Source text - English “Le procedure di composizione della crisi da sovraindebitamento nell’ordinamento giuridico francese e italiano. Analogia e differenze.”
La legge 3/ 2012 introduce nel nostro ordinamento un istituto che disciplina, in chiave concorsuale, l’insolvenza del debitore non fallibile. La legge citata è stata profondamente modificata dal d.l 179/2012 convertito con le modificazioni dalla legge n.221 del 17 dicembre 2012. Il modello previsto dalla legge 3/2012, prima delle modifiche apportate, che prevedeva una disciplina volta a consentire al debitore la possibilità di addivenire ad un accordo solo con il con i creditori aderenti, cede il passo ad una disciplina nuova, concorsuale, che prevede, oltre alla procedura di accordo, una disciplina specifica per destinata al soggetto consumatore e l’alternativa liquidatoria del patrimonio del debitore non fallibile o non soggetto a procedure concorsuali. La procedure sono a carattere in quanto possono essere aperte solo su domanda del debitore con l’assistenza dell’ organismo di composizione della crisi .
L’organismo di composizione della crisi è un soggetto nuovo nel panorama dell’ordinamento giuridico italiano. La disciplina in commento dedica varie norme in relazione ai ruoli e alle funzioni che tale soggetto è chiamato a svolgere. Tale soggetto è delegato dalla legge a svolgere funzioni che in altri ambiti il legislatore affida ad una pluralità di soggetti dotati di specifica professionalità autonoma: collabora con il debitore alla predisposizione a alla stesura del piano; è chiamato ad attestare il piano e al sua veridicità; nella procedura di piano del consumatore e di liquidazione del patrimonio deve procedere alla redazione di una relazione particolareggiata; è assistente del giudice. Appare quindi evidente il che il ruolo svolto da tali organismi è quello di garanti del funzionamento dell’intera procedura da svolgersi in collaborazione con il giudice .
Nel processo di analisi si affronteranno tutte le questioni di maggior rilievo della normativa qui in commento, si entrerà nel cuore della disciplina del sovraindebitamento del debitore civile toccando gli aspetti più importanti e innovativi ed anche più problematici, quali, ad esempio, la valutazione della meritevolezza del debitore, presupposto soggettivo del consumatore necessario per accedere alla procedura di piano del consumatore e elemento indispensabile per ottenere l’esdebitazione nella procedura di liquidazione del patrimonio.
Una sezione a parte sarà dedicata alla descrizione della normativa del sovraindebitamento in Francia e tale scelta è stata adottata per fare un paragone utile con la normativa italiana.
Si affronterà anche il tema centrale della legge che si riassume nella seguente domanda: questa norma consente realmente al soggetto in difficoltà, non più in grado di assolvere i propri debiti, di poter tornare a svolgere un ruolo attivo nella società?
Nel rispondere a questa domanda indirettamente si solleva un problema focale, nel nostro ordinamento la tutela del credito è preponderante rispetto alla tutela della persona? Esiste un limite oltre il quale il diritto della persona di condurre una vita serena e dignitosa indipendentemente dalla sia situazione pregressa, riconducibile anche sue scelte probabilmente sbagliate, prevale sul diritto di esercitare l’azione di recupero del credito da parte del creditore?

Law No.3/2012 has recently introduced in Italy a new procedure that regulates the insolvency of non-fallible debtors. The aforementioned law was profoundly modified by Leg. Decree 179/2012 converted with amendments by Law No.221 of December 17, 2012. The model envisaged by Law 3/2012, which, prior to the implementation of the changes foresaw a regulation that enabled the debtor to reach an agreement with adhering creditors only, now gives way to a new regulation on insolvency proceedings, which envisages - besides the composition agreement - a specific regulation related to the consumer and an alternative solution that entails the liquidation of assets of non-fallible debtors (or debtors who are not subject to traditional insolvency proceedings). Such proceedings are in that they can be initiated only at the debtor’s request with the support of a crisis settlement panel.
The crisis settlement panel is a new figure in the panorama of the Italian legal system. The regulation referenced herein includes several provisions related to the roles and functions that such panel is called to fulfil; it is designated by law to fulfil functions which, in other ambits, are entrusted by the legislator to a plurality of subjects endowed with specific, professional autonomy. The crisis settlement panel collaborates with the debtor in preparing and drafting the Consumer Plan and is in charge of certifying both the Plan and its veracity. Furthermore, when implementing the Consumer Plan and the Liquidation Plan, the settlement panel is required to draw up an accurate report and assists the judge. Hence, it is clear that such bodies exercise their role in collaboration with the judge as guarantors of the proper implementation of the entire proceeding.
The analysis procedure deals with all issues of major relevance regarding the regulation referenced herein, and goes straight to the heart of the discipline concerning civil debtor over-indebtedness. Also, the most important and innovative aspects, including the most problematic ones, are discussed, such as for example the evaluation of debtor credit worthiness, which represents both a subjective prerequisite for the debtor to be eligible for the Consumer Plan as well as a key element for the same to be discharged from bankruptcy in the asset liquidation process.
The French over-indebtedness legislation shall be described in a separate section, with the aim to provide a useful comparison with the Italian legislation on the same subject matter.
The main theme of the law, also covered in this paper, can be summed up with one question: Does this regulation actually enable distressed subjects, who are no longer able to fulfil their debt obligations, to resume an active role in society?
Answering such question indirectly gives rise to a focal problem: Does credit protection prevail over the protection of the individual in our legal system? Is there a limit beyond which the right of an individual to live a quiet and dignified life can prevail over the creditor’s right to initiate a debt recovery process, regardless of the debtor’s financial situation that mostly results from bad decisions made in the past?
