of forests and forest recovery to organizations, households, individuals and rural communities. Recently, on Jan 29, 2011, the Ministry of Agriculture and Rural Development, the Ministry of Natural Resource and Environment has issued Circular No. 07/2011/TTLT-BNNPTNT-BTNMT guiding some contents on the allocation and lease of forests associated with forest land allocation and lease of forest land. Accordingly, the guidelines for coordination between the agencies of Natural Resources and Environment and the Forest Rangers under the General Directorate of Forestry (the Ministry of Agriculture and Rural Development) to perform tasks such as allocation and lease of forests associated with land, forestry land for the first time; to complete profile of allocation and lease of forests; to complete cadastral documents for cases that was allocated and leased forests but have not been handed over forests or forest land, or not yet granted certificate of land use rights, etc. The map used in this case has the VN-2000 reference system with the basic rate of 1/10000 or 1/5000.
- Law on Land, Law on Forest Protection and Development also provides rights of forest owners (converse, transfer, donate, lease, inherit, mortgage, guarantee or contribute capital with the right use of forests and forest land) depending on the types of forests and forestry land assigned (special-use forests, protection forests, production forests), or depending on the types of forest owners (organizations, households, individuals or rural communities).
Households, individuals or rural communities assigned forest land only have rights to use land; assigned natural forests only have rights to use forests, not forest owner rights. Rural community assigned forests have less rights in comparison with the rights of forest owners of households and individuals such as no rights to converse, transfer, donate, lease, mortgage, guarantee or contribute capital on business equivalent to the value of assigned forest use rights (see Box 1, Box 2). This is one of the important legal bases to identify the main objectives who will participate in the activities of REDD and be shared benefits from REDD .

In addition, Law on Land, Law on Forest Protection and Development also provides policies on land and forest lease for organizations, households and individuals, and defines the rights of forest owners to lease forest and land, creating a legal basis to form the the owners of forests. These are also the subjects involved in activities related to REDD and shared benefits from the collection of REDD .
- According to the Ministry of Natural Resources and Environment, as of January 1, 2009, the State has allocated about 11.4 million hectares of forest land to organizations, households, individuals, rural communities for stable and long-term use, including delivery to households and individuals to 3.82 million ha (equivalent to 33.5%), and 2.97 million hectares of economic organizations (26%).
Forests, as resources and assets on forest land have changed in terms of structure of ownership/rights to use forests in recent years to implement policies of forest and land allocation. In fact, three major types of forest use/ownership rights have been established as follow:
Firstly, forests belong to the forest use/ownership rights of state agencies formed on the basis of forest and forestry land allocation of the Sate to the state economic organizations, to management board of special-use forests, protection forests and production forests, to armed forces, and other units; the unassigned forest and forest land areas are owned and managed by Committee of People at commune level.
Secondly, forests belong to the forest use/ownership rights of households, individuals, private units formed on basis of the allocated forest and forestland areas to households, individuals, private units, joint venture companies for stable and long term forestry use.
Thirdly, forests belong to the forest use/ownership rights of communities formed on basis of forest and forestland areas managed traditionally by communities or allocated by the State for stable and long term forestry use.
- In terms of structure of forest ownership/use rights, as of Dec 31, 2009, according to the Ministry of Agriculture and Rural Development, the total natural forests is 13.258 million hectares, including 8.672 million hectares of forests of state organizations equivalent to 67%, of which the economic organizations account for 2.044 million hectares (15.6%), the management of protection forests is 2.328 million hectares (17.6 %), the management of special-use forests is 1.99 million hectares (15.2%), approximately 2.31 million hectares (17.6%) have not been allocated to specific owners and under management of People’s Committee at commune level. The forest areas under the ownership/use rights of non-state sector accounts for 33% or 4.568 million hectares of natural forests, including 3.28 million hectares of households and individuals (about 25%). In coming years, Vietnam continues to promote the policies to allocate land and forests to various non-state economic sectors (including households, individuals and communities), the forest and forest land owned by state will decrease while forest and forestland areas under the ownership/use rights of other non-state sectors tends to increase.
2.4. Contracting policies on forests and forest land
- In legal systems related to forest management, a civil relationship is also referred as forest and forestland contracting. The contracting legal document for state enterprises is Decree No. 01/CP issued by the government on Jan 1, 1995 regulating the assignment of land use for purposes of agriculture, forestry, and aquaculture which was replaced by Decree No. 135/2995/ND-CP issued by the Government on Nov 08, 2005 for allotment of agricultural land, production forest land and water surface land for aquaculture farming in the state farms, forestry farms.
The distinction between the forest allocation and forest contracting is needed (see Box 3), as it relates to the legal status of the subjects involved in this relationship and of course, these subjects have different rights, including rights of benefiting from the carbon services. Households, individuals and rural communities who accept contracting to protect, regenerate and afforestate are not “forest owner”. In essence, they are just employees through the contract with forest owners (contracting party).
- According to the Ministry of Agriculture and Rural Development, along with forest and land allocation and lease, yearly, Project 661 have spent about 150 to 200 billions to contract for protection of over 2 million hectares of concentrated forests in the priority areas to contract for forest protection. The total area of forest protection have made 2,454,480 hectares, of which, the contracted areas in the period of 1998-2005 achieved 2,416,413 on 2,000,000 hectares available, reaching 120%. The period of 2006-2010 achieved 2,507,355 on 1,500,000 hectares, reaching 167%.
2.5. Policies on logging, using and benefiting from forests
Framed in the Law on Forest Protection and Development in 2004, wherefrom, on basis of the distribution of three forest types, the State promulgates different regimes of mining, using and benefiting from forest which may be summarized as follows:
- Decision No.186/2006/QĐ-TTG issued on August 14, 2006 by the Prime Minister on forest management regulation and Circular No.35/2011/TT-BNNPTNT issued on May 20, 2011 by the Ministry of Agriculture and Rural Development on guiding the exploitation and gather all of timber and NTFPs which have concretized the exploitation of forests under the types of forests (including special-use forests, protection forests and production forests); under each type of forest owners (organizations, households, individuals and rural communities); under the foundation of forests (natural forests or planted forests); under the capital of forests (the capital of the State, capital of the forest owners, investment and fund of the international projects)
- The rights of benefiting from forests are specified in a number of legal documents such as Decision No. 178/2001/QĐ-TTg issued on Nov 12, 2011 by the Prime Minister on the benefits and obligations of households and individuals assigned, leased or contracted forest and forest land; Decision No 661/QĐ-TTg on July 29, 1998 by the Prime Minister on the objectives, tasks, policies and implementation of Five Million Hectare Reforestation Program, Decision No.147/2007/QĐ-TTg issued on Sept 10, 2007 by the Prime Minister on a number of policies for production forest development in the period of 2007 to 2015. Under the provisions of the legislation mentioned above, the right of benefit from the forests means the benefits from the forests that forest owners or contracted persons will get, including timber, firewood, NTFPs (mainly forest vegetation not banned to exploit), the combined products of agriculture, forest and fishery, the fair cost (if any), etc. The right of benefits from forests is applied to two following cases:
The right of benefit from forests to the forest owners who are allocated land and forest; leased land and forests.
The right of benefit from forests to the contracted persons who protect, regenerate and afforestate forests.
Organizations, households, individuals and communities participating in planting, protecting, regenerating forests funded by the international project would benefit from forests under the regulations of the project.
Thus, under the current legal framework, the right of benefit of forest owners who are households, individuals mainly from the direct use values of forests, and there has not been any legislation that specifies the right to benefit from the services of carbon.
On the supposition that there is income from the carbon services, it’s necessary to address two main benefit relationships as follow:
- Sharing the benefits between the State with forest owner from the income of the carbon service in case the forest owner is allocated the natural forest, and the planted forests are funded by the State because forest owners are not the creator of the forest, they only contribute to the protection, maintenance and increase of use value of forests.
- Sharing the benefits between forest owners with contracted person, in case forest owners make forest protection contracts to households, individuals, and rural communities
This issue should be studied and considered when setting up the regime of benefit share from REDD .
2.6. Policies on payment for forest ecosystem services
- Vietnam is the first Southeast Asia country piloting down the policy on payment for forest ecosystem services under Decision No. 380/QĐ-TTg issued on April 10, 2008 by the Prime Minister with piloting time of 2 years (from May 2008 to December 2010) which is applied in two provinces of Lam Dong and Son La.
This is one of the new policies in the forestry sector to mobilize financial resources from organization and individuals that benefit from environmental services to pay for forest protection and development.
As stipulated in Decision 380, seven hydroelectric power production facilities and pure water suppliers have to pay for regulation and provision services of water and solid conservation, services of limiting erosion wear, anti-sedimentation of reservoirs. In addition, organizations and individuals dealing in tourism based on forest ecosystems must also pay for services. The proceeds from the above units are non-state budget and considered as additional funding outside the budget and paid for providing forest ecosystem services.
To end of 2010, seven of seven subjects who are hydroelectric power production and water supply facilities have made the payment for forest ecosystem services of 2009 and 2010 with the total amount of 169.870billion Dong. Parties using the services must pay for the providers of forest ecosystem services through the Fund of forest protection and development. This fund is an intermediary organization to receive trust money from hydropower production facilities, pure water production and supply facilities, organizations, individuals dealing to tourism business based on forest ecosystems, then this money after deducting the relating administrative costs will be paid to the providers of forest ecosystem services (including forest owners, contracted households). The level of payment for forest ecosystem services to households protecting the forest in the pilot areas in Lam Dong province ranges from 270,000 VND/ha/year to 400,000 VND/ha/year (about three to four times higher than the contracting fees of forest protection paid by the State under the Five Million Hectare Reforestation Program). While the payment level in Son La province is from 85,000 to 136,000 VND/ha/year.
- Based on the successful pilot, the Government issued Decree No. 99/2010/NĐ-CP on Sept 24, 2010 on payment policies for forest ecosystem services (Decree No 99/2010/NĐ-CP) are in effect nationwide since Jan 1, 2011. Under the provisions of this Decree (Article 4, Article 7, and Article 11) starting from Jan 1, 2011, three types of forest ecosystem services will be paid for forest ecosystem service, including:
(1)-Soil conservation, erosion and sedimentation limitation on the lake, river and stream;
(2)-Regulation and maintenance of water resource for production and social life
(3)-Protection of natural landscape and biodiversity conservation of forest ecosystems.
3 Three subjects have to pay for forest ecosystem services, including
(1)-Hydroelectric power production facilities;
(2)-Pure water production and supply facilities;
(3)- Organizations, individuals dealing to tourism business have benefited from the forest ecosystem services with the amount of 20 Dong/1kwh of commodity electricity (for hydroelectric power production facilities), 40 Dong/ one cubic meter of pure water (for pure water production and supply facilities) organizations and individual business travel has benefited from the forest ecosystem services with rates from 1% to 2% of sales made during the period.
One of the latest points of the policy is the legal clear statement that the proceeds from the above units are non-State budget and considered as the additional financial resources outside the state budget and paid for the providers of forest ecosystem services. The total proceeds of forest ecosystem services from hydroelectric power production facilities and pure water production and supply facilities by 2015 is estimated about 1,300 billions Dong/year (…USD), not including revenues from tourism business units based on forest ecosystems.
Some other will have to pay for forest ecosystem services in the following years after the legal adjustments such as the industrial production facilities that use water directly from water sources, objects have to pay for carbon absorption and store services; services of providing the breeding grounds, food and natural breeding, and using the water resources from forests to farming aquaculture.
Decree 99/2010/NĐ-CP (Article 8, Article 3) also provided that subjects who are paid for forest ecosystem services are forest owners and contracted households to protect forest from state organizations. Parties using services must pay for service providers through the Fund of Forest Protection and Development in the central and provincial levels. This fund, similar to what is regulated in Decree No.05/2008/NĐ-CP issued Jan 14, 2008 by the Government, is an entrusted intermediary organization from the users of forest ecosystem services, then the proceeds, after deducting the relating administrative costs will be paid to the provider of forest ecosystem services (forest owner, contract household)
Thus, according to Decree 99, the special-use forests, production forests or protection forests will be paid for services if they are able to provide one or more types of ecosystem services under the regulation, such as ensuring water resources for hydropower generation, pure water production and eco-tourism activities.
The forest owners that provide services and organizations, households and individuals, rural communities have contracts for forest protection with long-term stability with forest owners will receive payment.
Payment mechanisms for forest ecosystem services are expected to socialize successfully the forestry sector, gradually establish a sustainable economic base to help protect the environment and ecosystems, and to improve the quality of forest ecosystem services.
There were some lessons drawn from the test model of PFES in Lam Dong and Son La provinces can help to continue research in the framework of REDD implementation such as:
- Under the PFES program, communities are assigned the role of forest protection and paid for the performance of this role. The question is that the community can be paid for contributing to the objectives of REDD or not? If so, what and how are the the exact roles of communities in the REDD implementation.
- Management and disbursement of revenues from REDD , including the role of Fund of forest Protection and Development. May this Fund be the entrusted organization of revenues from REDD or not? May the distribution system involved in PFES apply to the implementation of REDD or not?
- Are Beneficiaries from REDD similar to objects paid by forest ecosystem services
2.7. Sanctions against administrative violations of forests
Vietnam has promulgated many legal documents on strengthening forest law enforcement. Crimes are classified under the Penal Code, including four types related to forestry: relating to exploitation and protection (Article 175), forest management (Article 176), destruction of forests (Article 189) and a special regime for the protection of natural protected areas (Article 191). Law on Forest Protection and Development (Article 12) has a number of prohibited actions, including: exploiting, illegal logging; illegal hunting and gathering; violation on regulations on the prevention for forest fires; illegal encroachment and conversion of forest land use; illegally transporting forest products; free grazing and other activities. The legal system has assigned MARD-the rangers to supervise and inspect the implementation of the law, to gather evidence and conduct investigations, sanctions and monitoring issues related to crime. To the more complicated crime with the larger number and value of the evidence will have to switch to a police agency.
2.8. State management agencies of forests and forest land
Under current law, there are two branches to perform the tasks of State management over forests and forest land in the whole country; they are the MNRE and MARD
- Under the provisions of land legislation, the organizational system of land management agencies was established from the central to grassroots (level). Land management agencies at central level are MNRE. General Department of Land Management (DLM) performs the function of advising and assisting the Minister of Natural Resources and Environment, State management and implementation tasks of state management on land in the country. Organizations assisting the General Director in performing state management functions are Department of Registry and Statistics (DRS), Department of Land Planning (DLP), Department of Economics and land Development (DELD). Land management agencies at the provincial level are the Department of Natural Resources and Environment (DNRE), including the registration department of land use rights. Land management agencies at the district level are the Division of Natural Resources and Environment, including registration office of land use rights. Commune level has administration officials.
- According to Law on Forest Protection and Development, the state management agencies specializing in forestry are held uniformly from the central to district level. The state management agency in forestry at central level is the MARD. General Department of Forestry is under the Ministry to perform the function of advising and assisting the Minister of MARD in state management and performing the tasks of state management of forestry in the country.
Organizations assisting the General Director in performing state management functions are the Department of Forest Development, the Department of Forest Service Use, The Department of The Nature Conservancy; the Department of Forestry, the Inspection of Department, the CITES Management Authority of Vietnam. State management agencies at the provincial forestry are the Department of Agriculture and Rural Development, in which most of the provincial Department of Forestry, Forest Protection Department under the Department.
Agencies of state management of forest in the district are functional departments of agriculture and rural development with officials responsible for monitoring forest or part-time and ranger. Commune level (where many forests remain), may be responsible for forestry workers. Model agencies for forest management and forest land are shown in diagram 01

2.9. Some programs and project related to forestry
2.9.1. Five Million Hectare Reforestation Program
In 1992, Vietnam has been implementing the program 327, with the goal of "greening of barren hills." The program was then followed by a program with larger goals to protect and develop forests in Vietnam, namely Five Million Hectare Reforestation Program, also referred to as Project 661 (1998-2010).

I. THÔNG TIN CHUNG
1. Việt Nam và biến đổi khí hậu
Việt Nam nằm ở khu vực Đông Nam Á, có diện tích 330.991 km2, với địa hình phức tạp với đặc điểm có núi, cao nguyên, đồng bằng và sông ngòi, trong đó hai sông lớn nhất là sông Hồng và sông Cửu Long. Khí hậu nhiệt đới gió mùa, với nhiệt độ trung bình từ 24-27°C và lượng mưa trung bình 1.500-2.500mm, chủ yếu là vào mùa mưa từ tháng Năm đến tháng Mười.
Mật độ dân số Việt Nam cao nhất Đông Nam Á, lên tới 1.000 người trên km2 tại Đồng bằng Bắc Bộ (trung bình cả nước là 232 người/km2), mặc dù mật độ dân số tại những vùng núi thấp hơn rất nhiều. Khoảng 80% dân số sống tại các vùng nông thôn, và 75% lấy sản xuất nông nghiệp và lâm nghiệp là sinh kế chính.
