Sentence appeals
The Crown (DPP) can appeal against a sentence on the grounds that it is inadequate or too lenient. An offender may appeal as of right to the District Court against a sentence imposed in the Local Court. An offender can appeal directly to the Supreme Court against such a sentence only on a question of law. An offender sentenced in the District or Supreme Court may seek leave (permission) to appeal to the Court of Criminal Appeal to have the sentence reduced.
A sentence appeal to the District Court from the Local Court is a rehearing of the case. This means that the judicial officer hearing the sentencing appeal will reconsider all of the evidence presented in the initial sentencing hearing. The judicial officer will usually undertake this task by reading all documents tendered at the Local Court hearing. The defence might also call witnesses to provide further evidence as to why the sentence is too harsh. The defence and prosecution will then make (usually oral) submissions.
An appeal to the Court of Criminal Appeal from a sentence imposed in the District Court or the Supreme Court will only be successful if the sentencing judge is found to have committed a legal error, including imposing a sentence that was manifestly lenient or excessive.
In very special circumstances, an appellant might be able to seek leave (permission) to appeal to the High Court against the severity of a sentence. This is the highest court in Australia.
An appellant may have bail continued or granted while waiting for the appeal even if they were given a prison sentence.

Apelaciones contra sentencia
La corona (o en su nombre el fiscal - DPP por sus siglas en inglés) puede apelar en contra de una sentencia sobre la base de que la misma sea inadecuada o indulgente. El imputado tiene derecho de apelar a la corte distrital en contra de una sentencia dictada por la corte local. El imputado puede apelar directamente a la corte suprema en contra de dicha sentencia solo si hay cuestionamientos de ámbito legal. El imputado sentenciado en la corte distrital o en la corte suprema puede solicitar dispensa( permiso) de apelar a la corte de apelaciones criminales para reducir su sentencia.
Una apelación contra sentencia a la corte distrital desde la corte local implica una nueva audiencia del caso. Esto quiere decir que el funcionario judicial a cargo de la audiencia de apelación contra sentencia reconsiderará toda la evidencia que se presentó en la audiencia inicial. Para llevar a cabo esta tarea el funcionario judicial lee todos los documentos presentados en la audiencia de la corte local. La defensa también podrá llamar a testigos para que provean de más pruebas que indiquen la razón por la cual consideran que la sentencia impuesta ha sido muy dura. Una vez realizado esto, la defensa y la fiscalía entregarán sus ponencias (normalmente de forma oral) .
Una apelación a la corte de apelaciones criminales, por una sentencia impuesta en la corte distrital o en la corte suprema, tendrá éxito solo si se comprueba que el juez que emitió la sentencia cometió un error de derecho, incluyendo la imposición de una sentencia indiscutiblemente dura o indiscutiblemente indulgente.
En situaciones muy especiales, el apelante puede tener la facultad de solicitar dispensa (permiso) para recurrir a la corte superior en contra de la severidad de una sentencia. Esta es la corte de mayor jurisdicción en Australia.
El imputado puede tener una fianza ya impuesta o se le puede otorgar una fianza mientras espera el resultado de la apelación aún cuando se haya emitido una sentencia condenatoria.
