Source text - English 5.1. The Seller guarantees quantity and quality of the Goods. The Goods delivered under the Contract will be considered as accepted by quantity according to the quantity stipulated in the invoice. If damage is found, Buyer should immediately contact with the Seller. A third party expert should investigate and report the damage.
If the pallets are missing or delivered with damage, Buyer should indicate it on the CMR or Bill of Lading. Otherwise, Seller will not be responsible since insurance will not be valid under these circumstances.
The Buyer must notify the Seller about the fact of the damaged GOODS in writing form within 10 (ten) days from the moment of its arrival to the address of the Buyer.
Translation - Russian 5.1. Продавец гарантирует качество и количество товара. Поставленный по настоящему Контракту товар будет считаться принятым по количеству, указанному в счёте-фактуре. При обнаружении повреждений Покупатель должен немедленно связаться с Продавцом. Независимый эксперт должен провести осмотр и составить отчет о повреждениях. Если палет нехватает или же они доставленны в повреждённом виде, Покупатель должен указать данное обстоятельство на СМR или же на Траспортной Накладной. В противном случае Продавец не будет ответсвенным, так как страхование не может быть действительным в данной ситуации.
Покупатель обязан известить Продавца о факте повреждения товара в письменной форме в течение 10 (десяти) дней с момента получения товара на свой адрес.
