Source text - English TERMS AND CONDITIONS OF MEMBERSHIP PROGRAM
1DEFINITIONS
"Jimpower", "us", "our", "we" means Jimpower Trading Limited, its subsidiaries, group companies, and www.jimpower.ae;
"Program" means the Jimpower Membership Program;
"Member ID" means the unique identifying code provided to you by Jimpower;
"Website" means Jimpower’s website at www.Jimpower.ae;
The “Client” “ you” ,”your” “he /she” is a person who is 18 years or older and or an entity who / which has registered and has been accepted on the Jimpower website including satisfactorily completing the applicable verification requirements in accordance with General Terms and Conditions;
The “Member” a Client placing an order trough the Jimpower Membership Program;
The “Bars” mean gold being not less than 99.5% purity, sold by to the Client.
2. PURPOSE OF AGREEMENT
2.1 runs a membership Program which allows JimpowerClient to earn a portion of the commission charged on trades made by Clients they have referred to Jimpower by becoming a “Member”.
2.2The following terms and conditions are applicable for all contract that are concluded between an entrepreneur and Jimpower via the online shop.
2.3An entrepreneur means natural or legal person or a partnership with legal personality who or which, when entering into a legal transaction, acts in exercise of his or its trade, business or profession.
2.4The Client affirms that he acquires Bars from Jimpower solely in exercising his commercial or independent professional activity.
3.OBLIGATIONS AND ELIGIBILITY
3.1 To become a Member:
(a) you must be at least 18 years old;
(b) you must satisfactorily meet our assessment criteria, which will be determined at our sole discretion;
(c) you must be an entrepreneur who acts in exercise of your trade, business or profession;
(d) you must hold a verified Jimpower Account and abide by the JimpowerGeneral Terms and Conditions. Should you close your Jimpower Account or no longer be eligible for a Jimpower Account, you will no longer be eligible to participate in the Program.
3.2By registering for our Program and in agreeing to these terms, you represent that you are doing so for the purposes of your business, and that you are not acting for any purpose outside your business.
3.3 You warrant that you are suitable and will continue to remain suitable for our Program. We may reject or cancel your application or terminate your participation in the Program should we determine that you are unsuitable or becomes unsuitable for our Program.
3.4You agree that you will not promote any illegal activity, including, but not limited to warez, cracking, and hacking sites.
3.5 It is your responsibility to ensure your own compliance with the laws and regulations of the jurisdiction in which you reside, including, but not limited to, any requirements relating to disclosure of commissions, data protection, and tax. You may not participate in the Program where doing so would be prohibited by any applicable law or regulation.
3.6 You must inform potential customers that you will receive a commission if they open a Jimpower Account with your referral code and buy precious metals.
4MEMBERSHIP PROGRAM
4.1The Client can purchase Bars directly or register one or more order types under the terms of the Jimpower Membership Program.
4.2To make an order under the Program, the Client must:
- register under Program with a referral link provided from who is already a Member or from Jimpower;
- provide Jimpower with such information as Jimpower may require or request in relation of this Agreement, including all information required to comply with all applicable laws and regulations, including all applicable anti-money laundering rules and regulations. Without prejudice to the generality of the foregoing, as conditions to buy precious metals from Jimpower the Client must provide a minimum of one accepted form of government issued photographic identity documents and a proof of address;
- accept JimpowerGeneral Terms and Conditions;
- choose one order typein his /her Jimpower Account panel;
- make a down payment according the value of the order type;
- make a payment for Jimpower Account service.
4.3 With the order, the Client shall declare acceptance of a contractual offer.
4.4 If the Client makes an order adhering to the Program, he /she becomes a Member and can take advantage of the favorable terms of payment for the purchase of Bars under the Program.
4.5Order payment according to the invoice can be carried out at its own expense, with reward units credited through the Jimpower Membership Program or a combination of the two.
4.6 If the Member wishes to place an order for all types simultaneously then the member will have to do the registration five times for the five order types and the Member will receive five different login credentials.
5. RULES AND REGULATIONS OF THE PREMIUM CLASS TABLE.
5.1To participate to Premium Class Table, the Member must:
Place an order for Bars for the value of Eur 7,000;
Make a down payment of Eur 210, including a subscription fee for system service of Eur 10.
Premium Class Table is of 4-2-1 structure, consists of 1 cycle, and is designated for the transitioning of the Members’ order to the Business Class Table.
Premium Class Table consists of 3 levels and includes 7 orders from Members
Level 1- 4 orders
Level 2 – 2 orders
Level 3 – 1 order
5.2 Incoming order are placed on the first level. Once the first level is filled, the table splits into 2 symmetric table of orders and the Member’ order moves down to the second level. At the first level of each 2 new tables of orders 4 new empty places are formed for new member order.
By the next table division credit bonus are charged on the Member’s order and the Member’s Order is automatically transferred to the first cycle of the Business Class Table and the Member will receive 800 Credit Bonus. In this case 1 credit bonus is equivalent to 1 Eur.
710 credit bonus are used to the transaction to Business Class Order, 90 credit bonus, less 10% for processing fee, will credited in Credit Bonus E-Wallet in order to purchase Bars.
5.3The qualification criteria for Premium Class Table are:
To get two new orders in the existing table or 2 new orders into the Business Class Table as well Executive Class Table, First Class Table and World Class Table or one new order in the existing table and one new order into the Business Class Table as well Executive Class Table, First Class Table and World Class Table.
The involved orders will be considered at any level of the table.
If the Member does not get two new orders in the first cycle of the Premium Class Order then the following is done:
Member will have to start the first cycle from the beginning and then get two new orders, after which the Member can go to the Business Class Table, or Member will have to start the first cycle from the beginning and then get one new order and does not get the second new order, then the Member will again start the first cycle and get the second new order and after this the member can go in the Business Class Table.
5.4To receive the credit bonuses in the Premium Class Table it is necessary to fulfilment qualification condition.
If the Member does not satisfy the condition after this then the Member will fall out of the Program and the total amount paid by the Member is credited in his / her Jimpower Account in order to purchase Bars which the Member can sell back under Buy Back scheme (see article 5 General Terms and Conditions) (link).
The Credit Bonus serves only for the purchase of Bars on the Account of the Member.
5.5If the Member has introduced two new orders in the Premium Class Table and those two new orders enter in the Business Class Table, then these two new orders can be considered as a new direct for the Business Class Table.
If the two new orders introduced by the member do not enter into Business Class Table then the member can get two new orders into Business Class Table.
6. RULES AND REGULATIONS OF THE BUSINESS CLASSTABLE
6.1To participate to Business Class Table, the Member must:
Place an order for Bars for the value of Eur 7,000;
Make a down payment of Eur 710, including a subscription fee for system service of Eur 10.
Business Class Table is of 4-2-1 structure, there are 3 cycles that Members need to complete.
Business Class Table consists of 3 levels and includes 7 orders from Members
Level 1- 4 orders
Level 2 – 2 orders
Level 3 – 1 order
6.2 Incoming order are placed on the first level.
The qualification criteria for Business Class Table are:
- To get two new orders in the first cycle of the existing table or 2 new orders into the Executive Class Table as well First Class Table and World Class Table, or one new order in the first cycle of existing of existing table and one new order into the Executive Class Table as well First Class Table and World Class Table.
- The Member’s Order pass 3 level of first cycle, 3 levels of second cycle and 3 levels of third cycle.
The involved orders will be considered at any level of the table.
6.3If the Member does not get two new orders in the first cycle of the Business Class Table then the following is done:
Member will have to start the first cycle from the beginning and then get two new orders, or Member will have to start the first cycle from the beginning and then get one new order and does not get the second new order, then the Member will again start the first cycle and get the second new order and after this the member can go in the cycle.
If the Member does not satisfy the condition after this then the Member will fall out of the Program and the total amount paid by the Member is credited in his / her Jimpower Account for purchase Bars which the Member can sell back to Jimpower under Buy Back scheme (see article 5 General Terms and Conditions) (link).

