წინამდებარე თავში ასახულია საქართველოში ეროვნულ უმცირესობებთან დაკავშირებული პრობლემატიკა და გაანალიზებული და შეფასებულია სამოქალაქო ინტეგრაციის პროცესი.
საანგარიშო პერიოდში ეთნიკური ნიშნით დისკრიმინაციის შესახებ სახალხო დამცველისთვის განცხადებით არავის მოუმართავს.
2011 წელს გაგრძელდა და განხორციელდა 2009–2010 წლებში შემწყნარებლობისა და სამოქალაქო ინტეგრაციის ეროვნული კონცეფციისა და სამოქმედო გეგმის ფარგლებში წამოწყებული მნიშვნელოვანი ინიციატივები.
2009 წელს „უმაღლესი განათლების შესახებ“ კანონში შეტანილი ცვლილებით აზერბაიჯანულენოვანი, სომხურენოვანი, ოსურენოვანი და აფხაზურენოვანი აბიტურიენტებისთვის გამარტივდა ეროვნული გამოცდების ჩაბარების წესი, რითაც მნიშვნელოვნად გაიზარდა ეთნიკური უმცირესობებისთვის უმაღლესი განათლების ხელმისაწვდომობა. მიმდინარე წელს საგამოცდო ბარიერი 250–მა აზერბაიჯანულენოვანმა და 179–მა სომხურენოვანმა მოქალაქემ გადალახა. სახელმწიფო სასწავლო გრანტით 2011 წლის ერთიანი ეროვნული გამოცდების ზოგადი უნარების აზერბაიჯანულენოვანი ტესტის შედეგების საფუძველზე დაფინანსდა 98 აბიტურიენტის სწავლა, ხოლო სომხურენოვანი ტესტის საფუძველზე - 99-ისა.
პოზიტიურ ცვლილებათა ნუსხაში შეგვიძლია შევიტანოთ არაქართულენოვან სკოლებში ქართული ენისთვის გამოყოფილი საათების გაზრდა და ცალკეულ საჯარო სკოლაში ბილინგვური სწავლების დანერგვა-განვითარება. უმცირესობებით კომპაქტურად დასახლებულ რეგიონებში ამაღლდა სახელმწიფო ენის შესწავლის მოტივაცია.
აღსანიშნავია ინფრასტრუქტურის განვითარებისკენ მიმართული მასშტაბური ღონისძიებები. 2011 წელს გაიხსნა ახალქალაქი–წალკა–თბილისის რეაბილიტირებული გზა, რომელიც უკვე მნიშვნელოვან როლს ასრულებს რეგიონების სოციალურ–ეკონომიკური განვითარებისა და ინტეგრაციის საქმეში.
2010 წლიდან საზოგადოებრივი მაუწყებლით უმცირესობათა ენებზე ყოველდღიური საინფორმაციო პროგრამები გადაიცემა, რომლებიც პირველი და მეორე არხის გარდა ქვემო ქართლისა და სამცხე–ჯავახეთის რეგიონული ტელევიზიებითაც ტრანსლირდება, თუმცა საინფორმაციო პროგრამების ფორმატით ეთნიკურ უმცირესობებთან დაკავშირებული მოვლენები სრულფასოვნად ვერ შუქება, რაც მოსაგვარებელი პრობლემების რიცხვს განეკუთვნება.
პრეზიდენტი და ხელისუფლების სხვა წარმომადგენლები საჯარო გამოსვლებისას მუდმივად ხაზს უსვამდნენ ეთნიკური მრავალფეროვნების დაცვის, სამოქალაქო ინტეგრაციის ხელშეწყობის, თანასწორუფლებიანი გარემოს დამკვიდრების აუცილებლობას. ინტეგრაციის პროცესის წარმართვაში ჩართული არიან რეინტეგრაციის საკითხებში სახელმწიფო მინისტრი და სხვა ცენტრალური თუ რეგიონული სახელმწიფო უწყებები. ცალკე უნდა აღინიშნოს პრეზიდენტის ადმინისტრაციასთან არსებული ტოლერანტობისა და სამოქალაქო ინტეგრაციის საბჭოს საქმიანობა. უმცირესობათა საკითხებისადმი განსაკუთრებულ ყურადღებას იჩენს საქართველოს ეროვნული უშიშროების საბჭო.
