The Ombudsman found no maladministration with regard to the European Parliament’s decision to reject a complainant’s bid following a call for tenders. However, he pointed out that a statement Parliament had made concerning its discretion in such procedures did not seem to be borne out by the text of the call for tenders in this particular case or to be consistent with the principles of good administration regarding the exercise of discretionary powers.

Source text - French Pour le 22 décembre 2011 au plus tard, les États membres doivent procéder à une évaluation préliminaire des risques. Celle-ci comprend des informations relatives, à l'emplacement des bassins hydrographiques, à l’historique des inondations, leur probabilité de retours et aux conséquences estimées de celles-ci.
Sur la base de cette évaluation, les États membres doivent classer les bassins hydrographiques soit comme zone à risque potentiel significatif, soit comme zone ne présentant pas de risque significatif.
Pour toutes les zones identifiées comme présentant un risque d'inondation, les États membres doivent établir des cartes identifiant lesdites zones, la probabilité (forte, moyenne ou faible) d'inondation pour chacune d'elles, ainsi que les dommages potentiels pour les populations locales, les biens et l'environnement.
Translation - Romanian Pâna la 22 decembrie 2011 cel mai târziu, statele membre trebuie să efectueze o evaluare preliminară a riscurilor. Aceasta include informații referitoare la amplasarea bazinelor hidrografice, istoricul inundațiilor, probabilitatea de revenire şi consecințele estimate ale acestora.
Pe baza acestei evaluări, statele membre trebuie să clasifice bazinele hidrografice fie ca zonă de risc potenţial semnificativ, fie ca zonă care nu prezin risc semnificativ.
Pentru toate zonele identificate ca fiind expuse riscului de inundații, statele membre trebuie să stabilească hărți de identificare a acestor zone, probabilitatea (ridicată, medie sau scăzută) de inundare pentru fiecare, precum și pagubele potenţiale pentru popută nici unlația locală și mediul înconjurător.