By the next table division credit bonus are charged on the Member’s order and the Member’s Order is automatically transferred to the second cycle of the Business Class Table and the Member will receive 2,100 Credit Bonus, less 10% for processing fee.
6.5After the competition of second cycle, the Member will receive 2,100 Credit Bonus, less 10% for processing fee.
After the competition of third cycle, the Member will receive 2,800 Credit Bonus, less 10% for processing fee.
The Credit Bonus that the Member has earned will be displayed on the Jimpower Account Dashboard after each cycle.
After the competition of the 3 cycles, if the Member has qualified and met each of Jimpower Membership Program requirements:
If the Member enter in the First Class Table and make an order of Eur 30,000, with a down payment of 3,040 Credit Bonus, the Member will receive the amount of 3,260 Credit Bonus (7,000 Credit Bonus, less 10% for processing fee, less 3,040 Credit Bonus).
If the Member does not enter in the First Class Table, the Member will receive 6,300 Credit Bonus (7,000 Credit Bonus, less 10% for processing fee) in the Credit Bonus E-Wallet for purchase Bars.
The Credit Bonus serves only for the purchase of Bars on the Account of the Member.
6.6If the Member has introduced two new orders in the Business Class Table and those two new orders enter in the First Class Table, then these two new orders can be considered as a new order for the First Class Table.
If the two new orders introduced by the Member do not enter into First Class Table then the member must get two new orders into First Class Table.
7. RULES AND REGULATIONS OF THE EXECUTIVE CLASSTABLE.
7.1To participate to Executive Class Table, the Member must:
Place an order for Bars for the value of Eur 30,000;
Make a down payment of Eur 940, including a subscription fee for system service of Eur 40.
Executive Class Table is of 4-2-1 structure, consists of 1 cycle, and is designated for the transitioning of the Members’ order to the First Class Table.
Executive Class Table consists of 3 levels and includes 7 orders from Members
Level 1- 4 orders
Level 2 – 2 orders
Level 3 – 1 order
7.2 Incoming order are placed on the first level. Once the first level is filled, the table splits into 2 symmetric table of orders and the Member’ order moves down to the second level. At the first level of each 2 new tables of orders 4 new empty places are formed for new member order.

7.3The qualification criteria for Executive Class Table are:

If the Member does not get two new orders in the first cycle of the Executive Class Order then the following isdone:
Member will have to start the first cycle from the beginning and then get two new orders, after which the Member can go to the First Class Table, or Member will have to start the first cycle from the beginning and then get one new order and does not get the second new order, then the Member will again start the first cycle and get the second direct new order and after this the member can go in the First Class Table.
If the Member does not satisfy the condition after this then the Member will fall out of the Program and the total amount paid by the Member is credited in his / her Jimpower Account in order to purchase Bars which the Member can sell back under Buy Back scheme (see article 5 General Terms and Conditions) (link).
The Credit Bonus serves only for the purchase of Bars on the Account of the Member.
7.4If the Member has introduced two new orders in the Executive Class Table and those two new orders enter in the First Class Table, then these two new orders can be considered as a new direct for the First Class Table.
If the two new orders introduced by the member do not enter into First Class Table then the member can get two new orders members into First Class Table.
8. RULES AND REGULATIONS OF THE FIRST CLASSTABLE
8.1To participate to First Class Table, the Member must:
Place an order for Bars for the value of Eur 30,000;
Make a down payment of Eur 3,040, including a subscription fee for system service of Eur 40.
8.2First Class Table is of 4-2-1 structure, there are 3 cycles that Members need to complete.
First Class Table consists of 3 levels and includes 7 orders from Members
Level 1- 4 orders
Level 2 – 2 orders
Level 3 – 1 order
Incoming order are placed on the first level.
8.3The qualification criteria for FirstClass Table are:
- To get two new orders in the first cycles of the existing table or 2 new orders into the World Class Table, or one new order in theexistingtable and one new order into the World Class Table.
- The Member’s Order pass 3 level of first cycles, 3 levels of second cycle and 3 levels of third cycle
The involved orders will be considered at any level of the table.
If the Member does not get two new orders in the first cycle of the First Class Order then the following is done:
Member will have to start the first cycle from the beginning and then get two new orders, or Member will have to start the first cycle from the beginning and then get one new order and does not get the second new order, then the Member will again start the first cycle and get the second new order and after this the member can go in the cycle.
If the Member does not satisfy the condition after this then the Member will fall out of the Program and the total amount paid by the Member is credited in his / her Jimpower Account in order to purchase Bars which the Member can sell back to Jimpower under Buy Back scheme (see article 5 General Terms and Conditions) (link).
8.4Once the first level is filled, the table splits into 2 symmetric table of orders and the Member’ order moves down to the second level. At the first level of each 2 new tables of orders 4 new empty places are formed for new member order.
By the next table division credit bonus are charged on the Member’s order and the Member’s Order is automatically transferred to the second cycle of the First Class Table and the Member will receive 9,000 Credit Bonus, less 10% for processing fee.
After the competition of second cycle, the Member will receive 9,000 Credit Bonus, less 10% for processing fee.
After the competition of third cycle, the Member will receive 12,000 Credit Bonus, less 10% for processing fee.
The Credit Bonus that the Member has earned will be displayed on the Jimpower Account Dashboard after each cycle.
8.5After the competition of the 3 cycles, if the Member has qualified and met each of Jimpower Membership Program requirements:
If the Member enter in the World Class Tableand make an order of Eur 99,000, with a down payment of 9,050 Credit Bonus, the Member will receive the amount of 17,950 Credit Bonus (30,000 Credit Bonus, less 10% for processing fee, less 9,050 Credit Bonus).
If the Member does not enter in the World Class Table, the Member will receive 27,000 Credit Bonus (30,000 Credit Bonus, less 10% for processing fee) in the Credit Bonus E-Wallet to purchase Bars.
The Credit Bonus serves only for the purchase of Bars on the Account of the Member.
8.6If the Member has introduced two new orders in the First Class Table and those two new orders enter in the World Class Table, then these two new orders can be considered as a new ordersfor the World Class Table.
If the two new orders introduced by the member do not enter into World Class Table then the member must get two new orders into World Class Table.
9. RULES AND REGULATIONS OF THE WORLD CLASSTABLE
9.1To participate to World Class Table, the Member must:
Place an order for Bars for the value of Eur 99,000;
Make a down payment of Eur 9,050, including a subscription fee for system service of Eur 50.
9.2World Class Table is of 4-2-1 structure, there are 3 cycles that Members need to complete.
World Class Table consists of 3 levels and includes 7 orders from Members
Level 1- 4 orders
Level 2 – 2 orders
Level 3 – 1 order
Incoming order are placed on the first level.
9.3Eligibility condition for World Class Table the Members will earn credit bonus only if they get two new orders in the first cycles of the existing table andthe Member’s Order pass 3 level of first cycles, 3 levels of second cycle and 3 levels of third cycle.
The involved orders will be considered at any level of the table.
9.4If the Member does not get two new orders in the first cycle of the World Class Table then the following is done:
Member will have to start the first cycle from the beginning and then get two new orders, or Member will have to start the first cycle from the beginning and then get one new order in the WorldClass Table and does not get the second new order, then the Member will again start the first cycle and get the second new order and after this the member can go in the cycle.
If the Member does not satisfy the condition after this then the Member will fall out of the Program and the total amount paid by the Member is credited in his / her Jimpower Account for purchase Bars which the Member can sell back to Jimpower under Buy Back scheme (see article 5 General Terms and Conditions) (link).
9.5Once the first level is filled, the table splits into 2 symmetric table of orders and the Member’ order moves down to the second level. At the first level of each 2 new tables of orders 4 new empty places are formed for new member order.
By the next table division credit bonus are charged on the Member’s order and the Member’s Order is automatically transferred to the second cycle of the World Class Table and the Member will receive 29,700 Credit Bonus, less 10% for processing fee.
After the competition of second cycle, the Member will receive 29,700 Credit Bonus, less 10% for processing fee.
After the competition of third cycle, the Member will receive 39,600 Credit Bonus, less 10% for processing fee.
The Credit Bonus that the Member has earned will be displayed on the Jimpower Account Dashboard after each cycle.
9.6After the competition of the 3 cycles, if the Member has qualified and met each of Jimpower Membership Program requirements, the Member will receive 89,100 Credit Bonus (99,000 Credit Bonus, less 10% for processing fee) in the Credit Bonus E-Wallet for purchase Bars.
The Credit Bonus serves only for the purchase of Bars on the Account of the Member.
10. CREDIT BONUS
10.1These points are given to the members after they receive credit bonus.
These points are given in the Credit Point E-Wallet.
Credit Bonus Point is calculated as follow:
Credit Point Bonus = Credit Bonus Earned/500
These credit points will be used for the calculation of the leadership Program.
11. LEADERSHIP BONUS
11.1This income is given to the members if they satisfy the below conditions:
- Member needs to successfully complete the respective Type Order.
- The 2 directs new orders sponsored by the member need to successfully complete the respective Type Order.
- The 4 directs new orders sponsored by the 2 above directs new orders need to successfully complete the respective Type Order.
This is a differential income.
Cumulative points will be considered.
Eligible a member get credit points on every time a Member cycle out and earn credit point.
The formula used for calculating the credit point is as follows:

12. PRESTIGE LEADERSHIP BONUS
12.1 Prestige Leadership e is an invitation only Program. This means that every Member who joins the Prestige Leadership Program must be sponsored by, and receive an invitation from Jimpower.
The Members are selected based on several criteria, but primarily on their demonstrated interest in Jimpower Membership Program.
13. DURATION OF CONTRACT AND TERMINATION
13.1 If not otherwise contractually agreed upon, the Program shall be concluded for a period of 12 months.
13.2 Within 12 months the order set under the Program must pass (complete) the required number of cycles as set out in the chosen order type, and the Member must engage two new customers who have paid in for their orders through referencing his client identification number to fulfill the qualification requirements of the order type, for it to be considered fully executed and eligible for reward through the corresponding Jimpower Program.
13.3 If the order complete the required number of cycles as set out in the chosen order type, but the Member does not engage two new customers, the Member will fall out of the Program and the total amount paid by the Member is credited in his / her Jimpower Account.
13.4 If the Order does not complete the required number of cycles within twelve months after his / her order registration:
- The Member has the right to complete the Order type at its own expenses and to sell back the Bars to Jimpower under Buy Back scheme (See Article 5 of Jimpower General Terms & Conditions)
Or
-The Member has the right to purchase the Bars for the down payment already paid for the order type (less system fee) and to sell back them to Jimpower under Buy Back scheme (See Article 5 of Jimpower General Terms & Conditions).
14. RIGHT OF WITHDRAWAL
14.1 The Client making an Order under Jimpower Membership Program has a right to cancel the Order without giving reasons within fourteen (14) days after placing an order online.
14.2 In order to exercise the right of withdrawal, the Client must expressly notify Jimpower its decision to withdraw from the contract. To do so, the Client can contact Jimpower using the form in the Contacts area of Jimpower Account.
14.3 In case of withdrawal from the contract entered into with Jimpower, any payments made to Jimpower will be reimbursed to the Client to the his / her Jimpower Account, net of any discounts and/or promotional offers, without any undue delay and in any event no later than 14 days from the day on which Jimpower was informed of the Client's decision to withdraw from the contract.
15. PROMOTION RESTRICTIONS
15.1The Member shall not compel or induce or mislead any person with any false statement / promises to join the company or to purchase any product. Jimpower will not be answerable for any promises, assurance given by any Member to any person, unless it is in accordance with the approved business plans and terms of the company. Hence the applicant shall go through the website www.jimpower.ae and the brochures and notices issued by the company. Through theses company sources, he/she will fully inform himself on all these matters.
15.2 Jimpower has not authorized any official, officer or Member of the company to receive any amount in cash on behalf of the company. Jimpower shall not be responsible for any payment made anywhere else or to anybody else. The Member of the company are not authorized to issue any receipt, on behalf of the Company.
15.3 You agree that, if you promote Jimpower via email, you accept responsibility for ensuring that your mailing lists are up-to-date, "opt-in" only, and fully compliant with your local data protection legislation.
15.4 You will ensure that any text or other content that you create in order to refer potential customers to Jimpower, including any content on websites, blogs, or emails, accurately reflects the business of Jimpower.
15.5 You may not advertise in any way that effectively conceals or misrepresents your identity or your return email address.
15.6 You will not infringe any copyright, trademark, service mark, or intellectual property rights when promoting Jimpower to potential clients, which includes, but is not limited to, the use of images, words, marks, video, or written material in your promotional materials and campaigns.
16. CODE OF ETHICS
16.1 Be honest and accurate. As part of your participation in the Membership Program, you agree and acknowledge that you are responsible for making truthful and accurate statements about Jimpower’s products/services in connection with any referrals.
16.2 You must disclose your relationship with Jimpower at the outset of any referral communication.
16.3 Explain how to returns a product or cancel an order.
17. VARIATION
17.1 By giving ten days’ notice of modifications, Jimpower may from time to time modify its Terms and Conditions and tariff. For modified Terms and Conditions and Tariff to become effective they must be published on the Jimpower website.
17.2 During a ten days’ notice period the Client has the right to terminate the relationship under the previous Terms and Conditions. The Client has the right to complete the Order according to the previous terms and to refuse registration of the new order.
17.3 New Client opening accounts within the ten days’ notice period accept the Terms and Conditions then in effect and accept that they will be bound by the new Terms and Conditions which come into effect at the end of the stated 10 days’ notice period.
18. LIMITATIONS OF LIABILITY
18.1 We will not be liable to you with respect to any subject matter of this Agreement under any contract, negligence, tort, or law, for any indirect, incidental, consequential, special or exemplary damages (including, without limitation, loss of revenue or goodwill or anticipated profits or lost business), even if we have been advised of the possibility of such damages. Further, notwithstanding anything to the contrary contained in this Agreement, in no event shall Jimpower's cumulative liability to you arising out of or related to this Agreement, whether based in contract, negligence, strict liability, tort or other law, exceed the total commission fees paid to you under this Agreement.
19. TERMINATION
19.1 Jimpower reserves the right to terminate this Agreement and your participation in the Program immediately and without notice to you should you commit fraud, misuse your membership, or abuse the Program in any way. If any such fraud or abuse is detected, Jimpower shall not be liable to you for any commissions for such referrals.
19.2 Jimpower shall have the right to unilaterally terminate this Agreement, without any notice, if the Client fails to comply with the obligations set forth at Article 4and / or Article 13 and / or Article 15 and / or Article 16.
20 MISCELLANEOUS
20.1 This Agreement represents the entire agreement between you and Jimpower, and shall supersede all prior arrangements and communications of the parties, oral or written. This Agreement and this Program replaces all previous terms and conditions.
20.2 The headings and titles contained in this Agreement are included for convenience only, and shall not limit or otherwise affect the terms of this Agreement.
20.3 If any part of this Agreement is held to be invalid or unenforceable, that provision shall be deleted or carried as necessary and the remainder of this agreement shall continue in full force and effect.
20.4 Jimpower can assign this Agreement to any successor upon notice to you. You may not assign this Agreement.