Từ năm 1986, Chính phủ thực hiện chính sách phát triển kinh tế “Đổi Mới”, bao gồm một loạt các sửa đổi về chính sách và thể chế theo hướng mở cửa và xây dựng nền kinh tế thị trường định hướng xã hội chủ nghĩa . Chính sách này được xem là đã thúc đẩy phát triển kinh tế mạnh mẽ của đất nước với mức tăng trưởng GDP hàng năm từ những năm 1990 đến những năm đầu 2000 từ 6% đến 9% mỗi năm. Sau hơn một thập kỷ tăng trưởng mạnh mẽ, năm 2009, Việt Nam chính thức trở thành nước có thu nhập trung bình so với thế giới.
Tuy nhiên, với vị trí nằm ở khu vực nhiệt đới gió mùa Đông Nam Á, Việt Nam là một trong những quốc gia có nhiều khả năng chịu các tác động tiêu cực lớn nhất từ biến đổi khí hậu. Việt Nam đã trải qua những thay đổi của các yếu tố khí hậu cơ bản cũng như các hiện tượng thời tiết cực đoan như bão, mưa lớn và hạn hán. Nhiệt độ tăng 0,5 - 0,70C/50 năm, tần suất front lạnh giảm xuống 2,45 đợt/50 năm. Vùng ven biển phải gánh chịu các cơn bão nhiệt đới xuất phát từ biển Đông với trung bình khoảng 7 cơn bão/năm. Tần suất các xoáy thuận nhiệt đới cũng tăng lên 2,15 đợt/50 năm và mực nước biển tăng lên khoảng 20cm/50 năm. Đặc biệt, theo đánh giá của Ngân hàng thế giới, Việt Nam là một trong 5 quốc gia chịu ảnh hưởng lớn nhất của biến đổi khí hậu.
Các phân tích kịch bản biến đổi khí hậu chỉ ra rằng nhiệt độ trung bình của Việt Nam năm 2100 so với thời kỳ 1980-1999 có xu hướng tăng trong khoảng 1,1 – 1,90C và 2,1 – 3,60C, lượng mưa hàng năm tăng 1,6 – 14,6%, mực nước biển dâng khoảng 11,5 – 68cm. Trong số những tác động này, mực nước biển dâng với tốc độ 0,5 – 0,6cm/năm là tác động đáng lo ngại nhất, đặc biệt ở khu vực phía Nam Việt Nam.
Biến đổi khí hậu tác động mạnh đến các lĩnh vực nông nghiệp và tài nguyên nước. Ngập lụt và hạn hán xảy ra thường xuyên hơn do sự gia tăng cường độ mưa và giảm số ngày mưa. Đồng bằng sông Hồng và sông Cửu Long có thể sẽ bị xâm nhập mặn do nước biển dâng. Biến đổi khí hậu cũng sẽ dẫn tới gia tăng nguy cơ suy giảm đa dạng sinh học, đặc biệt là các loài thực vật bản địa và các loài có giá trị kinh tế cao. Nước biển dâng có thể làm giảm diện tích rừng ngập mặn, gây tác động bất lợi đối với các rừng tràm và rừng trồng trên đất phèn ở miền Nam, thay đổi phân bố rừng nguyên sinh và rừng thứ sinh. Đồng bằng sông Hồng, tỉnh Quảng Ninh, đồng bằng duyên hải Bắc Trung Bộ, Nam Trung Bộ và đồng bằng sông Cửu Long là những khu vực dễ bị tổn thương nhất.
2. REDD và tầm quan trọng của khung pháp lý về REDD
1/6 khí thải dẫn đến hiệu kính nhà kính là do việc mất rừng và suy thoái rừng. Lượng khí thải này còn nhiều hơn toàn bộ lượng khí thải do giao thông gây ra. Do đó, giải pháp được đưa ra là phải bảo tồn rừng mà một trong những phương thức hiệu quả nhất là có thể dựa trên việc định giá kinh tế rừng và sử đụng đất hợp lý. Đơn giản hơn, việc giữ rừng hay phá rừng chịu ảnh hưởng rất nhiều bởi giá rừng.
Đó là lý do vì sao giảm phát thải từ nỗ lực giảm phá rừng và suy thoái rừng (REDD) đã được đưa vào trong chương trình nghị sự của Công ước khung về Biến đổi Khí hậu của Liên Hợp Quốc (UNFCCC) – Hội nghị các bên liên quan (COP) 11 từ năm 2005 và một khái niệm mở, “REDD ” được lồng ghép để tăng cường trữ lượng các bon lâm nghiệp hiện có, trong Kế hoạch Hành động Bali tại COP13 năm 2007. Việc công nhận tầm quan trọng của bảo tồn rừng đối với giảm thiểu biến đổi khí hậu là một trong những nội dung của thỏa thuận tại COP15 ở Copenhagen.
Hiện nay, REDD được coi là một phương pháp tiềm năng quan trọng để giảm phát thải các bon đồng thời bảo vệ quyền lợi của người dân bản địa. , REDD nhằm mục tiêu bảo vệ các cánh rừng nguyên sinh, khôi phục các khu rừng đã bị suy thoái, hỗ trợ các phương án thay thế cho khai thác gỗ công nghiệp mang lại lợi ích phát triển bền vững và lâu dài đảm bảo khả năng phục hồi của hệ sinh thái. Đồng thời, REDD hỗ trợ phát triển cho các cộng đồng địa phương có vai trò giảm thiểu áp lực lên những khu rừng nguyên sinh còn lại bằng cách xây dựng nền tảng vững chắc cho quản lý hiệu quả.
Tuy nhiên, để thực hiện thành công các chương trình hay mô hình REDD , trước hết cần có “thiết kế”, khuôn khổ phù hợp và hiệu quả. Thiết kế và khuôn khổ này cần phải được luật hóa ở cấp quốc gia để đảm bảo hiệu lực thực thi và hiệu quả của chương trình REDD cũng như REDD .
Để chuẩn bị cho một quốc gia tham gia REDD, World Bank đã thiết kế Kế hoạch Chuẩn bị sẵn sàng thực thi (RPP) để tổ chức thực hiện REDD ở quốc gia đó. Theo đó, điều cần thiết là phải hiểu các thay đổi về sử dụng đất, các chính sách và định hướng về rừng để xác định phạm vi và các tác nhân tiềm ẩn gây mất rừng, suy giảm rừng ở quốc gia đó. Từ đó các quốc gia sẽ soạn thảo các chiến lược tương ứng để đối phó với các tác nhân ấy.
Các chiến lược cũng như cơ chế thực hiện REDD hiện nay chưa được hoàn thiện, và có những phần còn hoàn toàn chưa được luật hóa ở Việt Nam. Do vậy, một khung pháp lý, thể chế, chiến lược cho việc thực hiện REDD cần được ưu tiên thiết lập để đảm bảo sự thành công của REDD trong việc thực hiện mục tiêu cắt giảm phát thải đồng thời thúc đẩy phát triển bền vững.
Đặc biệt, REDD và REDD là những khái niệm còn rất mới ở Việt Nam. Khung pháp lý cũng như kinh nghiệm thực tiễn đối với vấn đề này còn rất ít ỏi và chưa hoàn thiện. Việt Nam đang trong quá trình định hướng và xác định các rào cản trong việc thực hiện có hiệu quả REDD , trong đó thách thức về cải tiến luật pháp và chính sách là rào cản rất lớn đối với việc thúc đẩy phát triển và đạt mục tiêu xóa đói giảm nghèo bằng cách chuyển đổi sang nền kinh tế carbon thấp. Khả năng thực hiện thành công REDD phụ thuộc trước hết vào khả năng đảm bảo các thực hiện các công cụ pháp lý cũng như năng lực về pháp lý và thể chế của quốc gia.
Với lý do như vậy, chương trình UN-REDD, IDLO và Văn phòng pháp lý FAO đã khởi động dự án "Xây dựng khung pháp luật REDD " . Dự án bao gồm hai giai đoạn. Trong giai đoạn đầu tiên, các nghiên cứu sẽ được tiến hành trong ba quốc gia (Mexico, Việt Nam và Zambia) để xác định và phân tích các rào cản pháp lý cho việc thực hiện REDD thông qua tham vấn với các chuyên gia quốc gia và các bên liên quan. Một báo cáo tóm tắt nêu bật các vấn đề xuyên suốt và các khuyến nghị để xây dựng hệ thống pháp lý cho REDD cũng sẽ được chuẩn bị. Giai đoạn thứ hai sẽ thảo luận và hoàn thiện các kết quả của giai đoạn 1, bao gồm cả báo cáo tóm tắt, thông qua một hội nghị chuyên gia vào đầu tháng 11 năm 2011. Các khuyến nghị đưa ra sau khi thống nhất kết quả nghiên cứu và hội nghị chuyên gia sẽ được trình bày trong một sự kiện bên lề tại UNFCCC 2011 ở Durban.
3. Tình hình phát triển rừng Việt Nam
Diện tích rừng, loại rừng, và xu hướng
Diên tích đất được xếp loại “đất lâm nghiệp” là 19,2 triệu héc ta, nhưng trong đó chỉ 13,1 triệu héc ta là có rừng (số liệu 2008), phần còn lại bao gồm các sườn núi trọc và đất trống. Trong số đất lâm nghiệp, 10,3 triệu héc ta là rừng tự nhiên, và 2,8 triệu héc ta là rừng trồng. Việc sử dụng đất lâm nghiệp được phân thành ba loại mục, đó là rừng đặc dụng (hầu hết là các khu vực được bảo vệ), 2,2 triệu héc ta; rừng phòng hộ, 5,7 triệu héc ta; và rừng sản xuất, 8,3 triệu héc ta. Rừng được phân bố không đều khắp Việt Nam, từ 5% diện tích đất tại các đồng bằng Bắc bộ và sông Cửu Long, đến 35% tại Bắc Trung Bộ, và các khu vực duyên hải Nam trung bộ, và 56% tại Tây Nguyên. Các loại rừng khá đa dạng, bao gồm rừng lá kim, rừng lá rộng, rừng tùng bách hỗn hợp, rừng dipterocarp ẩm và khô tại các vùng cao; và rừng dipterocarp vùng đất thấp, rừng ngập mặn, tre, và hỗn hợp các loại cây gỗ và tre tại các vùng thấp hơn, đồng bằng, và vùng ngập nước. Chất lượng rừng cũng khác biệt đáng kể.
Quá trình thay đổi diện tích rừng tại Việt Nam rất ấn tượng. Trong giai đoạn từ 1943 đến 1983 khoảng 50% rừng bị chặt phá suốt bốn thập kỷ do khai thác mạnh. Diện tích che phủ rừng xuống mức thấp nhất khoảng 27% khoảng năm 1990. Tuy nhiên, từ 1990 đến 2000, Việt Nam đã tăng được 236.200 héc ta rừng mỗi năm, tương đương lượng tăng 2,5% một năm. Từ 2000 đến 2005, tỉ lệ tăng là 2,1% một năm. Việc này dẫn tới tăng trưởng tỉ lệ che phủ rừng lên 38,3%, hay khoảng 3.568.000 héc ta vào năm 2008.
Các con số trên cho thấy Việt nam đã tiến sang phía bên phải của đồ thị biến thiên rừng (xem Hình 1.3), với diện tích rừng đang tăng lên. Tuy nhiêu, các số liệu quốc gia không thể hiện sự khác biệt lớn trong tình trạng tại các khu vực khác nhau trong nước. Tại Tây Nguyên, việc mất rừng (và suy thoái rừng) tiếp tục là yếu tố chính trong việc thay đổi mục đích sử dụng đất. Tại các vùng khác, ví dụ, Bắc trung bộ, việc mất rừng cũng tiếp diễn, nhưng với tốc độ thấp hơn nhiều – có thể coi như đã đạt được một diện tích rừng ổn định.

Nguyên nhân chính gây ra mất rừng và suy thoái rừng
Kết quả của các nghiên cứu khoa học và Chương trình Điều tra, theo dõi và đánh giá diễn biến tài nguyên rừng toàn quốc từ năm 1991 đến nay đã chỉ ra một số nguyên nhân chủ yếu dẫn đến sự biến động diện tích và chất lượng rừng ở Việt Nam:
- Do chuyển đổi rừng sang đất canh tác nông nghiệp. Đây được coi là một trong những nguyên nhân chủ yếu dẫn đến mất rừng.
- Do tập quán canh tác lạc hậu, du canh, du cư và phụ thuộc nặng nề vào tài nguyên rừng để sinh tồn. Bên cạnh đó, việc di dân từ vùng đồng bằng lên các vùng cao và từ miền núi phía bắc vào Tây Nguyên đã góp phần vào tỷ lệ tăng dân số và tạo áp lực lên những diện tích rừng hiện có.
- Do chưa có biện pháp quản lý và khai thác rừng hợp lý, nạn khai thác gỗ lậu vẫn xảy ra ở nhiều địa phương. Hệ thống pháp lý chưa hoàn thiện, năng lực thực thi pháp luật còn hạn chế, thiếu sự phối hợp giữa các cơ quan thực thi pháp luật. Quá trình giao đất, giao rừng cùng với việc cấp giấy chứng nhận quyền sử dụng đất chậm, quyền sử dụng rừng chưa rõ ràng.
- Do nhu cầu phát triển kinh tế, xã hội như: xây dựng hệ thống thủy lợi, thủy điện, hệ thống đường giao thông, bố trí tái định cư, xây dựng các khu công nghiệp, khai thác khoáng sản, vv...
- Do nhu cầu cung cấp nguyên liệu cho công nghiệp chế biến, xuất khẩu gỗ và lâm sản.
Chính phủ Việt Nam nhận thức rất rõ các nguyên nhân gây ra mất rừng và suy thoái rừng và đã có rất nhiều nỗ lực để giải quyết vấn đề này và đã đạt được những kết quả được quốc tế đánh giá cao.
Tuy nhiên, sự đầu tư của Nhà nước không phải là vô hạn. Do đó cần phải đẩy mạnh công tác xã hội hóa việc bảo vệ và phát triển rừng thông qua việc thiết lập một cơ chế tài chính mới và bền vững dựa vào chính sách chi trả dịch vụ môi trường rừng. Bên cạnh đó, việc quản lý bảo vệ rừng bền vững cũng góp phần đem lại những lợi ích cho khu vực và toàn cầu (ví dụ: hạn chế biến đổi khí hậu, bảo tồn đa dạng sinh học, vv...). Do vậy, cộng đồng quốc tế cũng phải có trách nhiệm hỗ trợ Chính phủ Việt Nam.
Tuy nhiên, hiện nay giá trị của rừng vẫn chưa được tính toán một cách đầy đủ và người dân vẫn chưa yên tâm sống bằng nghề rừng cũng như tích cực tham gia quản lý và sử dụng rừng bền vững. Hệ quả tất yếu là áp lực lên tài nguyên rừng hiện có ngày càng tăng, hiện tượng mất rừng và suy thoái rừng vẫn còn tiếp diễn ở nhiều nơi. Nếu giá trị của rừng được đánh giá và được lượng hóa một cách đầy đủ (cả giá trị về gỗ, lâm sản ngoài gỗ và giá trị bảo vệ môi trường, vv...) thì đó sẽ là cơ sở quan trọng để so sánh giữa lợi ích của việc bảo vệ và phát triển rừng với lợi nhuận thu được từ các hoạt động chuyển đổi rừng sang các mục đích sử dụng khác. Đó cũng là căn cứ để xây dựng một chính sách khuyến khích đủ mạnh để ngăn chặn mất rừng và suy thoái rừng. Tuy nhiên, việc định giá rừng (đặc biệt là lượng hóa giá trị của rừng đối với việc hấp thụ các-bon và giảm phát thải khí nhà kính) và tính toán chi phí cơ hội của các hoạt động sử dụng tài nguyên khác nhau ở Việt Nam cũng như việc tìm kiếm thị trường còn gặp nhiều khó khăn.
II. CƠ HỘI CHO REDD TẠI VIỆT NAM
Theo số liệu thống kê của Bộ Nông nghiệp & PTNT, tính đến tháng 12 năm 2007, diện tích rừng tự nhiên của Việt Nam là 10,28 triệu hécta (tương đương với 31% tổng diện tích tự nhiên). Mặc dù trong những năm vừa qua độ che phủ của rừng có tăng (từ 28% năm 1993 lên 38,7% năm 2008), tình trạng mất rừng và suy thoái rừng vẫn tiếp diễn, đặc biệt là ở Đông Nam Bộ và Tây Nguyên. Rừng nước ta có tính đa dạng sinh học cao, là nơi hội tụ của các luồng động, thực vật từ Đông sang Tây và từ Bắc xuống Nam. Như vậy, xét theo 3 tiêu chí của Quỹ Đối tác Các-bon trong lâm nghiệp (FCPF): diện tích rừng tự nhiên hiện có, đa dạng sinh học và diễn biến tài nguyên rừng thì Việt Nam đủ tiêu chuẩn được lựa chọn là nước thí điểm tham gia thực hiện REDD.
Việt Nam đã tham gia Công ước khung của LHQ về BĐKH (UNFCCC) vào tháng 11/1994 và phê chuẩn Nghị định thư Kyoto vào tháng 9/2002 nên chúng ta có đầy đủ cơ sở pháp lý và tiêu chí quốc tế để tham gia REDD.