მიმდინარე ეტაპზე, შეიძლება ითქვას, რომ საქართველოს სახალხო დამცველთან არსებული ეროვნული უმცირესობების საბჭო კვლავ ცენტრალურ საკონსულტაციო ფუნქციას ასრულებს როგორც სახალხო დამცველის, ასევე ინტეგრაციის პროცესში ჩართული სახელმწიფო უწყებებისთვისაც.
ამ დადებითი ტენდენციების მიუხედავად, სამოქალაქო ინტეგრაციისა და უმცირესობების უფლებების დაცვის მხრივ კვლავ არაერთი კონკრეტული და სისტემური პრობლემაა გადასაჭრელი, რომელთაგან ერთ–ერთი ყველაზე რთულად დასაძლევია ეთნიკური უმცირესობების პოლიტიკურ, კულტურულ და საზოგადოებრივ ცხოვრებაში არასაკმარისი მონაწილეობის აღმოფხვრა. უმცირესობები მცირე რაოდენობით არიან წარმოდგენილი ცენტრალური ხელისუფლების დონეზე – პარლამენტში და აღმასრულებელი ხელისუფლების უწყებებში. პრობლემატური და აქტუალურია უმრავლესობისა და უმცირესობების ჯგუფებს შორის არსებული ურთიერთგაუცხოება და ნეგატიური სტერეოტიპებით მოცული განწყობა.
საანგარიშო პერიოდში კვლავ იყო შემთხვევები ამა თუ იმ პოლიტიკოსის ეთნიკური წარმომავლობის საბაბით დისკრედიტაციის მცდელობისა. საქართველოს პარლამენტის მიერ რელიგიური გაერთიანებების რეგისტრაციის შესახებ სამოქალაქო კოდექსში შეტანილ ცვლილებებს, სამწუხაროდ, ქსენოფობიისა და კონკრეტულად, არმენოფობიის მასშტაბური გამოვლინება მოჰყვა (იხ. რელიგიის თავისუფლება და ტოლერანტული გარემო).

განათლების ხელმისაწვდომობა / ენის სწავლება
• სახელმწიფო ენის სწავლება
განათლებისა და მეცნიერების სამინისტრომ 2011 წელს დაიწყო ახალი პროგრამის - “ქართული ენა მომავალი წარმატებისთვის“ განხორციელება, რომელიც ეროვნული უმცირესობებით კომპაქტურად დასახლებულ რეგიონებში მაგისტრი სტუდენტების მივლენას ითვალისწინებს. ამ პროგრამით საანგარიშო პერიოდში სხვადასხვა რეგიონის სოფლებში 140 ახალგაზრდა გაიგზავნა, რომლებიც ადგილობრივ მოსწავლეებსა და სხვა მსურველებს სახელმწიფო ენას ასწავლიან.
2011 წელს გაგრძელდა 2009 წელს დაწყებული პროგრამა „ვასწავლოთ ქართული, როგორც მეორე ენა“. ამ პროგრამის ფარგლებში ქვემო ქართლისა და სამცხე ჯავახეთის რეგიონების სხვადასხვა სკოლაში 69 პედაგოგია მივლენილი. პროგრამა ხელს უწყობს ენის ცოდნის დონის ამაღლებას როგორც სკოლის მოსწავლეებში, ასევე პედაგოგებში. ამის დამადასტურებელია ისიც, რომ ამ სკოლების მოსწავლეების დიდმა უმრავლესობამ (განათლების სამინისტროს მონაცემებით) წარმატებით გადალახა საატესტატო გამოცდების ბარიერი ქართულ ენაში.
2011 წელს შეიქმნა და გამოიცა დაწყებითი საფეხურის I-IV დონის ქართულის, როგორც მეორე ენის სახელმძღვანელოები, რომლებიც არაქართულენოვან სკოლებში დარიგდა. სახელმძღვანელო შედგება მოსწავლის წიგნისა და სამუშაო რვეულისგან.
2011 წლისთვის განათლებისა და მეცნიერების სამინისტრომ „ქართული ენის პროგრამის” ფარგლებში დააფინანსა სამცხე-ჯავახეთში ნინოწმინდისა და ახალქალაქის ქართული ენის სახლები, ხოლო ქვემო ქართლში - დმანისის, მარნეულის, ბოლნისისა და გარდაბნის ქართული ენის ცენტრები. აღსანიშნავია, რომ 2011 წლის 1 ოქტომბრიდან ქართული ენის სახლებსა და ცენტრებს ადმინისტრირებას უწევს ზურაბ ჟვანიას სახელობის სახელმწიფო ადმინისტრირების სკოლა.