1 ТЕРМИНЫ
«JIMPOWER», «нас», «наш», «мы» – компания «Jimpower Trading Limited», ее дочерние компании, совместные компании, а также сайт www.jimpower.ae;
«Программа» – Программа участия в JIMPOWER;
«Идентификационный код участника» – уникальный идентификационный код, предоставленный вам JIMPOWER;
«Веб-сайт» – веб-сайт JIMPOWER www.Jimpower.ae;
«Клиент», «вы», «ваш», «он/она» – лицо, которому исполнилось 18 лет и/или физическое/юридическое лицо, зарегистрированное и принятое на веб-сайте JIMPOWER, включая удовлетворительное выполнение установленных условий проверки в соответствии с Общими условиями;
«Участник» – клиент, подающий заявку в Программе участия в JIMPOWER;
«Слитки» – золото, чистота которого не меньше 99,5%, продаваемое JIMPOWER клиенту.
2. ЦЕЛЬ СОГЛАШЕНИЯ
2.1 JIMPOWER проводит Программу участия, позволяющую Клиенту JIMPOWER заработать часть комиссионных на сделках, осуществляемых Клиентами, которых он направил к JIMPOWER, став «Учасником».
2.2 Следующие условия применяются ко всем контрактам, заключенным между предпринимателем и JIMPOWER через интернет-магазин.
2.3 Под предпринимателем имеется в виду физическое или юридическое лицо или товарищество с юридической ответственностью, которое при заключении правовой сделки действует с целью осуществления своей коммерческой, предпринимательской или профессиональной деятельности.
2.4 Клиент подтверждает, что он покупает Слитки у JIMPOWER исключительно с целью осуществления своей коммерческой или самостоятельной профессиональной деятельности.
3. ОБЯЗАННОСТИ И ПРАВА
3.1 Чтобы стать участником вы должны:
(a) быть не моложе 18 лет;
(b) надлежащим образом соответствовать нашим оценочным критериям, которые определяются на наше собственное усмотрение;
(c) быть предпринимателем, действующим с целью осуществления своей коммерческой, предпринимательской или профессиональной деятельности;
(d) иметь верифицированную учетную запись на JIMPOWER и придерживаться Общих условий JIMPOWER. При условии закрытия или потере права на учетную запись JIMPOWER, вы теряете право участия в Программе.
3.2 Регистрируясь в нашей Программе и соглашаясь с настоящими условиями, вы заявляете, что действуете в интересах собственного бизнеса, и не преследуете ни единой цели за пределами вашей коммерческой деятельности.
3.3 Вы гарантируете, что вы соответствуете, и будете соответствовать нашей Программе. При установлении вашего несоответствия нашей Программе мы можем отклонить или отменить ваше заявление или прекратить ваше участие в Программе.
3.4 Вы соглашаетесь не содействовать любой незаконной деятельности, включая, кроме прочего, посещение сайтов с программами, распространяемыми незаконным путем с нарушением авторских прав.
3.5 Вы отвечаете за обеспечение соответствия законам и нормативно-правовым актам правового пространства страны вашего проживания, включая, кроме прочего, любые требования, относящиеся к раскрытию информации о комиссионных выплатах, защите информации и налогам. Вы не можете участвовать в Программе, если это запрещено применимым законом или нормативно-правовым актом.
3.6 Вы должны сообщить потенциальным покупателям, что вы получите комиссионные, если они зарегистрируют учетную запись JIMPOWER с вашим кодом-ссылкой и купят драгоценные металлы.
4. ПРОГРАММА УЧАСТИЯ
4.1 Клиент может купить Слитки непосредственно или зарегистрировать один или несколько видов заказов по Программе участия в JIMPOWER.
4.2 Чтобы сделать заказ по Программе Клиент должен:
- зарегистрироваться в Программе по коду-ссылке, полученном от действительного Участника или от JIMPOWER;
- предоставить по требованию JIMPOWER необходимую информацию в соответствии с настоящим Соглашением, включая всю информацию, необходимую для исполнения требований применимых законов и нормативно-правовых актов, в том числе всех применимых законов и нормативно-правовых актов по борьбе с отмыванием денег. Без ограничения общего смысла вышеизложенного, условием для покупки драгоценных металлов у JIMPOWER является предоставление Клиентом хотя бы одного официально признанного удостоверения личности с фотографией и документа, подтверждающего адрес проживания;
- принять Общие условия JIMPOWER;
- выбрать один вид заказа на панели своей учетной записи JIMPOWER;
- произвести авансовый платеж, соответствующий стоимости вида заказа;
- оплатить услугу предоставления учетной записи JIMPOWER.
4.3 Размещая заказ, Клиент принимает договорное предложение.
4.4 Разместив заказ в соответствии с условиями Программы, Клиент становится Участником и может воспользоваться льготными условиями оплаты за покупку Слитков по Программе.
4.5 Оплату заказа по счету-фактуре можно осуществить либо за счет собственных средств, либо премиальными единицами, полученными по Программе участия JIMPOWER, либо путем сочетания обоих методов.
4.6 Если Участник хочет разместить заказ всех видов одновременно, он должен зарегистрироваться пять раз на пять видов заказов и получить пять разных реквизитов доступа.
5. ПРАВИЛА И ИНСТРУКЦИИ ТАБЛИЦЫ ПРЕМИУМ КЛАССА
5.1 Для участия в Таблице премиум класса, Участник должен:
Разместить заказ на слитки на сумму 7 000 евро;
Произвести авансовый платеж в сумме 210 евро, включая 10 евро абонементной платы за услуги системы.
Таблица премиум класса – это структура 4-2-1, состоящая из одного цикла и предназначенная для перемещения заказа Участника в Таблицу бизнес класса.
Таблица премиум класса состоит из 3 уровней и включает 7 заказов от Участников
Уровень 1 – 4 заказа
Уровень 2 – 2 заказа
Уровень 3 – 1 заказ
5.2 Поступающие заказы размещаются на первом уровне. После заполнения первого уровня Таблица разделяется на две симметрические таблицы заказов, и заказы Участника передвигаются на второй уровень. На первом уровне каждых двух новых таблиц заказов создаются 4 новых свободных места для заказа нового участника. При следующем делении таблицы на заказ Участника начисляются кредитные бонусы, и Заказ автоматически переносится на первый цикл Таблицы бизнес класса, а Участник получает 800 кредитных бонусов. В этом случае 1 кредитный бонус равняется 1 евро. 710 кредитных бонусов используются для отправления на Заказ бизнес класса, 90 кредитных бонусов за вычетом 10% сервисной платы зачисляются в электронный кошелек кредитных бонусов для покупки Слитков.
5.3 Квалификационные критерии для Таблицы премиум класса:
Разместить два новых заказа в имеющейся таблице, либо 2 новых заказа в Таблице бизнес класса, а также Таблице административного класса, Таблице первого класса и Таблице международного класса, либо один новый заказ в имеющейся таблице и 1 новый заказ в Таблице бизнес класса, а также Таблице административного класса, Таблице первого класса и Таблице международного класса.
Участвующие заказы учитываются на любом уровне таблицы.
Если Участник не размещает два новых заказа в первом цикле Таблицы премиум класса, происходит следующее:
Участнику приходится начинать первый цикл сначала и потом размещать два новых заказа, после этого Участник может перейти в Таблицу бизнес класса; либо Участник начинает первый цикл сначала, потом размещает один новый заказ, но не размещает второй, и опять начинает первый цикл сначала, потом размещает второй новый заказ и после этого может перейти в Таблицу бизнес класса.
5.4 Для получения кредитных бонусов в Таблице премиум класса необходимо выполнить квалификационное условие.
Если Участник не выполняет это условие, он выбывает из Программы, а вся сумма, уплаченная Участником зачисляется на его счет в JIMPOWER для покупки Слитков, которые Участник может продать обратно по схеме обратного выкупа (см. пункт 5 Общих условий) (ссылка).
Кредитные бонусы служат исключительно для покупки слитков в учетной записи Участника.
5.5 Если Участник помещает два новых заказа в Таблице премиум класса, и эти заказы переходят в Таблицу бизнес класса, эти два новых заказа можно рассматривать как новый заказ непосредственно в Таблице бизнес класса.
Если два новых заказа, помещенные Участником, не переходят в Таблицу бизнес класса, Участник может разместить два новых заказа в Таблице бизнес класса.
6. ПРАВИЛА И ИНСТРУКЦИИ ТАБЛИЦЫ БИЗНЕС КЛАССА
6.1 Для участия в Таблице бизнес класса, Участник должен:
Разместить заказ на слитки на сумму 7 000 евро;
Произвести авансовый платеж в сумме 710 евро, включая 10 евро абонементной платы за услуги системы.
Таблица бизнес класса – это структура 4-2-1, состоящая из трех циклов, которые Участник должен завершить.
Таблица бизнес класса состоит из 3 уровней и включает 7 заказов от Участников
Уровень 1 – 4 заказа
Уровень 2 – 2 заказа
Уровень 3 – 1 заказ
6.2 Поступающие заказы размещаются на первом уровне.
Квалификационные критерии для Таблицы бизнес класса:
- Разместить два новых заказа в первом цикле имеющейся таблицы, либо 2 новых заказа в Таблице административного класса, а также Таблице первого класса и Таблице международного класса, либо один новый заказ в первом цикле имеющейся таблицы и 1 новый заказ Таблице административного класса, а также Таблице первого класса и Таблице международного класса.
- Заказ Участника проходит 3 уровня первого цикла, 3 уровня второго цикла и 3 уровня третьего цикла.
Участвующие заказы учитываются на любом уровне таблицы.
6.3 Если Участник не размещает два новых заказа в первом цикле Таблицы бизнес класса, происходит следующее:
Участнику приходится начинать первый цикл сначала и потом размещать два новых заказа, либо Участник начинает первый цикл сначала, потом размещает один новый заказ, но не размещает второй, и опять начинает первый цикл сначала, потом размещает второй новый заказ и после этого может перейти в следующий цикл.
Если Участник не выполняет это условие, он выбывает из Программы, а вся сумма, уплаченная Участником зачисляется на его счет в JIMPOWER для покупки Слитков, которые Участник может продать обратно по схеме обратного выкупа (см. пункт 5 Общих условий) (ссылка).