Ở Việt Nam, Đảng và Nhà nước rất quan tâm đến bảo vệ và phát triển rừng, gắn liền với phát triển kinh tế - xã hội và xóa đói giảm nghèo ở vùng nông thôn miền núi. Luật Bảo vệ và Phát triển rừng (2004), Luật Bảo vệ Môi trường (2005) và Luật Đa dạng sinh học (2008) đều có quy định về nhiệm vụ bảo vệ và phát triển rừng. Quản lý rừng bền vững là một trong năm Chương trình trọng yếu của Chiến lược phát triển lâm nghiệp quốc gia giai đoạn 2006-2010 và tầm nhìn đến năm 2020 đã được Thủ tướng Chính phủ phê duyệt.
Bảo vệ và phát triển rừng bền vững cũng là một nội dung quan trọng trong Khung Kế hoạch ứng phó với biến đổi khí hậu của Bộ Nông nghiệp và PTNT (Quyết định số 2730/QĐ-BNN-KHCN ngày 5/9/2008) và Chương trình Mục tiêu quốc gia ứng phó với biến đổi khí hậu (tại Quyết định số 158/2008/QĐ-TTg ngày 2/12/2008).
Tại Quyết định 158/2008/QĐ-TTg, Thủ tướng Chính phủ nêu rõ cần phải huy động các nguồn lực để thực hiện Chương trình Mục tiêu quốc gia ứng phó với biến đổi khí hậu, trong đó sự tài trợ của cộng đồng quốc tế là hết sức quan trọng. Hấp thụ carbon được coi là một dịch vụ môi trường do rừng đem lại, do vậy thực hiện REDD sẽ góp phần hoàn thiện Chính sách chi trả dịch vụ môi trường rừng theo Quyết định số 380/QĐ-TTg của Thủ tướng Chính phủ.
Việt Nam có lợi thế là chúng ta có hệ thống quản lý nhà nước chuyên ngành lâm nghiệp thống nhất từ Trung ương đến địa phương tạo điều kiện thuận lợi cho việc triển khai REDD. REDD hứa hẹn là một cơ chế tài chính hiệu quả để thực hiện các chủ trương, đường lối này. Để thực hiện thành công REDD, các quốc gia nghèo có rừng phải thực hiện các chính sách để giảm và thậm chí xóa bỏ tình trạng chặt rừng và suy thoái rừng đồng thời thực hiện các chính sách làm tăng trữ lượng cácbon hiện có. Những quốc gia thực hiện những chính sách này sẽ được “thưởng” tài chính từ chính phủ hoặc khu vực kinh doanh của các nước phát triển, những nước cần bồi hoàn lượng phát thải họ tạo ra. Khái niệm rất đơn giản nhưng thực tế cho thấy việc thực hiện khái niệm này dường như khó khăn hơn nhiều. Nhiều tổ chức đang nghiên cứu các rào cản kỹ thuật, chính sách và tài chính để thực hiện thành công khái niệm này. Ví dụ, Hiệp hội Bảo tồn Thiên nhiên Quốc tế (IUCN) đã tập trung vào các điều kiện tiên quyết mang tính pháp lý về thực hiện REDD công bằng và hiệu quả trong khi đó Trung tâm Rừng và Con người trong khu vực (RECOFTC) ở Băng Cốc thì nghiên cứu về phạm vi, quy mô của sự tham gia của cộng đồng vào REDD .
Được thành lập năm 2008 và chủ yếu là đo chính phủ Na Uy tài trợ, Chương trình UN-REDD (http://www.un-redd.org/) giúp các quốc gia đang phát triển, bao gồm Việt Nam, sẵn sàng tham gia vào cơ chế REDD trong tương lai. Trong những vấn đề liên quan đến REDD cần phải thực hiện, chính phủ Việt Nam đã xác định việc thiết kế một hệ thống phân chia lợi ích minh bạch và công bằng (BDS) là một nội dung ưu tiên.
Đối với Việt Nam, việc bảo vệ rừng càng có ý nghĩa quan trọng đối với sự phát triển bền vững của quốc gia. Theo thống kê chính thức, Việt Nam đã mất khoảng một nửa diện tích rừng che phủ trong khoảng thời gian từ năm 1943 tới 1990. Kể từ đó, Việt Nam duy trì xu hướng phát triển tất cả các kiểu rừng vào khoảng 2% mỗi năm. Tuy nhiên, ngay cả khi tỷ lệ rừng che phủ đã tăng, chất lượng rừng vẫn không ngừng suy thoái. Trong khi đó, những khu rừng có diện tích giảm rõ rệt và bị suy thoái nghiêm trọng lại là những khu rừng chứa nhiều carbon nhất. Trong khi đó, ước tính hiện có khoảng 25 triệu người (chiếm 28% dân số của cả nước) đang sống ở vùng rừng núi, vùng sâu và vùng xa. Phần lớn họ là đồng bào dân tộc thiểu số, cuộc sống còn nghèo, khó khăn và phụ thuộc nhiều vào rừng. Cũng vì vậy mà ngành lâm nghiệp còn có vai trò quan trọng trong cải thiện đời sống và xoá đói giảm nghèo cho người dân vùng miền núi và nông thôn .
Nhận thức được tầm quan trọng của rừng đối với ứng phó với biến đổi khí hậu và phát triển bền vững, Việt Nam đã thể hiện sự quan tâm và nhiệt tình đối với việc thực hiện REDD . Việt Nam là một trong 9 nước được Chương trình Giảm phát thải nhà kính từ mất rừng và suy thoái rừng ở các nước phát triển của Liên hiệp quốc (UN-REDD) lựa chọn thực hiện dự án thí điểm và là quốc gia đầu tiên trên thế giới đưa ra Chương trình REDD quốc gia. Chính phủ Việt Nam cũng coi việc thực hiện REDD là một trong những nhiệm vụ trọng tâm của Chương trình mục tiêu quốc gia về ứng phó với biến đổi khí hậu.
Hiện nay, Bộ Tài nguyên và Môi trường (TN&MT) là cơ quan Nhà nước chuyên trách những hoạt động ứng phó với biến đổi khí hậu ở Việt Nam, nhưng Cục Lâm nghiệp thuộc Bộ Nông nghiệp và Phát triển Nông thôn (NN&PTNT) lại là cơ quan chỉ đạo chiến lược phát triển REDD, thông qua Ban chỉ đạo Quốc gia Ứng phó với Biến đổi Khí hậu. Chính phủ công nhận REDD là một vấn đề xuyên quốc gia và liên ngành, cần “sự tham gia rộng khắp và tích cực của các bên liên quan”.
Việt Nam có điều kiện phù hợp để xây dựng Hệ thống phân bổ lợi ích theo cơ chế REDD vì đã có nhiều năm kinh nghiệm với các hệ thống tương tự như Chương trình 661 (được biết đến như chương trình trồng 5 triệu ha rừng) trong đó trả tiền cho các hộ gia đình tham gia bảo vệ rừng và các dự án thí điểm thực hiện chi trả dịch vụ môi trường rừng (PFES) do các tổ chức quốc tế hỗ trợ. Trọng tâm của Hệ thống phân bổ lợi ích cũng nhằm đẩy mạnh chức năng quản lý của Việt Nam, đảm bảo ổn định xã hội và đảm bảo quyền hưởng dụng đất ở mức độ tương đối cao. Đó là những lợi thế mà Việt Nam có thể sử dụng để đạt được khả năng cạnh tranh cao trong cơ chế REDD trên trường quốc tế trong tương lai. Việt Nam cũng có diện tích lớn rừng bị suy thoái và nếu được tái sinh tự nhiên thì có thể nhanh chóng hấp thụ các bon, bảo tồn đất và nước. (Thực tế, 1,2 triệu trong tổng số 16 triệu ha rừng Việt Nam được phân loại là đất “chưa có rừng” hoặc “chưa thành rừng”.)
Nghiên cứu Hệ thống phân bổ lợi ích theo cơ chế REDD ở Việt Nam do Tổ chức Bảo tồn thiên nhiên quốc tế IUCN phối hợp với Bộ NN&PTNT tiến hành năm 2010 đã đưa ra một số kết luận : , REDD could generate about $80-100 million/year in Vietnam However, this potential can only be realized if government takes steps to ensure that REDD is implemented effectively. This involves: developing a comprehensive REDD strategy to generate and sustain emissions reductions at the local level; developing the necessary capacity to measure and report on emissions reductions; and putting in place a BDS that meets the requirements of international investors and the needs of forest managers.
Có thể nói cơ hội cho việc phát triển và thực hiện REDD ở Việt Nam là rất lớn, từ điều kiện kinh tế - xã hội – môi trường hiện tại, cũng như định hướng của chính phủ. Bên cạnh đó, lợi ích của việc thực hiện REDD mang lại cho Việt Nam cũng được đánh giá là rất lớn. Tuy nhiên, việc thực hiện REDD có thành công hay không, như trên đã nói, phụ thuộc chủ yếu vào việc thiết lập khung pháp lý và cơ chế, thể chế thực thi hiệu quả hay không.
III. THỰC TRẠNG CHÍNH SÁCH, PHÁP LUẬT LIÊN QUAN ĐẾN REDD Ở VIỆT NAM
Ở cấp quốc tế, Việt Nam đã ký kết và tham gia Công ước Khung của Liên hợp quốc về biến đổi khí hậu (UNFCCC), Nghị định thư Kyoto, và Công ước của Liên hợp quốc về Đa dạng sinh học (CBD). Việt Nam cũng áp dụng “Công cụ không mang tính ràng buộc pháp l. về tất cả các loại rừng” của Diễn đàn Liên hợp quốc về lâm nghiệp (UNFF). Ngoài ra, ở cấp khu vực, năm 2009, Việt Nam đã áp dụng Khung hành động đa ngành của ASEAN về Biến đổi khí hậu, Nông nghiệp và Lâm nghiệp hướng tới An ninh lương thực, trong đó có các yếu tố REDD .
Ở cấp độ quốc gia, Việt Nam đã có ban hành và thực hiện hiệu quả một số văn bản luật và chính sách về biến đổi khí hậu, trong đó có bảo vệ và phát triển rừng, tạo tiền đề và hỗ trợ cho việc thực hiện REDD . Báo cáo này sẽ tập trung phân tích các văn bản luật, chính sách liên quan đến REDD tại Việt Nam ở cấp độ quốc gia.
Trong khuôn khổ hệ thống pháp luật của Việt Nam, REDD chủ yếu chịu sự điều chỉnh trực tiếp của chính sách, pháp luật về đất đai, bảo vệ và phát triển rừng, bảo vệ môi trường, bảo tồn đa dạng sinh học….đặc biệt là chính sách, pháp luật về bảo vệ và phát triển rừng. Ngoài ra, trong quá trình triển khai REDD , còn chịu sự điều chỉnh của các chính sách, pháp luật khác, như: tài chính, xử lý vi phạm hành chính, khiếu nại tố cáo…Các lĩnh vực chính sách, pháp luật này luôn tồn tại mối quan hệ tương hỗ trong cùng một hệ thống pháp luật.
1. Chương trình UN-REDD
Như trên đã đề cập, Việt Nam đã tham gia Công ước khung của LHQ về BĐKH (UNFCCC) vào tháng 11/1994 và phê chuẩn Nghị định thư Kyoto vào tháng 9/2002. Đây chính là nền tảng pháp lý cơ bản nhất để Việt Nam xây dựng khung pháp luật và thực hiện REDD .
Việt Nam cũng là một trong 9 nước được Chương trình Giảm phát thải nhà kính từ mất rừng và suy thoái rừng ở các nước phát triển của Liên hiệp quốc (UN-REDD) lựa chọn thực hiện dự án thí điểm và là quốc gia đầu tiên trên thế giới đưa ra Chương trình REDD quốc gia. Chính phủ Việt Nam cũng coi việc thực hiện REDD là một trong những nhiệm vụ trọng tâm của Chương trình mục tiêu quốc gia về ứng phó với biến đổi khí hậu,
Chương trình UN-REDD được thành lập năm 2008 và chủ yếu là do chính phủ Na Uy tài trợ, nhằm mục tiêu giúp các quốc gia đang phát triển, bao gồm Việt Nam, sẵn sàng tham gia vào cơ chế REDD trong tương lai. Đây cũng hiện là chương trình có quy mô lớn nhất ở Việt Nam về REDD .
Hiện nay, Bộ Tài nguyên và Môi trường (TN&MT) là cơ quan Nhà nước chuyên trách những hoạt động ứng phó với biến đổi khí hậu ở Việt Nam, nhưng Cục Lâm nghiệp thuộc Bộ Nông nghiệp và Phát triển Nông thôn (NN&PTNT) lại là cơ quan chỉ đạo chiến lược phát triển REDD, thông qua Ban chỉ đạo Quốc gia Ứng phó với Biến đổi Khí hậu.
Mục tiêu của Chương trình UN-REDD Việt Nam là hỗ trợ Chính phủ Việt Nam trong việc phát triển một cơ chế thực hiện hiệu quả REDD tại Việt Nam và góp phần giảm lượng phát thải ở quy mô khu vực. Điều này sẽ góp phần vào các mục tiêu rộng lớn hơn để đảm bảo rằng đến cuối năm 2012, cơ chế cho REDD của Việt Nam đã sẵn sàng và có thể góp phần làm giảm phát thải từ phá rừng và suy thoái rừng quốc gia và khu vực.
Chương trình UN-REDD Việt Nam tìm cách giải quyết nạn phá rừng và suy thoái rừng thông qua xây dựng năng lực ở cấp quốc gia và địa phương. Thứ nhất, nó sẽ xây dựng năng lực ở cấp quốc gia cho phép Chính phủ Việt Nam, và đặc biệt là cơ quan là đầu mối về REDD trong Cục Lâm nghiệp (DoF) (Bộ Nông nghiệp và Phát triển nông thôn), phối hợp và quản lý quá trình thành lập các công cụ để thực hiện một chương trình REDD. Thứ hai, nó sẽ xây dựng năng lực ở cấp địa phương (tỉnh, huyện và xã) thông qua các mô hình thí điểm ở hai huyện trên địa bàn tỉnh Lâm Đồng để xác định cách tiếp cận hiệu quả để lập kế hoạch và các biện pháp thực hiện để giảm khí thải từ phá rừng và suy thoái rừng. Chương trình cũng nhằm tìm kiếm sự hợp tác giữa các nước trong lực vực sông Mekong trong việc phối hợp giảm phát thải ở khu vực này.
Quá trình thực thi REDD được chia thành 2 giai đoạn, giai đoạn 1 (2008-2012) - Nâng cao năng lực ở các cấp và các bên có liên quan trong việc thực thi REDD đồng thời tiến hành các dự án thử nghiệm, giai đoạn 2 (sau 2012) - Triển khai REDD (nếu REDD chính thức trở thành một cơ chế tài chính trong các Thỏa thuận quốc tế về biến đổi khí hậu).
Theo Nghị định số 01/2008/NĐ-CP của Chính phủ về chức năng, quyền hạn, nhiệm vụ và tổ chức bộ máy của Bộ Nông nghiệp và PTNT và Chương trình Mục tiêu quốc gia ứng phó với biến đổi khí hậu, Bộ Nông nghiệp và PTNT là cơ quan quản lý nhà nước về lĩnh vực nông nghiệp và phát triển nông thôn trong đó có ngành lâm nghiệp - là cơ quan chủ trì, phối hợp với Bộ Tài nguyên và Môi trường (cơ quan đầu mối quốc gia thực thi UNFCCC) và các Bộ, ngành, địa phương nghiên cứu triển khai REDD ở Việt Nam. Bộ Nông nghiệp và PTNT đã giao cho Cục Lâm nghiệp là cơ quan chủ trì, phối hợp với các đơn vị trong và ngoài Bộ, các tổ chức quốc tế xây dựng và triển khai REDD.
Thực hiện Quyết định số 2 của Hội nghị lần thứ 13 các bên tham gia UNFCCC (COP13), tháng 02/2008 Việt Nam đã gửi tới Ban Thư ký của Công ước tài liệu nêu quan điểm về phương pháp cũng như lộ trình thực hiện REDD, trong đó có đề xuất các hoạt động cần sự hỗ trợ về tài chính và kỹ thuật của cộng đồng quốc tế.
Bên cạnh đó, Tiểu ban Hạn chế Biến đổi Khí hậu và REDD, với những người tham gia cả trong và ngoài chính phủ đã lập Ý tưởng Kế hoạch (R-PIN) trong Quỹ Đối tác Các-bon Lâm nghiệp (FCPF) ở Việt Nam với vai trò là cơ quan chịu trách nhiệm phát triển những chính sách và chương trình của REDD, đồng thời thiết lập một quy trình tham vấn.
Việc thành lập Ban Chỉ đạo Quốc gia Ứng phó với Biến đổi Khí hậu gồm cả Bộ NN&PTNT, Bộ TN&MT và những bộ khác do Thủ tướng chủ trì, cho thấy vấn đề hợp tác giữa các bộ ngành đã được đồng tình. Tuy nhiên, trên thực tế việc phân trách trong những hoạt động đối phó với biến đổi khí hậu có thể khiến cho hoạt động hợp tác trở nên khó khăn.