უნდა ითქვას, რომ აღნიშნული პროგრამები ისევე, როგორც ეროვნული უმცირესობებით დასახლებულ რეგიონებში მოქმედი „ენის სახლები,“ დადებით როლს ასრულებს სამოქალაქო ინტეგრაციის თვალსაზრისით. დღეის მდგომარეობით მსურველების მნიშვნელოვან ნაწილს საშუალება ეძლევა, შეისწავლოს სახელმწიფო ენა ქვემო ქართლსა და სამცხე-ჯავახეთში.
Translation - English Rights of National Minorities and Support to Civic Integration
The present chapter describes problems related to national minorities in Georgia as well as analyzes and evaluates the process of civic integration.
In the reporting period, the Public Defender received no complaints related to discrimination on ethnic grounds.
The important initiatives, launched in 2009-2010, in the framework of the National Concept and Action Plan for Tolerance and Civic Integration, were sustained and implemented throughout 2011.
In 2009, the Law of Georgia on General Education was amended. According to the amendments, the rule for passing the unified national exams by Azerbaijani, Armenian, Ossetian and Abkhazian speaking school leavers was simplified, hereby significantly improving the access of ethnic minorities to higher education. This year, 250 Azerbaijani speaking and 179 Armenian speaking citizens overcame the entry threshold. In 2011, based on the results of the unified national exams, general skills test in Azerbaijani and Armenian languages, the study of 98 Azerbaijani and 99 Armenian speaking entrants was financed from the State study grants.
Increasing the number of hours for the Georgian language teaching in non-Georgian schools as well as introducing and developing bilingual education programmes in some public schools can be considered as positive developments. The motivation for learning State language has increased in the regions densely populated by minorities.
The large-scale activities aimed at development of infrastructure are also worth mentioning. In 2011, the rehabilitated Akhalkalaki-Tsalka-Tbilisi highway was opened, which already plays an important role in social-economic development and integration of the regions.
Since 2010, the GPB provides daily news programmes in minority languages. Apart from First and Second Channels, those programmes are broadcasted by Kvemo-Kartli and Samtskhe-Javakheti regional TV stations. However, the format of news programmes, does not ensure complete coverage of the developments pertinent to national minorities and this problem should be resolved.
During public speeches the President and other governmental officials constantly highlighted the need for protecting ethnic diversity, supporting civic integration and creating equal environment. The State Minister on Reintegration as well as other central and regional structures are involved in managing the integration process. In this regard activities of the Tolerance and Civic Integration Council under the President of Georgia deserve special mention. The National Security Council of Georgia pays particular attention to the minority-related issues.
At this stage, the Council of National Minorities under the Public Defender’s Office still plays a key advisory role for the Public Defender as well as other State agencies involved in the civic integration process.
Despite the afore-mentioned positive trends, a number of concrete and systemic problems related to civic integration and protection of minority rights still persist. One of the main challenges is ensuring increased participation of ethnic minorities in political, cultural and social processes. The ethnic minorities are underrepresented on central level - parliament and executive bodies. The majority-minority attitudes towards each other and negative stereotypes are also problematic.
During the reporting period, attempts of discrediting some politicians on ethnic grounds were still observed. The amendments to the Civil Code on registration of religious associations, adopted by the Parliament, were unfortunately followed by mass manifestations of Xenophobia and Armenophobia (please refer to the part on Freedom of Religion and Tolerance Environment).
The representatives of ethnic minorities frequently emphasize the issues related to their historic monuments and preservation of their cultural identity. Azerbaijani and Armenian theatres, the David Baazov Museum as well as other historic and religious monuments are in the hazardous conditions (please refer to the part on Freedom of Religion and Tolerance Environment).
Special attention should be drawn to the problems of small ethnic communities, their language, identity and preservation of culture.
Access to education/learning the language
Learning the State Language
In 2011, the Ministry of Education and Science of Georgia launched implementation of a new programme “Georgian Language for Future Success,” which envisages sending of postgraduate students to the regions densely populated by national minorities. During the reporting period, in the frames of the programme, 140 young students were sent to the villages of different regions to teach Georgian language to local pupils and other interested parties.