6.5 После завершения второго цикла Участник получает 2 100 кредитных бонусов за вычетом 10% сервисной платы.
После завершения третьего цикла Участник получает 2 800 кредитных бонусов за вычетом 10% сервисной платы.
Кредитные бонусы, заработанные Участником, отображаются на информационной панели учетной записи JIMPOWER после каждого цикла.
После завершения всех трех циклов при условии выполнения Участником всех требований Программы участия в JIMPOWER:
Если Участник переходит в Таблицу первого класса и делает заказ на 30 000 евро с авансовым платежом 3 040 кредитных бонусов, он получает 3 260 кредитных бонусов (7 000 кредитных бонусов за вычетом 10% сервисной платы и за вычетом 3 040 кредитных бонусов).
Если Участник не переходит в Таблицу первого класса, он получает 6 300 кредитных бонусов (7 000 кредитных бонусов за вычетом 10% сервисной платы) в электронный кошелек кредитных бонусов для покупки Слитков.
Кредитные бонусы служат исключительно для покупки слитков в учетной записи Участника.
6.6 Если Участник помещает два новых заказа в Таблице бизнес класса, и эти заказы переходят в Таблицу первого класса, эти два новых заказа можно рассматривать как новые заказы в Таблице первого класса.
Если два новых заказа, помещенные Участником, не переходят в Таблицу первого класса, Участник должен разместить два новых заказа в Таблице первого класса.
7. ПРАВИЛА И ИНСТРУКЦИИ ТАБЛИЦЫ АДМИНИСТРАТИВНОГО КЛАССА
7.1 Для участия в Таблице административного класса, Участник должен:
Разместить заказ на слитки на сумму 30 000 евро;
Произвести авансовый платеж в сумме 940 евро, включая 40 евро абонементной платы за услуги системы.
Таблица административного класса – это структура 4-2-1, состоящая из одного цикла и предназначенная для перемещения заказа Участника в Таблицу первого класса.
Таблица административного класса состоит из 3 уровней и включает 7 заказов от Участников
Уровень 1 – 4 заказа
Уровень 2 – 2 заказа
Уровень 3 – 1 заказ
7.2 Поступающие заказы размещаются на первом уровне. После заполнения первого уровня таблица разделяется на две симметрические таблицы заказов, и заказы Участника передвигаются на второй уровень. На первом уровне каждых двух новых таблиц заказов создаются 4 новых свободных места для заказа нового участника. При следующем делении таблицы на заказ Участника начисляются кредитные бонусы, и Заказ автоматически переносится на первый цикл Таблицы первого класса, а Участник получает 3 800 кредитных бонусов. 3 040 кредитных бонусов используются для отправления на заказ первого класса, 760 кредитных бонусов за вычетом 10% сервисной платы зачисляются в электронный кошелек кредитных бонусов для покупки Слитков.
7.3 Квалификационные критерии для Таблицы административного класса:
Разместить два новых заказа в имеющейся таблице, либо 2 новых заказа в Таблице первого класса, а также Таблице международного класса, либо один новый заказ в имеющейся таблице и 1 новый заказ в Таблице первого класса, а также Таблице международного класса.
Если Участник не размещает два новых заказа в первом цикле Заказа административного класса, происходит следующее:
Участнику приходится начинать первый цикл сначала и потом размещать два новых заказа, после этого Участник может перейти в Таблицу первого класса; либо Участник начинает первый цикл сначала, потом размещает один новый заказ, но не размещает второй, и опять начинает первый цикл сначала, потом размещает второй новый заказ и после этого может перейти в Таблицу первого класса.
Если Участник не выполняет это условие, он выбывает из Программы, а вся сумма, уплаченная Участником зачисляется на его счет в JIMPOWER для покупки Слитков, которые Участник может продать обратно по схеме обратного выкупа (см. пункт 5 Общих условий) (ссылка).

Если два новых заказа, помещенные Участником, не переходят в Таблицу административного класса, Участник может разместить два новых заказа в Таблице первого класса.
8. ПРАВИЛА И ИНСТРУКЦИИ ТАБЛИЦЫ ПЕРВОГО КЛАССА
8.1 Для участия в Таблице первого класса, Участник должен:
Разместить заказ на слитки на сумму 30 000 евро;
Произвести авансовый платеж в сумме 3 040 евро, включая 40 евро абонементной платы за услуги системы.
8.2 Таблица первого класса – это структура 4-2-1, состоящая из трех циклов, которые Участник должен завершить.
Таблица первого класса состоит из 3 уровней и включает 7 заказов от Участников
Уровень 1 – 4 заказа
Уровень 2 – 2 заказа
Уровень 3 – 1 заказ
Поступающие заказы размещаются на первом уровне.
8.3 Квалификационные критерии для Таблицы первого класса:
- Разместить два новых заказа в первом цикле имеющейся таблицы, либо 2 новых заказа в Таблице международного класса, либо один новый заказ в первом цикле имеющейся таблицы и 1 новый заказ Таблице международного класса.
- Заказ Участника проходит 3 уровня первого цикла, 3 уровня второго цикла и 3 уровня третьего цикла.