Chương trình UN-REDD được triển khai chính thức tại Việt Nam – quốc gia duy nhất của Đông Nam Á được chọn để triển khai UN-REDD từ tháng 9/2009 với kinh phí gần 4,4 triệu USD - do Chính phủ Na Uy tài trợ. Hai huyện Lâm Hà và Lạc Dương của tỉnh Lâm Đồng được lựa chọn để thí điểm triển khai bằng việc tham vấn người dân. UN-REDD cũng tiến hành các hoạt động nâng cao kỹ năng chuyên môn về theo dõi và đánh giá trữ lượng cácbon của rừng và nhận thức về REDD cho người dân của hai huyện này.
Sau 18 tháng, các nội dung cụ thể đã được hoàn tất bao gồm việc xây dựng cơ chế điều phối giữa các bộ, ngành và tổ chức liên quan; xây dựng mạng lưới REDD; thành lập tổ công tác kỹ thuật; xây dựng chương trình chiến lược quốc gia; thực hiện cơ chế tham vấn cộng đồng (FPIC) tại một số tỉnh; nâng cao nhận năng lực, nhận thức thông qua việc tổ chức hội thảo, tập huấn; thực hiện các nghiên cứu kỹ thuật như xây dựng cơ sở dữ liệu về rừng ...
Sau thành công ban đầu của Chương trình giảm phát thải khí nhà kính thông qua nỗ lực hạn chế mất rừng và suy thoái rừng của Liên Hợp Quốc (UN-REDD) tại Việt Nam, Mạng lưới quốc gia về REDD tiếp tục lập đề xuất chương trình UN-REDD pha 2, với tổng kinh phí thực hiện 100 triệu USD. Mục tiêu tổng quát của chương trình UN-REDD Việt Nam pha 2 là quản lý tài nguyên rừng bền vững hướng tới mục đích giảm thiểu phát thải khí nhà kính do phá rừng và suy thoái rừng.
Hoạt động chính của UN-REDD pha 2 là vận hành chương trình chiến lược REDD quốc gia, các cơ chế điều phối, đo đạc carbon có sự tham gia, chia sẻ lợi ích công bằng từ REDD…thử nghiệm tại 6 tỉnh có độ che phủ rừng lớn là Bắc Kạn, Bình Thuận, Cà Mau, Hà Tĩnh, Lâm Đồng, Lâm Đồng và Lào Cai. Không dừng lại ở REDD, Việt Nam tiếp tục hướng tới việc thực hiện sáng kiến REDD với các nội dung liên quan đến bảo tồn thiên nhiên và đa dạng sinh học cũng được tính đến.
Nhằm phục vụ cho việc chỉ đạo, xây dựng và triển khai chương trình REDD và REDD tại Việt Nam, ngày 07/01/2011, Bộ trưởng Bộ Nông nghiệp và Phát triển Nông thôn đã ký Quyết định 37/2011/QĐ-BNN-TCCB thành lập Ban chỉ đạo thực hiện sáng kiến REDD do Bộ trưởng Bộ NN-PTNT Cao Đức Phát đứng đầu.
Việc triển khai các hoạt động trong UN-REDD Việt Nam pha 1 và pha 2 nhằm đảm bảo Việt Nam sẵn sàng thực thi REDD vào cuối năm 2012. Việc thực thi REDD là một nội dung trong chiến lược phát triển rừng quốc gia. Một số nội dung khác trong chiến lược phát triển rừng như Tăng cường thực thi luật pháp,quản trị và thương mại lâm sản, Chi trả dịch vụ môi trường rừng (PES)... cũng sẽ có tương tác và hỗ trợ cho việc thực thi REDD.
Do REDD là vấn đề tương đối mới mẻ và còn đang tiếp tục được thảo luận trong các cuộc đàm phán quốc tế, nên các chương trình, chính sách, văn bản pháp luật cũng như các kế hoạch phát triển kinh tế xã hội của Việt Nam chưa đề cập nhiều và cụ thể về REDD . Tháng 10/2010, Bộ NN&PTNT đã bắt đầu đưa nội dung về REDD vào Kế hoạch Quốc gia về Bảo vệ và Phát triển rừng 2011-2020. Kế hoạch này dự kiến sẽ được trình Thủ tướng vào Quý 3/2011.
2. Chính sách, pháp luật về đất đai, bảo vệ và phát triển rừng
Ở Việt Nam, có 2 luật chuyên ngành điều chỉnh rừng và đất lâm nghiệp. Luật Đất đai năm 2003 điều chỉnh các quan hệ liên quan đến đất lâm nghiệp. Luật Bảo vệ và phát triển rừng năm 2004 điều chỉnh các quan hệ liên quan đến rừng - với tư cách là tài nguyên, tài sản trên đất lâm nghiệp và có thể tóm tắt như sau:
2.1. Khái niệm về rừng
- Luật Bảo vệ và Phát triển rừng năm 2004 là văn bản có hiệu lực pháp lý cao nhất quy định về quản lý, bảo vệ, phát triển, sử dụng rừng cũng như các quyền và nghĩa vụ của chủ rừng. Luật này quy định, “Rừng là một hệ sinh thái bao gồm quần thể thực vật rừng, động vật rừng, vi sinh vật rừng, đất rừng và các yếu tố môi trường khác, trong đó cây gỗ, tre nứa hoặc hệ thực vật đặc trưng là thành phần chính có độ che phủ của tán rừng từ 0,1 trở lên. Rừng gồm rừng trồng và rừng tự nhiên trên đất rừng sản xuất, đất rừng phòng hộ, đất rừng đặc dụng”. (Khoản 1 Điều 3).
Trong quá trình triển khai vào thực tiễn, Bộ Nông nghiệp và PTNT đã hướng dẫn cụ thể về tiêu chí xác định về Rừng tại Thông tư số 34/2009/TT-BNNPTNT ngày 10 /06.2009. Theo đó, một đối tượng được xác định là rừng nếu đạt được cả 3 tiêu chí sau đây:
Là một hệ sinh thái, trong đó thành phần chính là các loài cây lâu năm, thân gỗ, cau dừa có chiều cao vút ngọn từ 5, 0 mét trở lên (trừ rừng mới trồng và một số loài cây rừng ngập mặn ven biển), tre nứa,…có khả năng cung cấp gỗ, lâm sản ngoài gỗ và các giá trị trực tiếp và gián tiếp khác, như bảo tồn đa dạng sinh học, bảo vệ môi trường và cảnh quan.
Rừng mới trồng các loài cây thân gỗ và rừng mới tái sinh sau khai thác rừng trồng có chiều cao trung bình trên 1,5 m đối với loài cây sinh trưởng chậm, trên 3,0 m đối với loài cây sinh trưởng nhanh và mật độ từ 1.000 cây/ha trở lên được coi là rừng.
- Độ tàn che của tán cây là thành phần chính của rừng phải từ 0, 1 trở lên.
- Diện tích liền khoảnh tối thiểu từ 0, 5 ha trở lên, nếu là dải cây rừng phải có chiều rộng tối thiểu 20 mét và có từ 3 hàng cây trở lên.
Tuy nhiên, trong luật cũng như các văn bản hướng dẫn chưa có định nghĩa về suy thoái rừng.
2.2. Phân loại rừng
- Phân chia lâm phận quốc gia thành 3 loại rừng theo mục đích sử dụng, gồm: rừng đặc dụng, phòng hộ, sản xuất, từ đó Nhà nước quy định chế độ quản lý, sử dụng phù hợp với mục đích của từng loại rừng.
- Phân loại rừng theo nguồn gốc hình thành (rừng tự nhiên, rừng trồng); theo điều kiện lập địa (rừng núi đất, rừng ngập nước, rừng ngập mặn…), theo loài cây (rừng gỗ, rừng hỗn giao), theo trữ lượng (nghèo, trung bình, giàu, rất giàu, rừng chưa có trữ lưọng).
- Năm 2001, Bộ Nông nghiệp và Phát triển nông thôn đã phê duyệt Chiến lược phát triển lâm nghiệp giai đoạn 2001-2010, trong đó quy hoạch đất lâm nghiệp là 16 triệu ha, bao gồm: rừng đặc dụng 2 triệu ha, rừng phòng hộ 6 triệu ha, rừng sản xuất 8 triệu ha.
- Ngày 05/12/2005, Thủ tướng Chính phủ đã ban hành Chỉ thị số 38/2005/CT-TTg chỉ đạo các địa phương tiến hành rà soát quy hoạch sắp xếp lại 3 loại rừng phù hợp với yêu cầu thực tiễn, đảm bảo yêu cầu bảo tồn, phòng hộ và phát triển kinh tế bền vững. Cơ cấu 3 loại rừng toàn quốc sau rà soát quy hoạch với tổng số 16.247.492 ha (chiếm gần 50% diện tích đất tự nhiên toàn quốc), trong đó quy hoạch rừng đặc dụng 2.199.342 ha, rừng phòng hộ 5.552.328 ha, rừng sản xuất 8.495.823 ha. Diện tích này tương đối phù hợp với dự kiến lâm phận quốc gia đến năm 2020 được đề cập trong Chiến lược phát triển lâm nghiệp Việt Nam giai đoạn 2006-2020.
- Theo số liệu của Bộ Nông nghiệp và PTNT, tính đến 31/12/2009, diện tích rừng toàn quốc: 13.258.843ha (tỷ lệ che phủ 39,1%), trong đó rằng đặc dụng: 1.999. 915ha; rừng phòng hộ: 4.832.962ha; rừng sản xuất: 6.288.246ha.
Đây là cơ sở pháp lý quan trọng cho việc tiến hành điều tra, khảo sát, đánh giá tình trạng rừng, đo đếm trữ lượng hấp thụ và lưu giữ các bon, lựa chọn địa điểm triển khai REDD .
2.3. Chính sách giao đất, giao rừng
- Luật Đất đai 2003 (Điều 5) khẳng định, đất đai thuộc sở hữu toàn dân do Nhà nước đại diện chủ sở hữu. Nhà nước giữ quyền định đoạt cao nhất đối với đất đai bằng việc thực hiện những quyền năng cụ thể. Nhà nước trao quyền sử dụng đất cho người sử dụng đất thông qua hình thức giao đất, cho thuê đất, công nhận quyền sử dụng đất đối với nguời đang sử dụng đất ổn định.
- Luật Bảo vệ và Phát triển rừng năm 2004 (Điều 6) quy định, Nhà nước thống nhất quản lý và định đoạt đối với rừng tự nhiên và rừng được phát triển bằng vốn của Nhà nước, rừng do Nhà nước nhận chuyển quyền sở hữu rừng sản xuất là rừng trồng từ các chủ rừng. Nhà nước thực hiện quyền định đoạt đối với rừng. Nhà nước trao quyền sử dụng rừng cho chủ rừng thông qua hình thức giao rừng, cho thuê rừng, công nhận quyền sử dụng rừng, quyền sở hữu rừng sản xuất là rừng trồng.
Như vậy, theo quy định của pháp luật hiện hành, giao đất, giao rừng là một trong những hình thức cơ bản Nhà nước thực hiện trao quyền sử dụng đất và rừng cho các đối tượng trong xã hội và hình thành hệ thống các chủ rừng. Luật Bảo vệ và Phát triển rừng quy định, chủ rừng là tổ chức, hộ gia đình, cá nhân được Nhà nước giao rừng, cho thuê rừng, giao đất để trồng rừng, cho thuê đất để trồng rừng, công nhận quyền sử dụng rừng, công nhận quyền sở hữu rừng sản xuất là rừng trồng; nhận chuyển nhượng rừng từ chủ rừng khác; có 7 loại chủ rừng, như ban quản lý rừng phòng hộ, ban quản lý rừng đặc dụng; tổ chức kinh tế; hộ gia đình, cá nhân… Ngoài ra, quyền sử dụng rừng còn được trao cho cộng đồng dân cư thôn và được công nhận là chủ rừng.
- Sau khi Luật Bảo vệ và Phát triển rừng được ban hành, cơ quan nhà nước đã ban hành nhiều văn bản dưới luật hướng dẫn thi hành luật. Bộ Nông nghiệp và Phát triển Nông thôn đã ban hành Thông tư số 38/2007/TT-BNN ngày 25/4/2007 về hướng dẫn trình tự, thủ tục giao rừng, cho thuê rừng, thu hồi rừng cho tổ chức, hộ gia đình, cá nhân và cộng đồng dân cư thôn. Gần đây, ngày 29/01/2011, Bộ Nông nghiệp và PTNT, Bộ Tài nguyên và Môi trường đã ban hành Thông tư liên tịch số 07/2011/TTLT-BNNPTNT-BTNMT hướng dẫn một số nội dung về giao rừng, thuê rừng gắn với giao đất, thuê đất lâm nghiệp. Theo đó, hướng dẫn việc phối hợp giữa cơ quan Tài nguyên và Môi trường và cơ quan Kiểm lâm trực thuộc Tổng cục Lâm nghiệp (Bộ Nông nghiệp và PTNT) thực hiện các công việc, như: giao rừng, thuê rừng gắn liền với giao đất, thuê đất lâm nghiệp lần đầu; hoàn thiện hồ sơ giao rừng, thuê rừng; hoàn thiện hổ sơ địa chính đối với trường hợp đã được giao rừng, thuê rừng nhưng chưa được giao đất, thuê đất lâm nghiệp hoặc chưa được cấp giấy chứng nhận quyền sử dụng đất…Bản đồ được sử dụng trong trường hợp này là hệ quy chiếu VN-2000 với tỷ lệ cơ bản là 1/10000 hoặc 1/5000.
- Pháp luật về đất đai, pháp luật bảo vệ và phát triển rừng còn quy định các quyền của chủ rừng (chuyển đổi, chuyển nhượng, tặng cho, cho thuê, thừa kế, thế chấp, bảo lãnh, góp vốn bằng giá trị quyền sử dụng rừng và đất lâm nghiệp) tuỳ theo từng loại rừng và đất lâm nghiệp được giao (rừng đặc dụng, rừng phòng hộ, rừng sản xuất), tuỳ theo từng loại hình chủ rừng (tổ chức, hộ gia đình, cá nhân, cộng đồng dân cư thôn).
Hộ gia đình, cá nhân, cộng đồng dân cư thôn được giao đất lâm nghiệp chỉ có quyền sử dụng đất; được giao rừng tự nhiên chỉ có quyền sử dụng rừng, chứ không có quyền sở hữu rừng. Rừng trồng do chủ rừng là hộ gia đình, cá nhân, cộng đồng dân cư thôn tự đầu tư thì có quyền sở hữu rừng. So với chủ rừng là hộ gia đình, cá nhân, cộng đồng dân cư thôn được giao rừng có ít quyền hơn, như không có các quyền chuyển đổi, chuyển nhượng, tặng cho, cho thuê, thế chấp, bảo lãnh, góp vốn kinh doanh bằng giá trị quyền sử dụng rừng được giao (xem Hộp 1, hộp 2). Đây là một trong những cơ sở pháp lý quan trọng trong việc xác định các đối tượng chính tham gia vào các hoạt động của REDD và được chia sẻ lợi ích từ REDD .

Ngoài ra pháp luật về đất đai, pháp luật về bảo vệ và phát triển rừng còn quy định chính sách cho thuê đất, cho thuê rừng cho tổ chức, hộ gia đình, cá nhân, quy định các quyền của chủ rừng được thuê đất, thuê rừng, tạo cơ sở pháp lý hình thành các chủ rừng. Đây cũng là những đối tượng tham gia vào các hoạt động liên quan đến REDD và cũng là đối tượng được chia sẻ lợi ích từ nguồn thu REDD .
- Theo Bộ Tài nguyên và Môi trường, tính tới tháng 1/1/2009, Nhà nước đã giao khoảng 11,4 triệu ha đất lâm nghiệp cho các tổ chức, hộ gia đình, cá nhân, cộng đồng dân cư thôn sử dụng ổn định lâu dài vào mục đích lâm nghiệp, trong đó giao cho hộ gia đình, cá nhân 3,82 triệu ha (33,5%), các tổ chức kinh tế 2,97 triệu ha (26%).
Rừng với tư cách là tài nguyên, tài sản trên đất lâm nghiệp, đã có sự thay đổi, xét về cơ cấu quyền sở hữu/quyền sử dụng rừng, trong những năm gần đây khi thực hiện chính sách giao đất, giao rừng; cho thuê đất, cho thuê rừng. Trên thực tế đã hình thành 3 loại hình về quyền sở hữu/quyền sử dụng rừng chủ yếu sau đây:
Thứ nhất, rừng thuộc quyền sở hữu/quyền sử dụng của các tổ chức nhà nước được hình thành trên cơ sở Nhà nước đã giao rừng và đất lâm nghiệp cho các tổ chức kinh tế của nhà nước, ban quản lý rừng đặc dụng, ban quản lý rừng phòng hộ, đơn vị vũ trang nhân dân và các tổ chức khác; diện tích rừng và đất rừng chưa giao cho chủ quản lý cụ thể do Uỷ ban nhân dân cấp xã chịu trách nhiệm quản lý về mặt nhà nước.