In 2011, implementation of the programme, “Let’s Learn Georgian as a Second Language,” launched in 2009, continued. In the frames of the programme, 69 teachers are sent to the various schools of Kvemo-Kartli and Samtskhe-Javakheti regions. The programme facilitates enhanced knowledge of the language among school pupils as well as teachers. The vast majority of the pupils of the mentioned school (in accordance with the data provided by the Ministry of Education and Science) successfully overcame the barrier of the attestation exams in the Georgian language.
In 2011, the textbook, Georgian as a Second Language for the I-IV level beginners, was elaborated, published and distributed among non-Georgian schools. The textbook is composed of the pupil’s book and workbook.
By 2011, the Ministry of Education and Science of Georgia, in the frames of the “Georgian Language Programme,” financed so called “Georgian Language Houses,” in Samtkshe-Javakheti, Ninotsminda and Akhalkalaki, while in Kvemo-Kartli - Dmanisi, Marneuli, Bolnisi and Gardabani, Georgian Language Centers were financed.
It should be noted that the mentioned programmes as well as the “Language Houses” operating in the regions densely populated by national minorities play a positive role for civic integration. At this stage, significant number of interested persons in Kvemo-Kartli and Samtskhe-Javakheti has possibility to learn State language.

2011 წლის იანვრიდან საქართველოში ამოქმედდა ახალი საგადასახადო კოდექსი. აღნიშნული კანონი ისევე, როგორც მანამდე მოქმედი, რელიგიური ორგანიზაციების საქმიანობას არ მიიჩნევს ეკონომიკურ საქმიანობად და შესაბამისად არ ბეგრავს რიგი გადასახადებით, თუმცა ეს წესი ყველა რელიგიური ორგანიზაციისათვის ერთნაირი არ არის.
საქართველოს საგადასახადო კოდექსის მე–2 მუხლის თანახმად: „საქართველოს საგადასახადო კანონმდებლობა შედგება საქართველოს კონსტიტუციის, საერთაშორისო ხელშეკრულებებისა და შეთანხმებების, ამ კოდექსისა და მათ შესაბამისად მიღებული კანონქვემდებარე ნორმატიული აქტებისაგან“. მიუხედავად იმისა, რომ ხსენებული ნორმა საგადასახადო კანონმდებლობის შემადგენელ ნაწილად არ განიხილავს „საქართველოს სახელმწიფოსა და საქართველოს სამოციქულო ავტოკეფალურ მართლმადიდებელ ეკლესიას შორის” კონსტიტუციურ შეთანხმებას, ის მაინც საგადასახადო კანონმდებლობის შემადგენელი ნაწილია. სწორედ ამ შეთანხმებით არის გათვალისწინებული საქართველოს სამოციქულო ავტოკეფალურ მართლმადიდებელ ეკლესიისათვის განსხვავებული საგადასახადო პირობები და განსაზღვრულია გადასახადები, რომელთაგანაც ის გათავისუფლებულია.

Translation - English Tax Regime
Since January 2011 new Tax Code operates in Georgia. The mentioned Code, as well as the previous one, does not deem activities of the religious organization as economic ones and accordingly exempts them from a number of taxes. However, this rule is not the same for all religious organizations.
According to Article 2 of the Tax Code of Georgia “the tax legislation of Georgia comprises Constitution of Georgia, international treaties and agreements, the present Code and by-laws adopted in compliance with the mentioned acts.” Despite the fact that mentioned provision does not define the Constitutional Agreement between the State and the Apostolic Autocephalous Orthodox Church of Georgia as part of tax legislation, this agreement forms part of tax legislation. The mentioned agreement envisages different tax regime for Apostolic Autocephalous Orthodox Church of Georgia and defined taxes from which Orthodox church is exempted.
The aim of this chapter is not discussion of the appropriateness of tax benefits defined by the Agreement between the State and the Apostolic Autocephalous Orthodox Church of Georgia. The similar tax benefit should be equally accessible to other religious organizations and this issue might be regulated by the legal act with lower hierarchy than constitutional agreement.
The Tax Code of Georgia links profit tax with economic activities. In compliance with Georgian legislation, the profit tax payer is a non-profit legal entity, except for the cases when it runs economic activities. In accordance with the first part of Article 9 of Tax Code, the economic activity is defined as any activity for getting profit, income or compensation, despite of the results of such activity, unless otherwise defined by the legislation. In accordance with second part of the same article, religious activity is not considered as economic activity.