После завершения третьего цикла Участник получает 12 000 кредитных бонусов за вычетом 10% сервисной платы.
Кредитные бонусы, заработанные Участником, отображаются на информационной панели учетной записи JIMPOWER после каждого цикла.
8.5 После завершения всех трех циклов при условии выполнения Участником всех требований Программы участия в JIMPOWER:
Если Участник переходит в Таблицу международного класса и делает заказ на 99 000 евро с авансовым платежом 9 050 кредитных бонусов, он получает 17 950 кредитных бонусов (30 000 кредитных бонусов за вычетом 10% сервисной платы и за вычетом 9 050 кредитных бонусов).
Если Участник не переходит в Таблицу международного класса, он получает 27 000 кредитных бонусов (30 000 кредитных бонусов за вычетом 10% сервисной платы) в электронный кошелек кредитных бонусов для покупки Слитков.
Кредитные бонусы служат исключительно для покупки слитков в учетной записи Участника.
8.6 Если Участник помещает два новых заказа в Таблице первого класса, и эти заказы переходят в Таблицу международного класса, эти два новых заказа можно рассматривать как новые заказы в Таблице международного класса.
Если два новых заказа, помещенные участником не переходят в Таблицу международного класса, участник должен разместить два новых заказа в Таблице международного класса.
9. ПРАВИЛА И ИНСТРУКЦИИ ТАБЛИЦЫ МЕЖДУНАРОДНОГО КЛАССА
9.1 Для участия в Таблице международного класса, Участник должен:
Разместить заказ на слитки на сумму 99 000 евро;
Произвести авансовый платеж в сумме 9 050 евро, включая 50 евро абонементной платы за услуги системы.
9.2 Таблица международного класса – это структура 4-2-1, состоящая из трех циклов, которые Участник должен завершить.
Таблица международного класса состоит из 3 уровней и включает 7 заказов от Участников
Уровень 1 – 4 заказа
Уровень 2 – 2 заказа
Уровень 3 – 1 заказ
Поступающие заказы размещаются на первом уровне.
9.3 Квалификационные критерии для Таблицы международного класса:
Участник получит кредитные бонусы только при размещении двух новых заказов в первом цикле имеющейся таблицы и прохождении Заказом Участника 3 уровней первого цикла, 3 уровней второго цикла и 3 уровней третьего цикла.
Участвующие заказы учитываются на любом уровне таблицы.
9.4 Если Участник не размещает два новых заказа в первом цикле Заказа международного класса, происходит следующее:
Участнику приходится начинать первый цикл сначала и потом размещать два новых заказа, либо Участник начинает первый цикл сначала, потом размещает один новый заказ в Таблице международного класса, но не размещает второй, и опять начинает первый цикл сначала, потом размещает второй новый заказ и после этого может перейти в следующий цикл.
Если Участник не выполняет это условие, он выбывает из Программы, а вся сумма, уплаченная Участником зачисляется на его счет в JIMPOWER для покупки Слитков, которые Участник может продать обратно по схеме обратного выкупа (см. пункт 5 Общих условий) (ссылка).
9.5 После заполнения первого уровня Таблица разделяется на две симметрические таблицы заказов, и заказы Участника передвигаются на второй уровень. На первом уровне каждых двух новых таблиц заказов создаются 4 новых свободных места для заказа нового участника.
При следующем делении таблицы на заказ Участника начисляются кредитные бонусы, и Заказ автоматически переносится на второй цикл Таблицы международного класса, а Участник получает 29 700 кредитных бонусов за вычетом 10% сервисной платы.
После завершения второго цикла Участник получает 29 700 кредитных бонусов за вычетом 10% сервисной платы.
После завершения третьего цикла Участник получает 39 600 кредитных бонусов за вычетом 10% сервисной платы.
Кредитные бонусы, заработанные Участником, отображаются на информационной панели учетной записи JIMPOWER после каждого цикла.
9.6 После завершения всех трех циклов при условии выполнения Участником всех требований Программы участия в JIMPOWER, Участник получает 89 100 кредитных бонусов (99 000 кредитных бонусов за вычетом 10% сервисной платы) в электронный кошелек кредитных бонусов для покупки Слитков.
Кредитные бонусы служат исключительно для покупки слитков в учетной записи Участника.
10. КРЕДИТНЫЕ БОНУСЫ
10.1 Баллы присваиваются участникам после получения кредитных бонусов.
Баллы начисляются в электронный кошелек кредитных баллов.
Кредитные бонусные баллы рассчитываются следующим образом:
Кредитные бонусные баллы = заработанные кредитные бонусы/500
Кредитные баллы используются при расчете Программы лидерства.
11. БОНУСЫ ЛИДЕРА
11.1 Эту прибыль получают участники при выполнении следующих условий:
- Участник должен успешно завершить соответствующий вид заказа.
- 2 новых заказчика, привлеченные участником должны успешно завершить соответствующий вид заказа.
- 4 новых заказчика, привлеченные двумя вышеупомянутыми заказчиками должны успешно завершить соответствующий вид заказа.
Это дифференциальная прибыль.
Приемлемый участник получает кредитные баллы каждый раз после завершения своего цикла и получения кредитных бонусов.
Для расчета кредитных баллов используется следующая формула:
Сумма бонусов разделяется на 500 (константа).

12. БОНУСЫ ПРЕСТИЖНОГО ЛИДЕРА
12.1 Программа престижного лидерства действует только по приглашению. Это значит, что каждый Участник, присоединяющийся к Программе престижного лидерства, должен быть привлеченным другим участником и получить приглашение от JIMPOWER.
Для отбора Участников используются несколько критериев, но в основном это выявление заинтересованности в Программе участия в JIMPOWER.
13. СРОК ДЕЙСТВИЯ И ПРЕКРАЩЕНИЕ КОНТРАКТА
13.1 Если иное не оговорено в контракте, Программа заключается сроком на 12 месяцев.
13.2 Для соответствия квалификационным требованиям определенного вида заказа, а также его завершения и получения вознаграждения по Программе JIMPOWER, в течение 12 месяцев заказ, размещенный по условиям Программы, должен пройти (завершить) необходимое количество циклов, как это предусмотрено выбранным видом заказа, а Участник должен привлечь двоих новых покупателей, оплативших свои заказы с указанием его идентификационного номера клиента.
13.3 Если заказ завершает необходимое количество циклов, как это предусмотрено выбранным видом заказа, но Участник не привлекает двоих новых покупателей, он выбывает из Программы, а вся сумма, уплаченная Участником зачисляется на его счет в JIMPOWER.
13.4 Если заказ не завершает необходимое количество циклов в течение 12 месяцев после регистрации:
- Участник имеет право завершить вид заказа за счет собственных средств и продать Слитки обратно JIMPOWER по схеме обратного выкупа (см. пункт 5 Общих условий JIMPOWER)
Или
- Участник имеет право купить Слитки за авансовый платеж, уже уплаченный в соответствии с видом заказа (за вычетом сервисной платы) и продать их обратно JIMPOWER по схеме обратного выкупа (см. пункт 5 Общих условий JIMPOWER).
14. ПРАВО НА ОТЗЫВ ЗАКАЗА
14.1 Клиент, размещающий заказ по Программе участия в JIMPOWER, имеет право отменить заказ без объяснения причин в течение 14 (четырнадцати) дней после его размещения в Интернете.
14.2 Чтобы воспользоваться правом не отзыв заказа Клиент должен словесно уведомить JIMPOWER о своем решении отказаться от контракта. С этой целью Клиент может связаться с JIMPOWER, используя формуляр в меню КОНТАКТЫ учетной записи JIMPOWER.
14.3 В случае отказа от контракта, заключенного с JIMPOWER, любые платежи, внесенные на счет JIMPOWER, возвращаются Клиенту на его счет JIMPOWER, за вычетом скидок и промоакций, без неуместной задержки и при любых обстоятельствах в срок не позднее 14 дней со дня уведомления JIMPOWER о решении Клиента отказаться от контракта.
15. ОГРАНИЧЕНИЯ РЕКЛАМИРОВАНИЯ
15.1 Участник не должен путем ложных заявлений/обещаний принуждать, убеждать либо вводить в заблуждение любое лицо присоединиться к компании или купить любую продукцию. JIMPOWER не несет ответственности за любые обещания, заверения, предоставленные любым Участником любому лицу, если они не соответствуют утвержденным бизнес-планам и условиям компании. Исходя из этого, претендент должен тщательно изучить веб-сайт www.jimpower.ae, а также буклеты и уведомления, выпущенные компанией. Из этих источников информации компании он получит полную информацию по всем вопросам.
15.2 JIMPOWER не поручает ни одному должностному лицу, служащему или Участнику компании получать любую сумму наличными от имени компании. JIMPOWER не несет ответственности за любые платежи, произведенные в любом другом месте или любому другому лицу. Участники компании не имеют полномочий выдавать любой чек от имени компании.
15.3 Вы соглашаетесь, что рекламируя JIMPOWER по электронной почте, вы несете ответственность за обновление листов рассылки, отправление информации только по запросу и полное соответствие законодательству о защите данных вашей местности.
15.4 Вы должны обеспечить точное отображение коммерческой деятельности JIMPOWER в любом тексте или другом источнике информации, созданном вами с целью направить потенциальных покупателей в JIMPOWER, включая любую информацию на веб-сайтах, в блогах или сообщениях по электронной почте.
15.5 Запрещается реклама любым способом, который скрывает или искажает вашу личность либо ваш электронный адрес.