Thứ hai, rừng thuộc quyền sở hữu/quyền sử dụng của hộ gia đình, cá nhân, tư nhân được hình thành trên cơ sở diện tích rừng và đất lâm nghiệp đã giao cho các hộ gia đình, cá nhân, tư nhân, công ty liên doanh sử dụng ổn định lâu dài vào mục đích lâm nghiệp.
Thứ ba, rừng thuộc quyền sở hữu/quyền sử dụng của cộng đồng: được hình thành trên cơ sở diện tích rừng và đất lâm nghiệp cộng đồng dân cư quản lý theo truyền thống từ lâu đời hoặc được nhà nước giao để sử dụng ổn định, lâu dài vào mục đích lâm nghiệp.
- Xét về cơ cấu quyền sở hữu/quyền sử dụng rừng: tính đến 31/12/ 2009, theo Bộ Nông nghiệp và PTNT, trong tổng số 13,258 triệu ha rừng toàn quốc, rừng thuộc quyền sở hữu/quyền sử dụng của các tổ chức nhà nước 8,672 triệu ha chiếm 67%, trong đó: tổ chức kinh tế: 2,044triệu ha (15,6 %); các ban quản lý rừng phòng hộ: 2,328 triệu ha (17,6%); các ban quản lý rừng đặc dụng: 1,99 triệu ha (15,2%), khoảng 2,31 triệu ha rừng (17,6%) chưa giao cho chủ quản lý sử dụng cụ thể, Uỷ ban nhân dân cấp xã đang chịu trách nhiệm quản lý về mặt nhà nước. Diện tích rừng thuộc quyền sở hữu/quyền sử dụng của khu vực ngoài quốc doanh 4,568 triệu ha chiếm 33% tổng diện tích rừng toàn quốc, trong đó hộ gia đình, cá nhân: 3,28 triệu ha (25%). Trong những năm tới, Việt Nam tiếp tục đẩy mạnh chính sách giao đất, giao rừng cho các thành phần kinh tế ngoài quốc doanh (hộ gia đình, cá nhân, cộng đồng) thì diện tích rừng và đất rừng thuộc sở hữu nhà nước sẽ giảm so với hiện nay, diện tích rừng và đất rừng thuộc quyền sở hữu/quyền sử dụng của các thành phần kinh tế ngoài quốc doanh có xu hướng tăng lên.
2.4. Chính sách giao khoán rừng và đất lâm nghiệp
- Trong hệ thống văn bản pháp luật liên quan đến quản lý rừng, còn đề cập đến một quan hệ dân sự đó là giao khoán rừng và đất lâm nghiệp. Văn bản pháp luật điều chỉnh quan hệ giao khoán rừng là Nghị định số 01/ CP ngày 1/1/1995 của Chính phủ ban hành quy định về việc giao khoán đất sử dụng vào mục đích sản xuất nông nghiệp, lâm nghiệp, nuôi trồng thuỷ sản trong các doanh nghiệp nhà nước và được thay thế bằng Nghị định số 135/2005/NĐ-CP ngày 08 /11/2005 của Chính phủ về việc giao khoán đất nông nghiệp, đất rừng sản xuất và đất có mặt nước nuôi trồng thuỷ sản trong các nông trường quốc doanh, lâm trường quốc doanh.
Việc phân biệt rõ giữa giao rừng và giao khoán rừng là cần thiết (xem hộp 3), vì nó liên quan đến tư cách pháp lý của các đối tượng tham gia vào các quan hệ này và đương nhiên các đối tượng này có các quyền khác nhau, trong đó có quyền huởng lợi từ dịch vụ cacbon. Hộ gia đình, cá nhân, cộng đồng dân cư thôn nhận khoán bảo vệ, khoanh nuôi tái sinh và trồng rừng không phải là "chủ rừng", về thực chất, họ chỉ là ngưòi làm thuê thông qua hợp đồng khoán với chủ rừng (bên giao khoán).
- Theo số liệu của Bộ Nông nghiệp và Phát triển nông thôn, song song với việc giao đất, giao rừng và cho thuê rừng, hàng năm Dự án 661 đã dành khoảng 150- 200 tỷ đồng khoán bảo vệ khoảng hơn 2 triệu ha rừng tập trung vào địa bàn cần ưu tiên để các địa phương chủ động giao khoán bảo vệ rừng. Tổng diện tích khoán bảo vệ rừng đã thực hiện được 2.454.480 ha. Trong đó: Giai đoạn 1998 - 2005 diện tích giao khoán bảo vệ rừng thực hiện được 2.416.413 ha/2.000.000 ha, đạt 120%. Giai đoạn 2006 - 2010 diện tích giao khoán bảo vệ rừng thực hiện được 2.507.355 ha/1.500.000 ha, đạt 167%.
2.5. Chính sách về khai thác, sử dụng rừng và hưởng lợi từ rừng
Được quy định khung tại Luật Bảo vệ và phát triển rừng năm 2004, theo đó, trên cơ sở phân chia 3 loại rừng, Nhà nước ban hành chế độ khai thác, sử dụng rừng và hưởng lợi từ rừng khác nhau và có thể tóm tắt như sau:
- Quyết định số 186/2006/QĐ-TTG ngày 14/8/2006 của Thủ tướng Chính phủ về quy chế quản lý rừng và Thông tư số 35/2011/TT-BNNPTNT ngày 20/5/2011 của Bộ Nông nghiệp và PTNT về hưóng dẫn thực hiện khai thác, tận thu gỗ và lâm sản ngoài gỗ đã cụ thể hoá việc khai thác rừng theo từng loại rừng (đặc dụng, phòng hộ, sản xuất); theo từng loại hình chủ rừng (tổ chức, hộ gia đình, cá nhân, cộng đồng dân cư thôn); theo nguồn hình thành rừng (rừng tự nhiên hay rừng trồng); nguồn vốn hình thành rừng (vốn đầu tư từ ngân sách nhà nước, vốn của chủ rừng; vốn đầu tư, hỗ trợ từ các dự án quốc tế...).
- Quyền hưởng lợi từ rừng được cụ thể hoá tại một số văn bản pháp luật như: Quyết định số 178/2001/QĐ-TTg ngày12/11/2001 của Thủ tướng chính phủ về quyền hưởng lợi, nghĩa vụ của hộ gia đình, cá nhân được giao, được thuê, nhận khoán rừng và đất lâm nghiệp; Quyết định số 661/QĐ-TTg ngày 29/7/1998 của Thủ tướng Chính phủ về mục tiêu, nhiệm vụ, chính sách và tổ chức thực hiện Dự án trồng mới 5 triệu ha rừng, Quyết định số 147/2007/QĐ-TTg ngày 10/9/ 2007 của Thủ tướng Chính phủ về một số chính sách phát triển rừng sản xuất giai đoạn 2007 – 2015...Theo quy định của các văn bản pháp luật trên, quyền hưởng lợi từ rừng là những lợi ích từ rừng mà chủ rừng hoặc người nhận khoán được hưởng, gồm: gỗ, củi, lâm sản ngoài gỗ (chủ yếu là thực vật rừng không thuộc loại cấm khai thác), sản phẩm nông - lâm - ngư kết hợp, chi phí công bằng tiền (nếu có)… Quyền hưởng lợi từ rừng được áp dụng cho 2 trường hợp sau đây:
Quyền hưởng lợi từ rừng đối với chủ rừng được Nhà nước giao đất, giao rừng; cho thuê đất, cho thuê rừng.

EXECUTIVE SUMMARY
The Trade-Related Technical Assistance [TRTA] addressed by this Report falls under the “Build-up Rules of Origin for specific industries of Viet Nam to orientate and support negotiations of Viet Nam in FTA Agreements“ component of MUTRAP III [Activity Code FTA 5A].
The TRTA was delivered in collaboration with the Vietnamese Chamber of Commerce & Industry, VCCI. The Center for Certifying Commercial Documents, CCCD was the implementation Partner, instrumental to mobilizing the Vietnamese entrepreneurs and producers in the Capital and at the decentralized level.
The Mission, which took place between 19 February and 14 March 2012, covered Hanoi, Ho Chi Min and Can Tho cities as per VCCI/CCCD’s planning.
The entry into force, on 1st January 2011, of the new EU-GSP Rules of Origin [RoO] as contained in the Commission Regulation (EU) N. 1063/2010 is a landmark in the evolution of preferential market access and the RoO regime regulating it.
Far more liberal than the RoO provisions previously in existence , the new EU-GSP RoO are setting a benchmark, which had long been advocated for in preferential rules of origin, thus paving the way for RoO reform by other preferences giving countries -namely, Japan and the United States under their respective GSP schemes.
Based on almost a decade of reflection on drafting and administering RoO within the EC-GSP, the current Commission Regulation provides evidence as well as practical guidance on RoO drafting, in the overall attempt to exploit the developmental dimension of preferential rules of origin.
Tailoring the RoO provisions to the production capacity of Viet Nam is central in the forthcoming round of negotiations, either within the Trans-Pacific Partnership [TPP] or, at bilateral level, in the context of the EU-Viet Nam FTA.
Facilitating the exploitation of trade preferences by Vietnamese producers/exporters is a current preoccupation of VCCI/CCCD’s Directors, in the awareness that preferential margins are, indeed, a factor of competitiveness in modern trade transactions.
Furthermore, Vietnamese authorities need the capacity to translate Vietnamese trade interests into negotiating positions for the benefit of both producers and consumers.
In this perspective, the TRTA delivered jointly with VCCI, had a twofold purpose:
Introduce the Vietnamese producers to the new EC-GSP RoO scheme and future administrative requirements induced by the entry into force of the abovementioned Commission Regulation as of January 1st, 2011. Awareness rising on the trade opportunities provided by the current FTAs is a determinant of competitiveness for actual and potential entrepreneurs/exporters.
Identify constraints and potentials of Vietnamese producers and exporters in view of forthcoming negotiations of a FTA with the EU and the TPP.
The methodology adopted was based on the following core components:
o Review of Viet Nam’s rate of performance in the utilization of the EU preferential tariff scheme. The latest available data [2009] were produced and analyzed to provide VCCI with evidence of the average preferential market access exploitation by Vietnamese exporters/producers.
o Identification of the product/sector categories where current rules of origin still encounters difficulties in terms of compliance and where the more liberal rules of origin introduced by the EC could assist in creating new trading opportunities. Matching the new EU Commission Regulation provisions with the reality of Vietnamese commercial transactions showed how -and the extent to which -RoO compliance becomes a factor of competitiveness as it determines the exploitation of preferential margins.
o Design of targeted RoO workshops to initiate a consultative process between VCCI and its Constituency nationwide. Maintaining the institutional dialogue between the public and the private sector is instrumental to channeling the required inputs into the drafting of RoO texts in view of the forthcoming negotiations.
o Identify action for immediate follow up, enabling VCCI to fully perform its leading role and functions as the interface between the public Authorities and the Private Sector on trade matters.
The Report contains three core sections:
1. IMPLEMENTATION - Presents the implementation modalities, including organization of work, selection of the technical contents and production of the reference material targeted to the business language of the Private Sector.
2. FINDINGS - Discusses the potential impact of the new RoO under the EU-GSP at horizontal and product/sector-specific level with the support of trade data referring to the rates of preferential tariffs’ utilization by Vietnamese exporters/producers. It also sheds light on the main issues of concern to the Vietnamese exporters and the bottlenecks being faced to take advantage of trade preferences.
3. WAY FORWARD - Based on the above as well as on the preliminary findings of the MUTRAP III Study on “Assessing the impact of Rules of Origin in the Vietnam FTAs”, suggests action aimed at enabling VCCI to:
Conduct comparative analysis of preferential margins and rules of origin available to Vietnamese exporters available under the various FTAs of which Viet Nam is a Party
Elaborate and review utilization rates of tariff preferences at product/sector level so as to determine the extent to which these are a function of the applicable RoO provisions and, thus , determine the easiness as well as the costs of compliance for Vietnamese exporters – both actual and potential
propose alternative RoO drafting wherever there is scope and margin of negotiating maneuvers in order to correct/improve the multiplicity of current RoO regimes and their administration modalities –to, ultimately, best reflect the reality of Vietnamese production capacity and its trade interests.
With an average rate of 50% utilization of tariff preferences under the EU-GSP scheme, there is scope for Viet Nam to improve the exploitation of preferential market access being granted under the EU and in the various FTAs. Preferential margins may, in fact, reveal as a decisive factor in determining the competitiveness of Vietnamese exporters -namely, those able to comply with origin requirements.
Moreover, there is a pressing need for VCCI to assess and to address the competitiveness challenge and risk that may be arising vis-à-vis of the LDCs as a result of the entry into force of the far more lenient RoO provisions that the new EU-GSP Regulation has introduced in favor of the LDCs. As a matter of fact, the literally overnight move of bicycle production across the Cambodian border provides evidence of what may be witnessed in other areas with the consequent shifting of foreign direct investment to Viet Nam’s neighbors.
The extent to which Vietnam is going to succeed in the forthcoming rounds of trade negotiations -namely, in the context of the US-supported TPP initiative and/or the EU-Vietnam FTA- is a function of the institutional capacity to anticipate economic trends and propose corrective measures at the occasion of the trade talks.
The rules of origin component of these negotiations should be designed to be conducive to business allowing a consolidation and expansion of commercial transactions.
Failing to do so will result in a missed opportunity for VCCI and for Viet Nam as a whole.
I. CONTEXT

The TRTA was delivered in collaboration with the Vietnamese Chamber of Commerce & Industry, VCCI. The Mission, which took place between 19 February and 14 March 2012, covered Hanoi, Ho Chi Min and Can Tho cities as per VCCI’s planning.
The Mission continued and built upon the work carried out in 2011, culminating with the production of the MUTRAP III Study on “Assessing the impact of Rules of Origin in the Viet Nam FTAs” .
As a follow up to the above mentioned study, it was thought necessary to establish a close link with VCCI to gather the necessary information on rules of origin compliance from the Vietnamese producers and exporters and assist VCCI in mastering and administering the new EC rules of origin and the various sets of RoO currently into existence under the various agreements. A series of national RoO events were designed to reach out for the Private Sector and start an institutional dialogue on the subject matter.
More specifically, the work carried out aimed at assessing the extent to which Vietnamese entrepreneurs are actually exploiting trade preferences, which are a significant indicator of the effectiveness of a given preferential arrangements as Viet Nam engages in the Trans-Pacific Partnership [TPP] and, eventually, the EU-Viet Nam FTA.
In February 2012, the Prime Minister conferred formal responsibility to VCCI as the institutional intermediary in public-private dialogue when trade issues are at stake. In fact, the contents of Decision N. 06/2012 specifically call upon to VCCI to link and consult with the Vietnamese entrepreneurs for well documented and informed trade policy-making to occur.
VCCI’s governmental designation as the primary actor to convey formalized Private Sector inputs into the negotiating agenda of Viet Nam made the scope and contents of the RoO Mission particularly relevant and timely.
This holds particularly true with regard to the capacity of VCCI’ s Center for certifying commercial documents, as the latter prepares for fully embracing its mandate and functions in relation to Viet Nam’s export performance as well as in preparation for the negotiating rounds ahead of the Vietnamese authorities - either within the ASEAN FTAs or, on a bilateral basis in the context of the long awaited for EU-Viet Nam FTA.
II. IMPLEMENTATION
In consultation with VCCI, the following implementation steps were made:
Selection of reference RoO material and trade data elaboration on preferential tariffs utilization rates by Vietnamese exporters. The support technical material was provided for translation into Vietnamese and dissemination prior to the three planned RoO events. This included:
- “The Reform of the EC GSP Rules of Origin” document
- The MUTRAP III Report on “Assessing the impact of Rules of Origin in the Viet Nam FTAs”
- the “Utilization of EU Preferential Scheme”, 2009 trade data table.
Agenda preparation for the three RoO workshops in Hanoi, Ho Chi Minh City and Can Tho. This included tailoring the sector/product-specific RoO review to the features of each hosting location -e.g. agro food processing and aquaculture for Can Tho’s audience. Sets of power-point presentations were prepared illustrating the changes introduced by the new EU GSP Regulation, at horizontal as well as product-specific level. The key findings and recommendation of the above mentioned MUTRAP III study were also introduced.
Analysis and discussion of the outcome of the RoO events with, respectively, VCCI and MUTRAP III Directors for follow up action.
The Mission built upon, and benefited from the RoO review and analytical work already carried out in 2011 with MUTRAP III support and culminated with the study report referred above.
Throughout the implementation, business-friendly terminology was in focus to enable private sector representatives to grasp the RoO’s impact on their commercial operations.
Evidence was chosen to illustrate how the RoO provisions directly affect company sourcing of production inputs - the typical case of fabric imports for garment manufacturing - as well as foreign direct investment choices -e.g., the case of the bicycling industry across the Cambodian borders. In the case of fishery products the various origin requirements specific to aquaculture, internal waters, territorial waters and high seas were addressed.
The workshops have been animated by a series of Q&A sessions where Vietnamese exporters and producers had the opportunity of showing samples of their products allowing clear and unambiguous advice from the MUTRAP experts.