The Tax Code defines religious activities as activities carried out by persons registered as religious organization (religious organization is an organization created for carrying out religious activities and is registered as such in accordance with the legislation), and not as activities carried out by any person. At the same time, it is noteworthy that organizational-legal form of Apostolic Autocephalous Orthodox Church of Georgia does not fit into the mentioned definition, as it represents Legal Entity of Public Law and not Non-Profit Legal Entity. Despite of the mentioned, coming out from the Constitutional Agreement, Apostolic Autocephalous Orthodox Church of Georgia should be considered as religious organization registred in accordance with legislation.

I. Discussion
A. Campaign Disputes
One of the most difficult areas in which to obtain an effective remedy for an alleged violation of electoral laws and rules is that of behavior that occurs during the pre-election campaign. For reasons similar to those relating to media conduct, it is very difficult for electoral authorities to assess the legality and significance of alleged campaign violations; and it is also challenging for them to devise and impose appropriate sanctions. Few campaign violations by a political candidate or party rise to the level where de-registration of candidacy could be justified, at least during the electoral period; and imposing other sanctions after-the-fact is unlikely to be effective either as a preventative or punishment during the election itself.
It is common for election laws to assign responsibility for enforcing election rules during the campaign to the courts. Not only may the drafters of election laws be unsure of the full range of conduct that may be at issue during the campaign, but also distinctions among violations based on the nature of the violation and the status of the violator (State body or official, local government or employee, opposing political candidate or party, agents or supporters of opposing candidates or parties) may vary widely. Thus it may appear that such matters should be left to case-by-case determination, making them suitable for judicial consideration.
Even when responsibility for enforcement of campaign or related rules is explicitly assigned to the courts through electoral legislation, that often does not clearly address important elements needed to guide the courts in exercising their jurisdiction. For example, the nature of the legal action (e.g., administrative, civil or criminal) is often not made clear; nor are the types of potential defendants (see previous paragraph) and/or available sanctions. In addition, the time limits applicable to electoral cases – which are often highly expedited – may conflict with the normal time periods under general procedural codes; and the judges are generally inclined to adhere to the latter, with which they are more familiar.

Source text - English The Ambassadorial Working Group (AWG) continues to follow closely developments related to the election environment in the country.
The AWG strongly supports country's democratic development, and in particular the fundamental principles of free and fair elections, a level playing field for all participants, equal access to media, and respect for the rule of law.
In this context, the AWG urges all political parties and authorities at all levels to adhere to the 17 point code of conduct proposed by the campaign ‘This Affect You Too’, and to respect both the election results validated by the Central Election Commission, and a process assessed by independent international observer organizations, in the first instance the OSCE/ODIHR, as having met international standards and norms.
The AWG also underlines the important role played by civil society organizations (CSOs), and reminds all parties that CSOs and independent observer organizations should be allowed to operate without any undue pressure or interference.
The AWG urges all political parties to adhere to the abovementioned proposals in the interest of advancing Georgia’s democratic development by ensuring free and fair parliamentary elections.
As also noted in our previous statement, the AWG welcomes the improved access to a diversity of media sources, which was made possible with the “must carry/must offer” legislation. Given the fact that some areas in Georgia have little access to cable television, the AWG encourages consideration of ways to further support wider access to free media beyond areas covered by cable television, especially in the regions of Georgia.
The AWG believes that all political parties bear the responsibility for ensuring free and fair parliamentary elections and continues to support all efforts to this end.

I have graduated from the State University of Georgia with a masters degree in Law. Throughout 2002-2014, for over 12 years, I worked for advancement of democratic reforms in Georgia, including in the field of elections, legislative reform, protection and promotion of human rights. I started my carrier by working for country’s largest election watchdog NGO. After two years of working in NGO sector, I continued my carrier with international organizations such as International Institute for Democracy and Electoral Assistance (International IDEA), Organization for Security and Cooperation in Europe (OSCE) and United Nations Development Programme (UNDP).
While working with NGO sector and international organizations, one of my major assignments, among others, included provision of translation services from Georgian into English and vice versa as well as proof reading of already translated materials. Since my work was quite diverse, I have provided translations involving a wide range of issues including elections, media, minorities, persons with disabilities, women, political parties, legislation, education, taxes. In addition, I worked as a free lance translator and provided respective services to various international organizations and private companies. I have performed proof reading of several publications translated from English into Georgian.