16. ЭТИЧЕСКИЕ НОРМЫ И ПРАВИЛА
16.1 Будьте честным и точным. В рамках вашего участия в Программе вы соглашаетесь и подтверждаете свою ответственность за правдивые и точные заявления касательно продукции/услуг JIMPOWER относительно любых потенциальных покупателей.
16.2 Вы должны сообщить о своих отношениях с JIMPOWER в начале любого общения с потенциальным покупателем.
16.3 Объясните, как возвратить продукцию или отменить заказ.
17. ИЗМЕНЕНИЕ УСЛОВИЙ
17.1 JIMPOWER может в любое время изменить свои Условия и тарифы, предварительно уведомив об изменениях за десять дней. Изменение Условий и тарифов вступает в силу после его публикации на веб-сайте JIMPOWER.
17.2 В течение десятидневного срока уведомления Клиент имеет право разорвать отношения в соответствии с предыдущими Условиями. Клиент имеет право завершить заказ в соответствии с предыдущими условиями и отказаться регистрировать новый заказ.
17.3 Новые клиенты, которые регистрируются в течение десятидневного срока уведомления, принимают Условия, действующие на момент регистрации, а также соглашаются принять новые Условия, которые вступят в силу по истечении установленного десятидневного срока уведомления.
18. ОГРАНИЧЕНИЕ ОТВЕТСТВЕННОСТИ
18.1 Мы не несем перед вами ответственности в отношении любого предмета настоящего Соглашения в силу любого договора, небрежности, деликта или закона, за любые непрямые, непреднамеренные, случайные, фактические или штрафные убытки (включая, кроме прочего, неполучение доходов, утрату репутации, потерю ожидаемой прибыли или коммерческие потери), даже если мы были предупреждены о возможности таких убытков. Кроме того, невзирая на какие-либо положения об обратном в настоящем Соглашении, ни при каких обстоятельствах совокупная ответственность JIMPOWER, вытекающая из или в связи с настоящим Соглашением, либо в силу договора, небрежности, объективной ответственности, деликта, либо иного закона, не должна превышать суммарные комиссионные вознаграждения, выплаченные вам в соответствии с настоящим Соглашением.
19. РАСТОРЖЕНИЕ СОГЛАШЕНИЯ
19.1 JIMPOWER оставляет за собой право разорвать настоящее Соглашение и прервать ваше участие в Программе незамедлительно и без уведомления, если вы совершаете мошенничество, используете свое участие не по назначению или злоупотребляете Программой любым способом. При обнаружении факта мошенничества или злоупотребления, JIMPOWER не обязана выплачивать вам комиссионные за таких потенциальных покупателей.
19.2 JIMPOWER имеет право одностороннего расторжения настоящего Соглашения без уведомления, если Клиент не выполняет обязательства, изложенные в Пункте 4 и/или Пункте 13 и/или Пункте 15 и/или Пункте 16.
20. ПРОЧИЕ УСЛОВИЯ
20.1 Настоящее Соглашение является полным соглашением между вами и JIMPOWER и заменяет все предыдущие договоренности и обмен информацией между сторонами, устные или письменные. Настоящее Соглашение и настоящая Программа заменяют все предыдущие условия.
20.2 Заголовки и названия, содержащиеся в настоящем Соглашении, включены только для удобства, и не должны ограничивать или иным образом повлиять на условия настоящего Соглашения.
20.3 Если какая-либо часть настоящего Соглашения будет признана недействительной или не имеющей юридической силы, такое положение удаляется или переносится по мере необходимости, а остальная часть данного Соглашения остается в силе без изменений.
20.4 JIMPOWER может передать настоящее Соглашение любому правопреемнику после уведомления вас. Вы не можете передавать настоящее Соглашение.

The Magnicator II magnetic liquid level gage is a simple device which requires a minimum amount of maintenance. The maintenance normally consists of cleaning the chamber. The frequency of cleaning will depend on the process in which it is installed in. When enough foreign matter collects in the chamber to restrict the movement of the float, it will be necessary to secure the gage and drain out the accumulation of dirt from the chamber. The gage can be flushed by using the vent and drain connections. In extreme cases, it may be necessary to remove the float, and mechanically clean the float and chamber. Some processes may dictate the use of a suitable solvent for cleaning.

The Credit Applicant must NOT pay any Commission or Fees.

Рабочая частота
Непременное условие работоспособности системы ограничения доступа — совпадение рабочих частот пульта и приемного устройства. Этим параметром в первую очередь нужно руководствоваться при выборе брелока.
Сегодня выпуск приборов, работающих на метровых радиоволнах, прекращен и используются две частоты:
866-868 МГц;
431-434 МГц (самая распространенная).
Популярность последней облегчает правильный подбор оборудования. Однако загруженность диапазона (в нем работают автомобильные сигнализации) нередко вызывает помехи и сбои в работе.
Существуют мультичастотные многоканальные устройства, в которых каждый из каналов запрограммирован на свою длину волны. Универсальность — их преимущество.
Способ программирования
Пульты, программирующие приемник, — оригинальные устройства, записывающие код в его память (каждый индивидуально в свою ячейку). Возможно применение совместимых разработок сторонних производителей.
При этом способе введения данных не предусмотрено копирование сигнала с одного передатчика на другие.
Преимущества:
строгость контроля доступа на закрытую территорию;

ограничение их количества числом ячеек памяти (25-1000, в зависимости от модели).
Программируемые от другого пульта — как оригинальные, так и универсальные передатчики, один из которых (основной) записывается в ячейку памяти приемника. В дальнейшем код с него копируется на любое количество брелоков.
Имейте в виду, что запись в ресивер нового пульта приведет к стиранию предыдущего и потере функциональности его клонов.
Достоинства:
простота программирования;
использование неограниченного количества передатчиков.
Недостаток – вероятность нелегального получения посторонними кода.
Типы приемников
Встроенные — приемники, выпускаемые производителями ворот или шлагбаумов, вмонтированные в их привод.
Выносные — ресиверы, конструктивно разделенные с преграждающими устройствами, но связанные посредством проводов с их блоками управления.
Основное достоинство — универсальность.
Применяются:
в случае невозможности подобрать пульт к редкой завезенной индивидуально автоматике;
при желании использовать один брелок для нескольких шлагбаумов с несовпадающими характеристиками приемников.
Сложные компьютерные устройства, являющиеся, по сути, системами контроля и управления доступом (СКУД). В них для каждого пульта зарезервирован файл в компьютере. В его памяти фиксируется входящий сигнал. Используются на автостоянках, рассчитанных на большое число автомобилей.
Достоинства:
ведение строгого учета;
функция блокировки брелоков (при задолженности у хозяина за парковочное место).
Недостаток: сложность системы, необходимость использования компьютера и дороговизна обслуживания.
Мобильность пультов
Пульт для ворот автомобильныйНосимые — компактные приборы, напоминающие брелоки автосигнализации. По этому параметру имеет смысл сравнивать только дизайн и габариты изделия.
Система Home Link — устройства, встраиваемые в панель приборов автомобиля. Ими оборудованы модели премиум класса.
Возможно возникновение проблем с оборудованием американских машин, завезенных из-за океана по “серым” схемам. Дело в том, что в США используются другие кодировки и частоты систем дистанционного управления. Выход — в установке совместимого выносного приемника американского производства.
Европейские же элитные марки оснащены Home Link со стандартными характеристиками.
Эффектно выглядит самостоятельный монтаж пульта в автомобиль и подключение к осветительной системе.
В этом случае ворота открываются по миганию фар, подъехавшей машины.
Возможные неисправности и проблемы в эксплуатации пультов
Поломка кнопок. Происходит из-за слишком интенсивных надавливаний. Если брелок не сработал, то нужно выяснять причину — силой нажатия проблему не решить.
Периодические “провалы” в срабатывании. Возникают из-за загрязнения токоведущих поверхностей. Необходимо разобрать пульт, очистить и протереть спиртом кнопки.
Снижение дальности действия.
Причины:
исчерпание ресурса батарей (требуется их замена);
выход из строя усилителя приемника;
поломка антенны;
падение напряжения в сети.
Низкая дальность действия со стороны ворот. Причина — экранирование забора. Решается путем установки выносной антенны длиной, соответствующей частоте сигнала. Она подключается посредством кабеля, защищенного оплеткой.
Периодическая потеря работоспособности из-за помех. Признак проблемы — “плавающая” дальность действия. Решение — переход на другую частоту с установкой выносного приемника и заменой пульта.
Сбои в работе в морозную погоду. Возникают из-за потери работоспособности батарей. Их нужно нагреть.
Как не попасться на хитрости продавцов
Часто, встретив заманчивое предложение торговцев автоматическими шлагбаумами, покупатель спешит сделать заказ. Систему для въезда во двор многоквартирного дома действительно установят по минимальной цене, но…
Позже выяснится, что брелоки всем жителям придется покупать в 2-3 раза дороже их реальной стоимости. Отказаться не получится, поскольку блок управления окажется опломбированным, а гарантия при нарушении пломб поддерживаться не будет.
Не попадитесь на удочку, выясняйте детали до заключения контракта.