Issues related to transshipment, verification, fraud prevention were a cross cutting feature of the workshops.
As an anticipation of the mission’s findings, it was found that continued effort is going to be needed to identify potential fraud and transshipment and to strengthen VCCI role in the origin verification proceedings.
This holds particularly important in view of the introduction of the Registered Exporters Database in 2017.
Furthermore, VCCI was determined to explore the possibility of becoming a Pilot Country for the setting up of the Registered Exporters’ Database, should the EU Commission opt for a test phase of the database functioning modalities in preparation for the new system to be fully operational.
In this respect, VCCI requested to be introduced to the on-going EU Dialogue involving, among others, IT Programmers as well as Customs management specialists, so that Viet Nam’s candidature can be put forward when times are ripe for it.
In order to ensure compliance with the principle of Administrative Cooperation introduced by the new EU Regulation, however, VCCI has the opportunity to replicate the implementation modalities of this TRTA, which can be instrumental to determining the level of preparedness of the Vietnamese RoO administration system and eventually, collect evidence to request for the derogation up to 2020.
III. FINDINGS
A. Preferential market access utilization rates
The average rate of preferential tariffs utilization by the Vietnamese exporters under the the EU GSP is 53%, according to the latest available figures . An examination of the preceding years carried out in the former MUTRAP study over the period 2005-2009 confirms this trend.
However, at product-specific level, performances are varying sensibly, with shrimps and prawns exports of HS160620 recording a 100% preferential tariff utilization rate while jerseys of HS611030 only scoring a mere 40%.
This trend of underutilization of trade preferences is not limited to the EU GSP. As a matter of fact, Viet Nam shows very limited exploitation of trade preferences being granted within the ASEAN FTAs.
These percentages provide evidence on the fact that Vietnamese exporters are only partially benefitting of the preferential market openings, thus introducing the argument of RoO compliance capacity to satisfy the rules of the export destination markets.
As shown in detail under the MUTRAP IIII Report, under the old rules of origin Vietnam faced a number of difficulties in meeting the rules of origin requirements for Clothing products of Chapter 62 due to the double processing requirement under the EC rules of origin that do not allow the use of imported fabric to make finished garments.
Such rule has not changed under the new EC GSP rules of origin. However new EC rules of origin have made it easier to comply with Rules of origin requirements rules for motorcycles and bicycles by raising the allowance of non-originating materials up to 50 per cent.
With its formal and substantive requirements, RoO compliance comes at a cost, both at the company/factory level as well as at the level of the RoO managing and inspecting authorities. These aspects are thoroughly addressed by the MUTRAP III study, which indicates that the willingness to comply with RoO is a function of “the volume of exports eligible for preferential treatment, the share of these exports in total value of sales and the cost involved. Ultimately, the expenditures incurred in operating a parallel accounting system may outweigh the benefit of preferential rates under a given FTA” .
They also consolidate the findings of the above cited MUTRAP III RoO Review study, showing low preferential tariffs utilization rates in intra-regional ASEAN trade.
In view of the above it is considered that in the forthcoming negotiations for the establishment of the EU FTA Vietnam seeks a kind of "LDC parity" arguing for the extension of the more lenient products specific criteria currently reserved to LDC to Vietnam .This especially for the clothing sectors where Vietnam is showing consistent pattern of under- utilization of trade preferences due to the double processing requirement i.e. weaving and making up .
In a similar vein Vietnam should argue in the TPP negotiations for lenient rules of origin in the case of textile and clothing sector where the US have already tabled some rules of origin clearly inspired to the yarn forward approach .. The table below provides an example of such more favourable rules of origin rules in both.

Obviously bearing in mind the above-mentioned example in the tables, there is a need to carry out a much more in depth analysis at product specific level to identify other areas where alternative rules of origin could be identified and drafted under the two negotiating scenarios. In the case of the TPP negotiations Vietnam should draw a number of lessons learned from the negotiations on rules of origin that many Latin America countries have carried with the US. In the case of the EU, apart the product specific examples given above, there are a number of areas in the electronic and machinery sectors for example, but not limited to these two sectors, where the new EC rules of origin under the EU GSP could assist in creating new trading opportunities. Through an in depth consultation with Vietnamese producers it would also be possible to gather the specific areas where improvements are needed even with respect to the current new EU GSP rules of origin to be brought forward in the future FTA negotiations . At the same time these consultations would be useful to further disseminate awareness of the new EU GSP rules .As gathered during the workshops the awareness on the new rules of origin is limited among the Vietnamese business community and more workshops would be beneficial to raise the understanding of the new rules of origin and their potential.
B. Cumulation
The relaxation of the criteria for allocating origin among the members of a Regional grouping is a significant improvement under the new GSP rules of origin as it facilitates the utilization of regional inputs among the Members of the same regional grouping. In addition, the new Regulation introduces the possibility of cumulation among ASEAN and SAARC.
Extended cumulation under the new EU GSP scheme has the potential to open up alternative sourcing of inputs for Vietnamese exporters along with the potential to attract FDI, should investors -national and foreign- opt for the simplified RoO requirements in promising electronics, machinery, toys, wooden products.
The flexibility introduced by the new ASEAN Regional cumulation provisions as compared to the previous regime are shown in the table below.

(a) materials originating in a country of one regional group shall be considered as materials originating in a country of the other regional
group when incorporated in a product obtained there, provided that the working or processing carried out in the latter beneficiary country goes
beyond the operations described in Article 78(1) and, in the case of textile products, also beyond the operations set out in Annex 16.
(b) where the condition laid down in point (a) is not fulfilled, the products shall have as country of origin the country participating in the cumulation which accounts for the highest share of the customs value of the materials used originating in other countries participating in the
cumulation.
In the case of the old regulation under paragraph (a ) the value of materials calculation was carried out automatically while in the case of the new regulation under (a) the test is not carried out unless the imported materials only undergo insufficient working or processing as contained in art 78 (1) or the operations described in annex 16 for textiles and clothing
The extended cumulation that could be granted under request has a number of conditionalities as it can be easily detected from the wording of paragraph 7 of Article 86 of the Regulation:
“At the request of any beneficiary country’s authorities, extended cumulation between a beneficiary country and a country with which the European Union has a free-trade agreement in accordance with Article XXIV of the General Agreement on Tariffs and Trade (GATT) in force, may be granted by the Commission, provided that each of the following conditions is met:
(a) the countries involved in the cumulation have undertaken to comply or ensure compliance with this Section and to provide the administrative cooperation necessary to ensure the correct implementation of this Section both with regard to the European Union and also between themselves.
(b) the undertaking referred to in point (a) has been notified to the Commission by the beneficiary country concerned.
The request referred to in the first sub-paragraph shall contain a list of the materials concerned by the cumulation and shall be supported with evidence that the conditions laid down in points (a) and (b) of the first sub-paragraph are met. It shall be addressed to the Commission. Where the materials concerned change, another request shall be submitted. Materials falling within Chapters 1 to 24 of the Harmonized System shall be excluded from extended cumulation”.
These conditionalities could be summarized as follows:
first, the extended cumulation is not automatic
second, it does not apply to agricultural products
third, there a number of procedures to be followed upon request and during implementation.
“Only practice would say the practical use of such provision” .
Actually, it could be of use to MERCOSUR Countries for inputs originating Mexico and Chile and to Asian Countries wishing to cumulate with South Korea inputs.
In the course of the workshop and in consultations held with VCCI it was found that one area of immediate follow up is the official request for the expansion of cumulation to with SAARC Member States and, perhaps, most importantly of extended cumulation with South Korea. This process requires the identification of the steps to be undertaken by the Vietnamese Authorities and requires institutional implementation capacity.
C. Product-specific Rules of Origin
The power point presentations in annex contain the major highlights on the product-specific RoO of interest to Viet Nam. These include items in the textile & clothing, electronics, bicycling/motor vehicles, machinery sectors along with agro-processing including aquaculture.
On footwear, the graduation of Viet Nam was taken into account for utilization rate purposes.
In the course of the discussion with the entrepreneurs/exporters, it very clearly emerged that there is need to address very specific and technical issues arising from the interpretation of the EC Regulation, which is a legal text in its entirety and that deserves to be translated into business-friendly language.
As repeatedly pointed out, failing to comply with RoO legal discipline has the immediate result of being denied preferential access –i.e. with the importer having to pay MFN duties at the time of customs clearance.
The Most Frequently Asked Questions table below summarizes, in a simplified format, the type of questions raised by the workshops’ participants, providing evidence of how diversified and extremely specific the requested clarifications may be.
Entrepreneurs brought their samples such as rugs of Chapter 62 and rubber articles of Chapter 40: this is a positive sign, witnessing commitment to comply and conform to origin certification for successful business operation.
More broadly, sector/product-specific analysis is required to address the diversification and investment targets being set by the Vietnamese Government.
In Annex IV, the RoO Comparative Matrix is provided showing the type of product-specific work to be carried out.
A. Administrative Cooperation
On January 1st, 2011, the European Commission has officially embraced a strengthened obligation of administrative cooperation between the preference granting and receiving partners. Shifting the burden of origin conferring and surveillance functions towards the certifying authorities in the Recipient, the new RoO administration regime “drastically changes” operational modalities and business practices.
For VCCI, much will depend on the ability to prepare the ground during the transitional period -either up to 2017 or, extended to 2020. Proximity to its exporters, documented knowledge of their production reality supported by transparent accounting and mutual trust are the prerequisites for optimal administration and win-win dialogue.
IV. WAY FORWARD
Governmental recognition of VCCI’s role and functions as the public-private interface on trade matters implies its institutional capacity to fully master trade administration tools as well as closely monitor trade trends in order to adopt corrective measures in real time.
New challenges are ahead of VCCI’s Centre for Certifying Commercial Documents [CCCD], as the preference-granting partners -namely, the EU- gradually embrace the principle of administrative cooperation , shifting the RoO management burden towards the intended beneficiary parties.
In addition to the current origin certification and verification functions, VCCI/CCCD will have to gain a thorough understanding of its trade actors, closely monitoring their production practices and commercial behaviors.
As the LDCs are the emerging competitors in the multilateral trade scenario, as a result of duty-free/quota free market access and relaxed rules of origin, there is a pressing need for VCCI to device alternative solutions for its private sector to successfully adjust and diversify as opportunities emerge on the negotiated tariff schedules and overall trade liberalizing practices.
To maintain its momentum, VCCI/CCCD can:
Organize decentralized events on Market Access & Rules of Origin to address the needs and interests of the private sector in targeting the various destination/sourcing markets. This will result in facilitating the use of tariff preferences made available to the Vietnamese exporters so as to optimize their export potentials and the overall production capacity of Viet Nam.
Focus on regional and extended cumulation with Group I [ASEAN] and Group III [SAARC] trade Partners provided for under the new EU-GSP. Conditional to official request by the intended Beneficiary [-ies], the launching of the necessary administrative process is the first step towards benefitting from the flexibility of the new EU-GSP cumulation regime. For VCCI/CCCD, this implies a significant effort in establishing constructive collaboration with the relevant Groupings’ counterparts responsible for RoO certification, verification and overall RoO administration.
Develop business-friendly formats of the multilateral trade instruments and their legal discipline [e.g., contents of the existing website providing on-line access to trade statistics and selected e-sources of trade information. This will include the translation into English of the existing components of the website and, ideally, its graduation into a comprehensive trade portal facilitating e-certification management along with the supply of trade information in real time. This will set the stage for the registered exporters database as Viet Nam gradually moves towards conformity to the quality standards requirements of its trading partners, regionally and globally.
Acquire in house capacity to conduct trade simulations of tariff liberalization schedules to optimize the benefit of trade negotiations.
Similarly, start alternative RoO drafting based upon the current experience of the EU’s RoO reform providing reference provisions for VCCI interpretation and possible formulation in support of Vietnamese trade interests and priorities.
Consider/prepare for pilot testing of the registered exporters database.

TÓM TẮT
Hoạt Động Hỗ trợ Kỹ thuật liên quan đến Thương mại [Viết tắt là TRITA] được đề cập trong báo cáo này nằm trong mục “Xây dựng các Quy tắc Xuất xứ dành cho các ngành công nghiệp cụ thể của Việt Nam nhằm định hướng và hỗ trợ các cuộc đàm phán của Việt Nam về các Hiệp định Thương Mại Tự do” của Dự ÁN MUTRAP III [Mã Vận Hành FTA 5A]
TRTA nằm trong nội dung hợp tác với Phòng Thương mại và Công nghiệp Việt Nam VCCI. Trung tâm Kiểm định Tài liệu Thương mại là Đối tác thực thi, tiến hành vận động các Doanh nghiệp và Nhà sản xuất Việt nam từ các cấp ban ngành trung ương tới cơ sở.
Theo kế hoạch của VCCI/CCCD, Hoạt đông sẽ diễn ra trong khoảng thời gian từ ngày 19 tháng 2 tới ngày 14 tháng 3 năm 2012.
Quy tắc xuất xứ mới theo Hệ thống Ưu đãi phổ cập của Liên minh Châu Âu EU-GSP nằm trong Quy Chế Ủy Ban (EU) Số. 1063/2010¬1 sẽ có hiệu lực kể từ ngày 1/1/2011. Đây chính là cột mốc để tăng cường khả năng tiếp cận thị trường ưu đãi cũng và cơ chế RoO.
Với nhiều điều khoản thông thoáng hơn so với RoO cũ hiện nay , EU-GSP RoO mới đang tạo ra một tiêu chuẩn đã từng được cổ xúy ngay trong các quy tắc xuất xứ ưu đãi, nhờ vậy đã mở đường cho các quốc gia trao ưu đãi thực hiện chương trình cải cách RoO, cụ thể là Nhật Bản và Mỹ theo quy trình GSP riêng của mình.
Căn cứ vào quá trình phản ảnh việc soạn thảo và quản lý RoO trong Hệ thỗng Ưu đãi Phổ cập của EU trong một thập kỷ3. Quy Chế Ủy Ban hiện hành5 đã đưa ra bằng chứng cũng như hướng dẫn thực hiện việc soạn thảo RoO, trong nỗ lực chung nhằm xác định phạm vi phát triển của quy tắc xuất xứ ưu đãi.
Lồng ghép các quy định RoO vào năng lực sản xuất của Việt Nam sẽ là trung tâm của các vòng đàm phán sắp tới trong tổ chức Quan hệ Đối tác Xuyên Thái Bình Dương (TPP) hoặc, ở cấp song phương, trong nội dung của Hiệp định Thương mại Tự do Việt Nam-Châu Âu.
Tạo điều kiện cho các nhà sản xuất/xuất khẩu của Việt Nam khai thác ưu đãi thương mại đang là mối quan tâm hiện nay của những người đứng đầu VCCI/CCCD vì họ phải nhận thức được rằng, biên độ ưu đãi thực sự là một yếu tố cạnh tranh trong các giao dịch thương mại hiện đại.
Hơn nữa, Chính quyền Việt Nam cần có năng lực để đưa được các lợi ích thương mại của Việt Nam vào vị trí đàm phàn vì lợi ích của cả nhà sản xuất lẫn người tiêu dung.
TRTA và VCCI đã đạt được một mục đích kép trong vấn đề này, cụ thể như sau:
Giới thiệu cho các nhà sản xuất của Việt nam về lộ trình Quy tắc xuất xứ EC-GSP mới cũng như những yêu cầu quản lý hành chính trong tương lai, sẽ có hiệu lực kể từ ngày 1/1/2011 theo quy định của Quy Chế Ủy Ban đã đề cập trên đây.
Nhận diện những hạn chế cũng như tiềm năng của các nhà sản xuất và xuất khẩu Việt nam tại các cuộc đàm phán sắp tới về FTA với EU và TPP.
Phương pháp được thông qua dựa trên một số nhân tố chính sau:
o Đánh giá khả năng tận dụng lộ trình ưu đãi thuế quan của Liên minh Châu Âu. Cơ sở dữ liệu mới nhất [2009] đã được xây dựng và phân tích để cung cấp bằng chứng cho VCCI về năng lực tiếp cận thị trường ưu đãi trung bình của các nhà sản xuất/xuất khẩu của Việt nam.
o Nhận diện các hạng mục sản phẩm/ngành nghề đang gặp khó khăn trong việc tuân thủ các quy tắc xuất xứ hiện hành, và khi EC giới thiệu những quy tắc xuất xứ thông thoáng hơn sẽ giúp các nhà sản xuât/xuất khẩu tạo ra các cơ hội thương mại mới. Việc các điều khoản của Quy Chế Ủy Ban phù hợp với tình hình giao dịch thương mại của Việt Nam đã chỉ ra cách thức và mức độ để việc áp dụng RoO trở thành một nhân tố cạnh tranh khi nó xác định mức độ khai thác biên độ ưu đãi.
o Tổ chức các cuộc hội thảo mục tiêu về RoO để bắt đầu quá trình tham vấn giữa VCCI và các văn phòng tại địa phương trên toàn quốc. Việc duy trì các cuộc đối thoại chuyên ngành giữa nhà nước và thành phần kinh tế tư nhân là cách tìm ra các yếu tố đầu vào cần thiết cho bản thảo RoO phục vụ cho các cuộc đàm phán sắp tới.
o Xác định kế hoạch hành động kịp thời sẽ giúp VCCI thực hiện đầy đủ vai trò và chức năng lãnh đạo của mình như một tổ chức trung gian giữa nhà nước và thành phần kinh tế Tư nhân về các vấn đề thương mại.