Gate remote control
Every driver had to get out of a warm car into cold rain to open the garage door or the driveway gates by hand.
With automated devices for gates and auto barriers you can avoid such contact with nature or get quick access to the parking lot during rush hours. These devices are operated by remote controls which will be considered in this article.
Gate remote controls are electronic devices used to operate wirelessly from a distance locks and structures, barring access to restricted areas.
These are plastic monoblocks usually made in the form of a keychain with buttons on its faceplate.
Classification of remote controls
According to the encoder type:
Gate and auto barrier remote controls are
fixed code;
rolling code.
According to the brand:
specific;
universal.
According to the number of channels:
single-channel;
multi-channel.
According to the operating frequency:

Encoder type:
When the button is pressed, fixed code remotes send the receiver an encoded signal with unique characteristics (frequency, pulse number and mode).
Devices of this type always send the same fixed code.
Their advantage is in simple electronic circuit.
They have a disadvantage of lax security against unauthorized copying.
Remote controls with a rolling code differ from the above described in variable ad hoc algorithm signal.
These remotes have an advantage of maximum security.
Their disadvantage is in difficulty to copy the code to another keychain without a special device, which limits the scope of their application.
Brand
Specific (original) remote controls are devices produced by receiver manufactures and having identical record and SPC protocols.
Their advantage is in reliability.
The disadvantage is that it is impossible to integrate several controls into one transmitter (gates, auto barriers).
Universal devices are produced by other companies (manufactures of the remote control and the receiver are different) and can be programmed with an original keychain.
Their advantage is in operation of one receiver with an unlimited number of transmitters.
Disadvantages:
lower reliability if compared with the original keychain;
potential problems if it is necessary to substitute the receiver.
Number of channels
Single-channel remote controls are keychains with a single button linked to a particular auto bar or gate.
Their advantage is in simplicity.
They have a disadvantage of limited usage.
NICE single channel gate remote control
Multi-channel remote controls can operate several locking structures (2 to 10). The number of buttons corresponds to the number of channels, each of them being programmed separately.
The advantage is in using one remote control rather than several ones.
The disadvantage is in complicated electronic circuit.

Operating frequency
The same operating frequency of the remote control and the receiver is the precondition for access restriction system efficiency. This is the primary characteristic to be taken into account when choosing a keychain.
Nowadays VHF band devices are no longer produced, thus, two frequency bands are used:
866 to 868 MHz;
431 to 434 MHz (most widely used).
Wide availability of the latter makes the choice of the device easier. However, the band load (in which car alarms work) often causes interference and malfunction.
There multi-frequency multi-channel devices which permit to program each channel to different frequency. Their advantage is in being universal.
How to program
Remote controls programming the receiver are original devices which save their code into the receiver's memory (each having an individual cell). Compatible devices of third-party manufactures can be used.
This way of programming doesn't provide for copying signal from one transmitter to others.
Advantages:
strict control over restricted territory access;
prevention of unauthorized keychain cloning.
Disadvantages:
necessity to open the cover of the built-in receiver to save each remote control;
limitation of their number by the number of memory cells (25 to 1000 depending on the model).
Remote controls programmed with another remote control are transmitters (both original and universal), one of which (the main one) is saved in the receiver's memory. Furthermore, its code is copied to an unlimited number of keychains.
Keep in mind that if you save a new remote control into the receiver, the previous one will be deleted and its clones will not function anymore.
Advantages:
They are easy to program.
Unlimited number of transmitters can be used.
The disadvantage is that unauthorized people can get the code.
Receiver types:
Built-in receivers are integrated into gate or auto bar drive by their manufactures.
Remote receivers are structurally separate with barring devices but connected through wires to their control units.
Their main advantage is that they are universal.
They are used:
if it is impossible to fit a remote control to a unique individual device;
if you want to use one remote control for several auto bars with incompatible receiver specifications.
Elaborate computer devices are essentially Access Control Systems (ACS). They have a computer backup file for each remote control. Incoming signal is recorded in its memory. They are used by car parks meant for a large number of cars.
Advantages:
strict record-keeping;
keychain lock function (if the car owner hasn't paid the parking fee).
Disadvantage: elaborate system, need to use a computer and high cost of maintenance.
Remote control portability
Gate remote controls are portable compact devices resembling car alarm system remote fobs. Taking into account this characteristic it is reasonable to compare only devices in their design and size.
Home Link System comprises devices integrated into the car dashboard. Premium class cars have this feature.
There can be problems with grey import vehicles brought from the USA. The thing is that in the USA they use different remote control system encoders and frequency. The solution is to install a compatible remote receiver produced in the USA.
European luxury car models have Home Link Systems with standard features.
Individual integration of the remote control into the car and its connection to the car lighting system also look impressive.
In this case the gate opens by flashing headlights of the car when driving up.
Possible faults and and problems in remote controls operation
Malfunction of buttons. It is due to pressing the buttons too hard. If the keychain won't work it is necessary to find out the reason - pressing harder does not solve the problem.
Alternate operation failures. They result from dirty current-conducting surface. You need to disassemble the remote, clean and wipe button with alcohol.
Reduced operation range.
Reasons:
the battery is flat (you need to change it);
failure of the receiver amplifier;
antenna breakage;
supply voltage interruption.
Low operation range on the part of the gate. The reason is fence screening. The solution is to install a remote antenna with the wavelength corresponding to the signal frequency. It connects via braid screened cable.
Periodic loss of efficiency due to interfering signal. The problem is identified by "floating" range. To solve the problem you have to change the frequency alongside with installing a remote receiver and changing the remote control.
Malfunctions in frosty weather. They arise due to efficiency loss of batteries. They need to be warmed.
How to avoid getting scammed by sellers
Buyers are often pushed to place an order when they meet a tempting offer from auto barrier sellers. System barring the driveway to a block of flats will really be installed at the lowest price, but...
It turns out later that the residents will have to pay for the keychains 2 to 3 times more than they really cost. They won't be able to refuse because the control unit will be sealed, and the guarantee will not be maintained in case of seal violation.