Báo cáo gồm có 3 phần trọng tâm:
1. THỰC HIỆN - trình bày các phương thức thực hiện, bao gồm việc sắp xếp công việc, lựa chọn nội các nội dung kỹ thuật và chuẩn bị tài liệu tham khảo tập trung vào ngôn ngữ thương mại của Thành phần Kinh tế tư nhân.
2. KẾT QUẢ - Thảo luận về tác động tiềm ẩn của RoO EU-GSP mới theo từng lĩnh vực/sản phẩm cụ thể và theo chiều nganh thông qua cơ sở dữ liệu thương mại liên quan đến tỉ lệ sử dụng ưu đãi thuế quan của các nhà sản xuất/xuất khẩu Việt Nam. Điều này cũng làm sáng tỏ các vấn đề chính đang được các nhà xuất khẩu Việt Nam quan tâm và gặp khó khăn khi tận dụng các ưu đãi thương mại.
3. ĐỊNH HƯỚNG - Dựa vào các thông tin trên cũng như những kết quả ban đầu của Nghiên cứu do Dự ÁN MUTRAP III thực hiện về việc “Đánh giá tác động của Quy tắc Xuất xứ trong các Hiệp định Thương mại Tự do của Việt Nam” đã mang lại cơ sở tạo điều kiện cho VCCI:
Tiến hành các phân tích mang tính so sánh về các mức cận biên ưu đãi3 và quy tắc xuất xứ đang áp dụng cho các nhà xuất khẩu Việt nam hiện nay theo các FTA khác nhau mà Việt nam là Đối tác.
Thiết lập và đánh giá tỉ lệ sử dụng ưu đãi thuế quan đối với sản phẩm/ngành nghề để xác định phạm vi chức năng của các quy định RoO có thể áp dụng, từ đó, xác định độ an toàn cũng như các khoản chi phí bắt buộc đối với các nhà xuất khẩu hiện tại và tiềm năng của Việt nam.
Đề xuất dự thảo RoO thay thế cho các mục có phạm vi và biên độ trong những lần thực hành đàm phán nhằm hoàn thiện/nâng cao tính đa dạng của các phương pháp RoO hiện nay cũng như các phương thức quản lý để cuối cùng, phản ảnh một cách tốt nhất thực tế năng lực sản xuất cũng như lợi nhuận thương mại của Việt Nam.
Với tỉ lệ sử dụng các ưu đãi thuế quan trung bình 50% theo phương án EU-GSP, khả năng khai thác tiệm năng tiếp cận thị trường ưu đãi của Châu Âu và các FTA khác của Việt nam sẽ được cải thiện. Trên thực tế, biên độ ưu đãi đóng vai trò then chốt trong việc xác định năng lực cạnh tranh của các nhà xuất khẩu Việt Nam, cụ thể là những người có khả năng đáp ứng được các yêu cầu về xuất xứ hàng hóa.
Ngoài ra, còn một nhu cầu bức thiết là VCCI phải đánh giá và nhận diện được thách thức cũng như rủi ro về năng lực cạnh tranh mà các nước kém phát triển đang phải đối mặt do những quy định RoO mới thông thoáng hơn từ Quy chế EU-GSP mới dành cho các nước kém phát triển bắt đầu có hiệu lực. Thực tế, việc chuyển đổi địa điểm đầu tư trong ngành sản xuất xe đạp sang Campuchia chính là bằng chứng về những gì đang diễn ra tương tự trong các ngành khác, và hậu quả là đang có sự dịch chuyển vốn đầu tư trực tiếp nước ngoài từ Việt nam sang các nước láng giềng.
Mức độ Việt Nam sẽ thành công trong các vòng đàm phán thương mại tới đây mà cụ thể, trong bối cảnh các cuộc đàm phán với Tổ chức Thương mại Xuyên Thái Bình Dương được Mỹ hậu thuẫn và/hoặc Hiệp định thương mại Tự do Việt Nam-Châu Âu-chính cho thấy vai trò về năng lực chuyên môn khi dự đoán các xu hướng kinh tế cũng như đề xuất các biện pháp khắc phục trong các cuộc đàm phán thương mại.
Chuẩn bị các mục trong quy tắc xuất xứ sẽ trao đổi trong các vòng đàm phàn sao cho có lợi cho hoạt động kinh doanh nhằm củng cố và mở rộng hơn nữa các hoạt động giao dịch thương mại.
Nếu không được chuẩn bị tốt, VCCI nói riêng và Việt Nam nói chung sẽ đánh mất cơ hội của mình.
I. BỐI CẢNH
Hoạt Động Hỗ trợ Kỹ thuật liên quan đến Thương mại [Viết tắt là TRITA] được đề cập trong báo cáo này nằm trong mục “Xây dựng các Quy tắc Xuất xứ dành cho các ngành công nghiệp cụ thể của Việt Nam nhằm định hướng và hỗ trợ các cuộc đàm phán của Việt Nam về các Hiệp định Thương Mại Tự do” của Dự ÁN MUTRAP III [Mã Vận Hành FTA 5A]
TRTA nằm trong nội dung hợp tác với Phòng Thương mại và Công nghiệp Việt Nam VCCI. Theo kế hoạch của VCCI/CCCD, Hoạt đông sẽ diễn ra trong khoảng thời gian từ ngày 19 tháng 2 tới ngày 14 tháng 3 năm 2012.
Hoạt động sẽ tiếp tục và căn cứ vào công việc thực hiện trong năm 2011, gần nhất là việc xây dựng Nghiên cứu Dự ÁN MUTRAP III về việc “Đánh giá tác động của Quy tắc xuất xứ trong các Hiệp định Thương mại Tự do của Việt Nam” .
Nghiên cứu đề cập trên đây cho rằng các Nhà sản xuất và Xuất khẩu của Việt nam cần liên kết chặt chẽ với VCCI để có các thông tin cần thiết về việc tuân thủ các quy tắc xuất xứ và hỗ trợ VCCI hiểu rõ và quản lý các quy tắc xuất xứ của Ủy ban Châu Âu cũng như các quy tắc xuất xứ khác được quy định trong các hiệp định thương mại. Hàng loạt các sự kiện mang tính quốc gia về Quy tắc xuất xứ đã được tổ chức dành riêng cho Thành phần kinh tế tư nhân và bắt đầu đối thoại chuyên ngành về nội dung chính liên quan đến RoO.
Đặc biệt hơn nữa, việc này nhằm đánh giá khả năng của các doanh nghiệp Việt Nam trong việc khai thác các ưu đãi thương mại, một chỉ số quan trọng mang tính hiệu quả trong các hiệp định ưu đãi cụ thể khi Việt Nam tham gia Quan hệ Đối tác Xuyên Thái Bình Dương TPP và gần đây nhất là Hiệp định Thương mại Tự do Việt Nam-Châu Âu.
Tháng 2/2012, Thủ tướng Chính phủ đã giao cho VCCI trách nhiệm làm trung gian tổ chức các cuộc đối thoại giữa nhà nước và doanh nghiệp khi nảy sinh các vấn đề thương mại. Trên thực tế, các nội dung trong Quyết định N.06/2012 tập trung kêu gọi VCCI liên kết và tham vấn với các doanh nghiệp Việt Nam để dưa ra quyết sách thương mại hợp lý và rõ ràng.
Việc Chính phủ chỉ định VCCI trở thành tác nhân chính đưa Thành phần kinh tế tư nhân lên bàn nghị sự đàm phán của Việt Nam đã cho thấy quy mô cũng như nội dung của nhiệm vụ RoO một cách cụ thể và kịp thời.
Điều này đặc biệt đúng với năng lực của Trung tâm Kiểm định Tài liệu Thương mại ,vì thông tin mới nhất được chuẩn bị bao hàm đầy đủ nhiệm vụ và chức năng liên quan đến hoạt động xuất khẩu của Việt Nam cũng như trong việc chuẩn bị cho cho các vòng đàm phán sắp tới của Việt Nam-bao gồm cả sự chuẩn bị cho các Hiệp định FTA trong khối ASEAN và nội dung cho cuộc đàm phán song phương về Hiệp Định FTA Việt Nam-Châu Âu rất được chờ đợi.
II. THỰC HIỆN
Các bước tiến hành sau đây đã được thực hiện trong quá trình tham vấn với VCCI:
Lựa chọn tài liệu RoO tham khảo và xây dựng cơ sở dữ liệu thương mại về mức khai thác ưu đãi thuế quan của các nhà xuất khẩu Việt Nam. Cung cấp tài liệu hỗ trợ kỹ thuật để dịch sang tiếng Việt và phổ biến trước khi lên kế hoạch cho ba sự kiện RoO. Hồ sơ bao gồm:
- Tài liệu“Sửa đổi Quy tắc xuất xứ của EC-GSP”
- Báo cáo của Dự ÁN MUTRAP III về việc “Đánh giá tác động của Quy tắc xuất xứ trong các Hiệp Định FTA của Việt Nam”
- Bảng cơ sở dữ liệu thương mại năm 2009 về “Tỉ lệ sử dụng lộ trình ưu đãi của Liên minh Châu Âu”.
Chuẩn bị chương trình nghị sự cho 3 cuộc hội thảo về RoO tại Hà Nội, Thành phố Hồ Chí Minh và Cần Thơ. Hội thảo phải lồng ghép đánh giá RoO về sản phẩm/ngành nghề cụ thể vào đặc điểm của mỗi địa phương nơi tổ chức hội thảo, ví dụ lồng ghép quá trình chế biến nông phẩm và nghề nuôi chồng thủy sản vào hội thảo tại Cần Thơ. Chuẩn bị các bài thuyết trình dạng powerpoint để minh họa những thay đổi trong Quy định GSP mới của Liên minh Châu Âu dành cho tất cả sản phẩm cũng như từng sản phẩm cụ thể. Cũng cần đề cập đến kết quả cũng như kiến nghị chính về bản nghiên cứu Dự ÁN MUTRAP III đã đề cập ở trên trong hội thảo.
Phân tích và thảo luận về tác động của các sự kiện RoO theo trình tự với lãnh đạo VCCI và Dự ÁN MUTRAP III để có hành động tiếp theo.
Nhiệm vụ được thực hiện và hưởng lợi từ việc đánh giá RoO cũng như những phân tích được thực hiện trong năm 2011 với sự hỗ trợ của Dự ÁN MUTRAP III và nhiều nhất là bản báo cáo nghiên cứu được đề cập ở trên.
Trong quá trình thực hiện, thuật ngữ thương mại thân thiện nhằm hỗ trợ các đại diện khu vực kinh tế tư nhân nằm bắt tác động của RoO lên các hoạt động thương mại.
Lựa chọn bằng chứng minh họa cho thấy các điều khoản RoO ảnh hưởng trực tiếp thế nào đến doanh nghiệp tìm mua nguyên liệu sản xuất- mà đặc trưng là việc nhập khẩu vải cho ngành dệt may-cũng như tác động trong vấn đề đầu tư trực tiếp nước ngoài, ví dụ ngành sản xuất xe đạp đang chuyển đổi đầu tư sang Campuchia. Trong trường hợp của sản phẩm thủy sản, những yêu cầu về xuất xứ khác nhau, cụ thể là ngành nuôi trồng thủy sản ở các vùng nội thủy, trong vùng lãnh hải hay ngoài biển cũng được đề cập trong hội thảo.
Các cuộc hội thảo diễn ra sôi động với hàng loạt các câu hỏi từ phía các nhà sản xuất và xuất khẩu của Việt Nam khi có cơ hội đưa ra những ví dụ cụ thể về các sản phẩm để được các chuyên gia Dự ÁN MUTRAP tư vấn cụ thể.
Các vấn đề liên quan đến việc chuyển tải, xác minh xuất xứ, đề phòng gian lận cũng được đưa ra mổ xẻ tại hội thảo.
Cũng theo dự tính, cần phải có nhiều hơn nữa những nỗ lực nhằm nhận biết gian lận tiềm ẩn và chuyển tải cũng như nhằm tăng cường vai trò của VCCI trong quá trình xác minh xuất xứ hàng hóa.
Điều này đóng vai trò đặc biệt quan trọng trong việc giới thiệu Cơ sở dữ liệu Các nhà Xuất khẩu Thành viên vào năm 2017.
Hơn nữa, VCCI đã được chỉ định để đánh giá khả năng trở thành Nước thí điểm trong việc xây dựng Cơ sở Dữ liệu Các nhà Xuất khẩu Thành Viên, và Ủy Ban Châu Âu phải lựa chọn thời điểm thử nghiệm những phương thức kích hoạt cơ sở dữ liệu để chuẩn bị cho hệ thống mới hoạt động đầy đủ.
Về khía cạnh này, VCCI được yêu phải giới thiệu Các lập trình viên Công nghệ thông tin và các chuyên gia về Quản lý Hải quan tại cuộc Trao đổi liên quan với Liên minh Châu âu cùng với các thành viên khác, có như vậy vào thời điểm hợp lý, Việt Nam sẽ tham gia ứng cử.
Tuy nhiên, để đảm bảo tuân thủ nguyên tắc Liên Hành chính theo quy định của EU, VCCI có cơ hội phát triển các phương pháp thực hiện TRTA nhằm xác định tình trạng sẵn sàng của hệ thống quản lý RoO của Việt Nam và từng bước, thu thập chứng cứ để yêu cầu được miễn trừ vào năm 2020.
III. KẾT QUẢ
A. Tỉ lệ tận dụng quyền tiếp cận thị trường ưu đãi
Theo số liệu mới nhất mới nhất, tỉ lệ tận dụng ưu đãi thuế quan EU GSP trung bình từ các nhà xuất khẩu Việt Nam là 53%. Xu hướng này cũng được khẳng định trong một cuộc điều tra nghiên cứu cũ của Dự ÁN MUTRAP trong giai đoạn 2005-2009.
Tuy nhiên, ở cấp độ sản phẩm cụ thể, việc tận dụng ưu đãi khá khác biệt, ví dụ trong khi mặt hàng tôm và tôm xuất khẩu mã sản phẩm HS160620 đạt được tỉ lệ tận dụng ưu đãi thuế quan lên tới 100% thì sản phẩm áo mã hàng HS611030 chỉ đạt được tỉ lệ khiêm tốn 40%.
Xu hướng không tận dụng hết những ưu đãi thương mại không chỉ giới hạn ở những ưu đãi GSP của Liên minh Châu Âu mà trên thực tế, Việt Nam đang cho thấy khả năng hạn chế của mình trong việc khai thác ưu đãi thương mại trong các Hiệp định Thương mại Tự do khối ASEAN.
Tỉ lệ này chứng minh thực tế rằng các nhà xuất khẩu Việt nam không khai thác được hết lợi ích về ưu đãi thuế quan ở những thị trường được ưu đãi, do vậy, họ cần có các cuộc trao đổi về khả năng thực thi RoO nhằm thỏa mãn các quy định của những thị trường xuất khẩu.
Như đã được thể hiện chi tiết trong báo cáo của Dự ÁN MUTRAP III, theo quy tắc xuất xứ trước đây, Việt Nam phải đối mặt với một loạt các khó khăn trong việc đáp ứng những đòi hỏi về quy tắc xuất xứ đối với các sản phẩm trong ngành hàng may mặc được quy định tại Chương 62, theo quy tắc xuất xứ của Liên minh Châu Âu, các mặt hàng may mặc phải có quy trình sản xuất kép vì không được phép sử dụng vải nhập khẩu để sản xuất ra sản phẩm.
Điều này cũng không được thay đổi trong quy tắc xuất xứ ESP mới của Liên minh Châu Âu. Tuy nhiên, quy tắc xuất xứ mới này lại có những yêu cầu thông thoáng hơn dành cho các sản phẩm xe mô tô và xe đạp, cho phép sử dụng nguyên vật liệu không có nguồn gốc xuất xứ trong sản phẩm lên tới 50%.
Đối với những yêu cầu về văn bản cũng như thực thi, việc tuân thủ RoO đi kèm với chi phí cả ở cấp độ công ty/nhà máy lẫn cấp độ quản lý và giám sát RoO. Những điều này đã được đề cập cụ thể trong nghiên cứu Dự ÁN MUTRAP III. Nghiên cứu đã chỉ ra rằng việc sẵn sàng thực thi RoO là chức năng của “sản lượng xuất khẩu đủ điều kiện để được đối xử ưu đãi, và thị phần hàng xuất khẩu đó trong tổng giá trị bán hàng và chi phí liên quan. Sau cùng, các khoản chi phí phát sinh trong việc vận hành hệ thống kế toán song song có thể lớn hơn lợi ích trong tỉ lệ ưu đãi theo một Hiệp định FTA cụ thể” .
Họ cũng củng cố những kết quả thu được từ nghiên cứu Đánh giá Dự ÁN MUTRAP được trích dẫn cho thấy tỉ lệ tận dụng ưu đãi thuế quan thấp trong hoạt động thương mại trong khu vực ASEAN. Quan điểm của các bên cho rằng trong các vòng đàm phán xây dựng FTA với Liên Minh Châu Âu tới đây, Việt Nam cần tìm đàm phán để được xem xét bình đẳng như một nước kém phát triển cũng như đòi hỏi các tiêu chí thông thoáng hơn dành cho các sản phẩm cụ thể được dành riêng cho nước kém phát triển như Việt Nam. Điều này hoàn toàn phù hợp với ngành may mặc khi Việt nam đang cho thấy mình là ví dụ điển hình của việc không tận dụng hết những ưu đãi thương mại do yêu cầu sản xuất kép, từ là phải tự đệt vải và hoàn thiện sản phẩm.
Tương tự, Việt Nam phải đòi hỏi các quy tắc xuất xứ thông thoáng hơn đối với ngành may mặc và dệt may trong các vòng đám phán với TPP vì gần đây, Mỹ đã đưa ra một số quy tắc xuất xứ theo mô hình yarn forward. Bảng sau đây cho thấy ví dụ về các quy định xuất xứ thông thoáng hơn.

Rõ ràng khi xem xét ví dụ được nêu ở bảng trên, cần phải tiến những phân tích sâu hơn nữa đối với từng dòng sản phẩm cụ thể để xác định những khu vực khác nơi các quy tắc xuất xứ thay thế có thể đồng nhất và soạn thảo theo hai kịch bản đàm phán. Trong trường hợp các cuộc đàm phán với TPP, Việt Nam phải rút ra những bài học kinh nghiệm từ các vòng đàm phán về quy tắc xuất xứ mà các nước Mỹ La tinh đã thực hiện với Mỹ. Trong đàm phán với Liên minh Châu Âu, Ngoài những ví dụ về sản phẩm cụ thể trên đây, còn có thể lấy một số ví dụ trong ngành điện tử và máy móc nhưng không chỉ giới hạn trong hai lĩnh vực này vì quy tắc xuất xứ mới của Liên minh Châu Âu theo EU GSP hỗ trợ tạo cơ hội kinh doanh mới. Tham vấn chuyên sâu với các nhà sản xuất Việt Nam cũng có thể có được những thông tin về các lĩnh vực cụ thể cần được phát triển và phù hợp các quy tắc xuất xứ gần đây của EU GSP để đưa vào các cuộc đàm phán FTA trong tương lai. Ngoài ra, các cuộc tham vấn này cũng hữu ích trong việc tăng cường nhận thức hơn nữa về các quy tắc xuất xứ mới của EU GSP cho các nhà sản xuất vì qua các cuộc hội thảo, nhận thức về các quy tắc xuất xứ mới trong cộng đồng doanh nghiệp Việt Nam vẫn còn nhiều hạn chế. Do vậy, cần tổ chức nhiều cuộc hội thảo chuyên ngành hơn nữa đề nâng cao hiểu biết về các quy tắc xuất xứ mới cũng như nhận biết được những cơ hội tiềm năng trong đó.
B. Cộng gộp
Việc nới lỏng các tiêu chí phân bổ nguồn gốc giữa các thành viên của một nhóm Khu vực là một bước tiến quan trọng theo quy tắc xuất xứ mới của GSP vì nó tạo điều kiện cho việc tận dụng các sản phẩm đầu vào trong khu vực gữa các thành viên trong cùng một nhóm khu vực. Bên cạnh đó Quy định mới cũng đưa ra khả năng cộng gộp giữa các nước ASEAN và SAARC.
Việc cộng gộp mở rộng theo chương trình GSP mới của Liên minh Châu Âu có tiềm năng mở ra nguồn cung ứng đầu vào thay thế cho các nhà xuất khẩu Việt nam cùng với tiềm năng thu hút vốn đầu tư trực tiếp nước ngoài, do vậy các nhà đầu tư trong và ngoài nước nên lựa chọn những yêu cầu RoO đơn giản hóa dành cho các sản phẩm trong ngành điện tử, máy móc, đồ chơi và gỗ nhiều triển vọng.

1. Khi hàng hóa xuất xứ tại quốc gia là thành viên của một nhóm khu vực được làm hoặc chế biến tại một nước khác trong cùng nhóm khu vực, thì sản phẩm sẽ mang xuất xứ tại quốc gia của nhóm khu vực nơi mà công đoạn chế biến hay sản xuất cuối cùng được thực hiện, với điều kiện:
(a)giá trị cộng gộp ở đây, được quy định tại đoạn 3, lớn hơn giá trị thuế nhập khẩu cao nhất của sản phẩm được sử dụng có xuất xứ tại bất cứ quốc gia nào trong nhóm khu vực, và
(b) công việc hay quá trình chế biến được tiến hành ở đó cao hơn mức được quy định tại Điều 70, và trong trường hợp là các sản phẩm dệt may, cũng có những quy định liên quan nêu tại Phụ lục 16.
Trường hợp sản phẩm được sản xuất trong nước được hưởng lợi của các Nhóm I (ASEAN) hoặc Nhóm III (SAAARC) sử dụng nguyên liệu có nguồn gốc ở một quốc gia thuộc nhóm khác để xuất khẩu sang thị trường EU, nguồn gốc của những sản phẩm đó phải được xác định như sau:
(a) nguyên liệu có nguồn gốc ở một quốc gia của một nhóm khu vực được coi là vật liệu có nguồn gốc ở một đất nước của nhóm khu vực khác khi kết hợp tạo ra sản phẩm tại đây, với điều kiện quá trình làm việc hoặc chế biến được thực hiện trong các nước được hưởng lợi thứ hai không nằm trong hoạt động được nêu trong Điều 78 (1) và, trong trường hợp sản phẩm dệt, cũng vượt ra ngoài các hoạt động quy định tại Phụ lục 16.
(b) Khi điều kiện quy định tại điểm (a) không được hoàn thành, các sản phẩm có nguồn gốc l của các quốc gia tham gia cộng gộp chiếm thị phần cao nhất của giá trị thuế nhập khẩu vật liệu được sử dụng có nguồn gốc ở các nước khác tham gia trong cộng gộp này.
Trong trường hợp quy định cũ theo đoạn (a) giá trị cộng gộp nguyên liệu được thực hiện tự động nếu trong trường hợp quy định mới theo đoạn (a) việc kiểm tra không được thực hiện trừ khi nguyên liệu nhập khẩu cho sản xuất, chế biến bị thiếu hụt như quy định tại điều 78 (1) cũng như các hoạt động được quy định tại Phụ lục 16 về sản phẩm dệt may
Việc cộng gộp mở rộng cấp theo yêu cầu gồm một số điều kiện có thể nhận biết dễ dàng ở đoạn 7 điều 86 của Quy định:
“Theo yêu cầu của bất cứ chính quyền của nước được hưởng lợi nào, Ủy ban có thể tiến hành cấp mở rộng cộng gộp giữa một nước được hưởng lợi và một quốc gia có ký kết hiệp định thương mại tự do với Liên minh châu Âu theo Điều XXIV của Hiệp định chung về Thuế quan và Thương mại (GATT) có hiệu lực với điều kiện từng điều khoản sau đây phải được đáp ứng:
(a) các nước tham gia cộng gộp đã thực hiện việc tuân thủ hoặc bảo đảm tuân thủ mục này và có sự hợp tác hành chính cần thiết để bảo đảm thực hiện đúng mục này đối với cả Liên minh châu Âu và giữa các bên.
(b) chủ trương nêu tại điểm (a) đã được nước hưởng lợi có liên quan thông báo cho Ủy Ban.
Các yêu cầu nêu trong phân đoạn tiên phải có danh sách các nguyên liệu liên quan đến quá trình cộng gộp và phải chứng minh được rằng các điều kiện quy định trong điểm (a) và (b) của phân đoạn thứ nhất được đáp ứng và do Ủy ban ấn định. Trường hợp thay đổi nguyên liệu liên quan, phải đệ trình bản yêu cầu mới. Nguyên liệu quy định từ chương 1 đến chương 24 trong Hệ thống Harmonized System không bao gồm cộng gộp mở rộng”.
Các điều kiện này có thể tóm tắt như sau:
Một, Quy trình cộng gộp mở rộng không mang tính tự động
Hai, Không áp dụng cộng gộp mở rộng cho các sản phẩm nông nghiệp
Ba, Tuân thủ một số thủ tục theo yêu cầu trong quá trình thực hiện.
“Chỉ thực tế mới chứng minh tính thực tiễn của các điều khoản đó” .
Trên thực tế, nguyên liệu đầu vào có nguốn gốc từ Mexico và Chi lê có thể hữu ích đối với Nhóm quốc gia MERCOSUR và các nước Châu Á mong muốn cộng gộp với nguyên liệu đầu vào của Hàn Quốc.
Trong các chương trình hội thảo cũng như tham vấn do VCCI tổ chức đã chỉ ra một vấn đề cần làm ngay, đó là đưa ra yêu cầu chính thức cho việc mở rộng cộng gộp với các Quốc gia thành viên của SAARC và quan trọng nhất là chương trình cộng gộp mở rộng với Hàn Quốc. Quy trình đòi hỏi chính phủ Việt Nam phải nhận diện được cấc bước cần thực hiện cũng như đảm bảo năng lực thực thi chuyên môn của mình.
C. Xuất xứ hàng hóa áp dụng cho sản phẩm cụ thể
Các bài trình bày định dạng powerpoint trong phần phụ lục phải thể hiện được các điểm nổi bật về lợi ích của Việt Nam trong RoO áp dụng cho sản phẩm cụ thể. Các bài trình bày phải bao gồm các mặt hàng dệt may và may mặc, điện tử, xe đạp/xe có động cơ, máy móc cùng với quy trình chế biến nông sản, trong đó bao gồm cả nghề nuôi trồng thủy sản.
Việt nam cần đặt mốc cho tỉ lệ tận dụng ưu đãi thuế quan đối với ngành da giày.
Trong quá trình thảo luận với các doanh nghiệp/nhà xuất khẩu nổi lên một vấn để cụ thể, đó là nhu cầu phải nhận diện và giải quyết các vấn đề hết sức cụ thể về kỹ thuật phát sinh từ quá trình tìm hiểu Quy định của Liên minh Châu Âu thể hiện hoàn toàn trong các văn bản pháp lý. Những văn bản này phải được chuyển ngữ theo ngôn ngữ chuyên ngành thương mại.
Như đã được nhắc lại nhiều lần rằng việc không tuân thủ quy định pháp lý về RoO sẽ ngay lập tức bị từ chối quyền tiếp cận các ưu đãi thuế quan-tức là các nhà nhập khẩu phải nộp thuế MFN khi làm các thủ tục hải quan.
Bảng Những câu hỏi thường gặp nhất dưới đây, theo một định dạng đơn giản, tóm lược những câu hỏi thu được từ các cuộc hội thảo trước đó cho thấy mức độ cần thiết phải giải thích rõ ràng tính đa dạng và cụ thể của các quy định xuất xứ.
Các doanh nghiệp đưa ra ví dụ của riêng mình chẳng hạn như mặt hàng thảm trong chương 62 và các sản phẩm làm từ cao su ở chương 40: đây là một dấu hiệu tích cực, cho thấy cam kết tuân thủ cũng như phù hợp với giấy chứng nhận xuất xứ nhằm đảm bảo cho các hoạt động kinh doanh được thành công.
Nói rộng hơn , những phân tích theo ngành/sản phẩm cụ thể là điều cần thiết để giải quyết những mục tiêu đầu tư và đa dạng hóa do Chính phủ Việt Nam đề ra.
Phụ lục IV cung cấp Ma trận So sánh RoO để minh chứng loại hình sản phẩm cụ thể cần được thực hiện.
A. Hợp tác quản trị hành chính
Ngày 1/1/2011, Ủy ban Châu âu chính thức áp dụng quy định nghĩa vụ tăng cường về hợp tác quản rị hành chính giữa các bên trao và nhận ưu đãi. Chuyển các chức năng giám sát và trao xuất xứ cho các nhà chức trách xác nhận nguồn gốc cho Người nhận, cơ chế quản trị RoO mới “thay đổi triệt để” các phương thức hoạt động cũng như thực tiễn thương mại.
Đối với VCCI, phần lớn phụ thuộc vào khả năng chuẩn bị cơ sở cho quá trình chuyển giao bắt đầu vào năm 2017 và hoàn tất vào năm 2020. Sát sao với các nhà xuất khẩu, kiến thức về thực tiễn sản xuất được trợ giúp từ hệ thống kế toán minh bạch và niềm tin lẫn nhau chin là những điều kiện tiên quyết cho hoạt động quản trị tối ưu và các cuộc đối thoại hai bên cùng thắng.
IV. ĐỊNH HƯỚNG
Chính phủ đề xuất vai trò và chức năng của VCCI như một tổ chức trung gian giải quyết các vấn đề thương mại giữa nhà nước và thành phần tư nhân. Điều đó cho thấy năng lực chuyên môn của VCCI nhằm nắm bắt rõ các công cụ quản lý thương mại cũng như giám sát chặt chẽ các xu hướng thương mại nhằm đưa ra các biện pháp khắc phục trong thời gian thực.
Sẽ có nhiều thách thức mới đối với Trung tâm Xác thực thông tin thương mại (CCCD) của VCCI vì các đối tác trao ưu đãi mà cụ thể là Liên minh Châu Âu đang từng bước nắm giữ nguyên tắc về hợp tác quản lý hành chính , chuyển gánh nặng quản lý RoO sang các đối tác thụ hưởng ưu đãi dự kiến.
Ngoài chức năng thẩm tra và cấp giấy chứng nhận xuất xứ như hiện nay, VCCI/CCCD phải hiểu biết một cách toàn diện các nhân tố thương mại, giám sát chặt chẽ thực tiễn sản xuất cũng như các hành vi thương mại của họ.
Do các nước kém phát triển LDC đang nổi lên như những đối thủ tiềm năng trong viễn cảnh thương mại đa phương, và kết quả từ việc tiếp cận thị trường phi hạn ngạch/phi thuế quan cũng như các quy tắc xuất xứ thông thoáng hơn, vì vậy yêu cầu bức thiết mà VCCI phải thực hiện đó là đưa ra các giải pháp thay thế cho thành phần kinh tế tư nhân nhằm điều chỉnh và đa dạng hóa thành công một khi xuất hiện cơ hội từ lộ trình thuế quan đã đàm phán cũng như từ quá trình thực thi tự do hóa thương mại chung.
Để duy trì được đà này, VCCI/CCCD có thể:
Tổ chức các sự kiện phân cấp về Tiếp cận Thị trường và Quy tắc xuất xứ nhằm giải quyết các yêu cầu và lợi ích của thành phần kinh tế tư nhân trong việc nhắm mục tiêu vào các thị trường cung ứng/điểm đến khác nhau. Điều này sẽ tạo điều kiện thuận lợi trong việc sử dụng các ưu đãi thuế quan dành cho các nhà xuất khẩu Việt Nam nhằm tối ưu hóa tiềm năng xuất khẩu của họ cũng như năng lực sản xuất tổng thể của Việt Nam.
Tập trung vào quy trình cộng gộp khu vực và cộng gộp mở rộng với các Đối tác thương mại thuộc Nhóm I [ASEAN] và Nhóm III [SAARC] với điều kiện phải tuân thủ Quy định EU-GSP mới. Điều kiện để Bên (các Bên) được hưởng lợi dự kiến đạt được yêu cầu chính thức là việc ban hành quy trình quản lý hành chính cần thiết như là bước đầu tiên hướng tới việc hưởng lợi từ sự linh hoạt trong phương pháp cộng gộp mới của EU-GSP. Đối với VCCI/CCCD, điều này cho thấy nỗ lực đáng ghi nhận trong việc phối hợp mang tính xây dựng với các bên đối trọng của các Nhóm liên quan chịu trách nhiệm cho việc thẩm định, cấp chứng nhận RoO cũng như quản lý tổng thể RoO.
Phát triển mô hình kinh doanh thân thiện về công cụ thương mại đa phương cũng như nguyên tắc pháp lý của chúng [ví dụ, nội dung của trang web hiện nay cung cấp khả năng tiếp cận các con số thống kê thương mại và các nguồn thông tin thương mại điện tử trực tuyến. Trang web cũng được chuyển ngữ sang tiếng Anh và đặc biệt, mục tiêu trở thành Cổng thương mại toàn diện tạo điều kiện thuận lợi cho việc quản lý giấy chứng nhận điện tử và cung cấp thông tin thương mại trong thời gian thực. Việc này sẽ tạo ra trang cơ sở dữ liệu cho các nhà xuất khẩu đã đăng ký khi Việt Nam đang từng bước chuyển đổi để phù hợp với các yêu cầu tiêu chuẩn chất lượng của các đối tác thương mại trong khu vực cũng như trên toàn thế giới.
Đạt được năng lực nội tại để thực hiện các mô phỏng thương mại về lộ trình tự do hóa thuế quan nhằm tối ưu hóa lợi ích từ các cuộc đàm phán thương mại.
